Questions and Answers

1. We would like to submit a metal roof as an “equal” for approval.

Response Any equivalent item(s) will need to meet the specifications outlined in the documents provided by the Government. Submissions must demonstrate full compliance with all technical, performance, and material requirements shown in the solicitation and associated drawings.

2. I also had a RFI regarding the metal roofing. The drawings shows metal coping to match the roof which is 24 gauge galvalume but detail 6/A2.3 calls for coping to be .040 aluminum. Can we use the same gauge coping as roofing so everything stays the same?

Response

Anything submitted must meet the technical requirements outlined in the solicitation documents and specifications. The drawings and details govern the required materials. Detail 6/A2.3 specifically calls for.040 aluminum coping, and any proposed variation—including matching the coping gauge to the roofing—would need to be formally submitted and must demonstrate full compliance with all technical and performance requirements.

3. Section 1.2 states that the contractor shall possess an Unlimited Commercial license in the State of North Carolina.

Please confirm whether this license must be held directly by the prime offeror at the time of proposal submission, or whether the requirement may be satisfied through an appropriately licensed North Carolina general contractor participating as part of the prime contractor's project team/subcontracting arrangement. If the prime offeror is required to hold the license directly, please also confirm at what stage the license must be active.

Response An Unlimited Commercial license in the State of North Carolina must be held at the time of proposal submission. This requirement may be met either directly by the prime offeror or through a subcontractor or project team member who possesses the appropriate North Carolina license. In all cases, the license must be active at the time the proposal is submitted.

4. Is it possible to have the bid date extended by 1 or 2 weeks? We are very interested in the project but only found out about it recently.

Response The deadline for proposal submission will not be extended and will remain as previously established.

5. The plans say that special inspections are not required but the specs say they are? Please confirm.

Response

Specs govern over the drawings special inspections are required

6. Can the building be wood framed and use wood trusses if the contractor meets fire code and installs any required sprinkler system for no additional cost?

Response To convert from light-gauge steel to wood-frame at this juncture would entail a complete re-design of the Structural plans and details and runs contrary to initial guidance received during 35% Design. The issue was debated, and after analysis, light-gauge steel was the better choice in this wind zone.

7. In the specs and on drawing sheet A5.1, several details (1D and 3) have notes that point to the countertops and call out high pressure laminate but the finish legend has countertops as corian. Should countertops be corian and cabinets be PLAM? Or are some corian and some PLAM? Please clarify which is correct, specs, drawings, or finish schedule.

We would prefer Corian with PLAM cabinets.

8. Drawing Sheet L1, note 3, says to sod all disturbed areas. Confirm that the intent is to essentially lay sod across the entire pervious project area (i.e. entire LOD) and not just topsoil, seed, and stabilize disturbed areas? This will be very expensive to sod vs. seed if the intent is just to stabilize disturbed areas.

Response If sod is not used and soil and seed are used the contractor must water the seed and get grass growing until there is a suitable stand of grass without bare spots.

9. Drawing Sheet M-001, specification note 3.13 denotes commissioning as start up and training. Confirm that the mechanical contractor can perform this commissioning and an NEBB certified 3rd party commissioning agent is not required?

10. Will B08 - Solicitation Attachment (Price Schedule) be used for technical analysis or will the wining contractor be bound by this pricing schedule for schedule of values, change orders, or scope changes? Many times, subcontractors do not submit competitive pricing until about 30 minutes before bid time, and it is incredibly tough to submit the proposal with this pricing being exact, and is many times more akin to a budget than actual pricing once subcontracts are negotiated.

Response This is a firm-fixed-price contract. The proposed price represents the amount the Government will expect to pay.

11. Will the overhead, profit, and bond rates submitted on B08 - Solicitation Attachment (Price Schedule) be locked in for future change orders?

Response The overhead, profit, and bond rates proposed with your initial offer will be used for pricing future change orders, unless otherwise stated in the contract.

12. For B08 - Solicitation Attachment (Price Schedule), there is a line item for 11 Equipment but appliances such as range, refrigerator, and dishwasher are listed as owner furnished. Please clarify what equipment needs to be priced for 11 Equipment on the Price Schedule?

There is no problem leaving this section blank if you do not have anything to put.

13. For B08 - Solicitation Attachment (Price Schedule), typically the 27 Communications and 28 Electronic Safety and Security are priced by the 26 Electrical subcontractor. Can the pricing for Div 26, 27, and 38 be combined on one line item for 26 Electrical or will that be highlighted as a technical deficiency?

That’s acceptable

14. For technical Factor 3 – Past Performance. Will the Government accept a contractor’s completed CPARS evaluation or previously completed PPQ for a relevant project in lieu of having the client complete the Past Performance Questionnaire (PPQ) form included with the solicitation?

Yes. It is the offerors responsibility to ensure that required information is represented.

15. If prior CPARS/PPQ’s can be utilized – please confirm that the page count can exceed the 6 pages listed in the solicitation. Typically, these forms are approximately 3-4 pages each and will total to about 20 pages considering five (5) projects need to be provided for past performance.

