About this file

This is a Questions and Answers document (Amendment 1) for the Dexter NFH Aquatic Research Building Addition, Solicitation # 140FGA26R0039. The document addresses nine clarifying questions submitted by prospective contractors regarding project execution requirements and compliance matters.

Key requirements clarified include: the bid bond will only be required during Phase 2 of the project; design professionals must be licensed in New Mexico, not other states; one superintendent may fulfill supervision, safety, and quality control roles if meeting all required qualifications; contractors must submit contract/project-specific Quality Control and Safety plans; no local plan reviews or permits are required from authorities having jurisdiction; and materials purchased for the project are not tax-exempt for the contractor, as they constitute components of a larger project rather than a final deliverable to the Federal Government. The Government was unable to provide the manufacturer information for the existing pre-engineered building being tied into the new addition, citing unsuccessful efforts to locate this data, which may impact scheduling considerations given potential long lead times for metal building components.

Questions & Answers - Amendment 1

Dexter NFH Aquatic Research Building Addition

Solicitation # 140FGA26R0039 Questions and Answers

1. Referencing Form 1442 Paragraph 13b. Will the referenced Bid Bond only be needed for Phase 2, as we would need to price the project prior to obtaining a Bid Bond?

Response: Correct. The bid bond will only be required to return in Phase 2.

2. Please provide the manufacturer of the existing pre-engineered building we are tying into. Given the various and sometimes long lead times for pre-engineered metal building, this is valuable information in relation to the advertised Period of Performance.

Response: We have been unsuccessful in locating this information.

3. Is it acceptable to use a designer who is licensed only in a state other than New Mexico?

This is typically allowed on Federal projects.

Response: No, the designer must be licensed in New Mexico.

4. In executing this project, can one superintendent fulfill the supervision, safety, and QAQC roles?

Response: A superintendent may fulfill the roles of supervision, safety, and QC so long as they meet all required qualifications.

5. Are contractors required to issue a contract specific QA/QC Plan?

Response: Yes, a QC plan must be contract/project specific.

6. Are contractors required to issue a contract specific Safety Plan?

Response: Yes, a Safety plan must be contract/project specific.

7. Is this project tax exempt?

Response: While the Government is tax exempt, the firm that wins the award for this project is not tax-exempt on the purchase of materials for the project since it is not a purchase of a final product made on the behalf of the Federal Government.

Explanation: If firm “ABCDEFG” was purchasing items and handing them directly off to the Federal Government then that would be tax exempt. However, the materials you are purchasing are part of a larger project and not an end deliverable. For instance, when the Federal Government purchases computers from Dell, the materials Dell purchases that go into the

Questions & Answers - Amendment 1 computers (circuit boards, processors, video cards, software, etc) are not tax-exempt purchases for Dell. However, if the Federal Government was purchasing the computer from a vendor which was purchasing the computer from Dell on behalf of the Federal Government that would be tax exempt to the Federal Government and flow down to the vendor making the purchase from Dell. This is because the vendor would be making the purchase for the Federal Government and handing directly off to Federal Government as the final product.

8. Please identify whether plan review and permits are required from the local authorities having jurisdiction.

Response: No plan reviews or permits are required by local authorities.

9. Please confirm whether design professional are required to be licensed in the State of New Mexico.

Response: Yes, the design professional must be licensed in the State of New Mexico.