16. There does not appear to be any Division 01 Specifications in regards to General Requirements for items such as schedules, safety, quality, environmental, etc. Do you have front end specs that you can provide?

Response Yes see attachment B08 - Solicitation Attachment (Division 01 Specifications - USFWS R4 General Requirements)

17. Will the awarded prime contractor be required to staff the job site at all times with a superintendent, quality control manager, and site safety & health officer? If so, can one person serve all functions or must 3 separate individuals be identified?

Response These three roles can be filled by one person provided they have the experience for all three roles.

18. With the Quality Control Manager be required to be on site 24/7 during construction activities? Or can they spot check and provide reports only?

QCM is a full time on sight position.

19. What are the qualifications required for the quality control manager? USACE CQM certificate? How many years of experience are required to be named the QCM for this project?

Response Minimum 5 years of experience, certifications such as USACE CQM are encouraged but not required. The Government reserves the right to assess anyone assigned to this position and request replacement should they have poor performance in said position.

20. With the SSHO be required to be on site 24/7 during construction activities? Or can they spot check and provide reports only?

SSHO is a full time on sight position.

21. What are the qualifications required for the SSHO? OSHA 30, First Aid/CPR, etc.? How many years of experience are required to be named the SSHO for this project?

Response Minimum 5 years of experience, certifications required are OSHA 30 and FirstAid/CPR at a minimum. The Government reserves the right to assess anyone assigned to this position and request replacement should they have poor performance in said position.

22. What type of schedules will be required for this job? Primavera P6 cost loaded? Or will a simple Microsoft Project CPM schedule be acceptable?

Either will be acceptable.

23. Do you have a schedule of special inspections required that you can provide to all bidders?

No

24. Tap / Impact / Utility Fees: Please confirm whether any water, sewer, electrical, telecommunications, tap, impact, connection, meter, capacity, or other utility fees are applicable to this project. If so, please clarify whether these fees are to be paid by the Contractor or directly by the Government.

Response This is unknown however if any of these are required it will be the responsibility of the contractor.

25. Testing and Special Inspections: The Statement of Work indicates that the Contractor is to provide and pay for an independent accredited construction materials testing laboratory.

Please confirm that the Contractor is responsible for all required materials testing and special inspections for the project and provide, if available, a complete list/matrix of the required testing and special inspections. Please also confirm whether any testing or special inspections will be provided and paid for directly by the Government.

Response There is no list/matrix of special inspections required. Specifications should call out what is needed. The cost will be the contractors responsibility.

26. Superintendent / Quality Control: The solicitation requires the proposal to identify a Site Superintendent and QA/QC personnel. May the Site Superintendent also serve as the Contractor's Quality Control/QA-QC representative?

Response:

Yes

27. Superintendent / Safety: Similarly, may the Site Superintendent also serve as the Contractor's safety representative/competent person?

Response They may be one person provided they have appropriate experience and certification to show they can perform both roles. The Government reserves the right to assess anyone assigned to this position and request replacement should they have poor performance in said position.

28. Kitchen Appliances: Please clarify the furnishing and installation responsibility for the kitchen equipment shown on the drawings, including the range/oven, range hood, dishwasher, microwave, refrigerator(s), under-counter refrigerator, coffee equipment, garbage disposal, and any other appliances. Please identify which items are Government-furnished/Contractor-installed, Government-furnished/Government-installed, or Contractor-furnished/Contractor-installed.

Response the range/oven(GFGI), range hood(GFGI), dishwasher(GFGI), microwave(GFGI), refrigerator(s) (GFGI), under-counter refrigerator(GFGI), coffee equipment(GFGI), garbage disposal(GFGI), and any other appliances(GFGI).

29. Owner-Furnished Light Fixture: The electrical drawings identify at least one fan-rated junction box with the notation "Fixture by Owner." Please confirm the extent of Owner-furnished lighting/fixtures and whether the Contractor is responsible only for the box, wiring, controls, and final electrical connection at these locations.

Response Contractor shall provide the box mounted to structure for a ceiling fan and pull wire with wire nuts switched per plans. Provide blank cover plate on ceiling junction box. Ceiling Fan desired in this space the Government will provide and install.

30. Workstations / Furniture: The drawings identify three workstations as N.I.C. Please confirm that all office furniture, workstations, desks, chairs, and related furniture are excluded from the Contractor's scope, with the Contractor responsible only for the electrical/data rough-ins and infrastructure shown.

31. Telecommunications / Data: The electrical documents state that telecommunications/data cabling will be installed by the Owner. Please confirm that the Contractor's scope is limited to the raceways, boxes, backboards, cabinets, pull strings, grounding, power, and other infrastructure shown, and that all data, telephone, CATV, fiber cabling, terminations, patch panels, equipment, and testing will be furnished and installed by others.

32. Structural Engineering / Delegated Design: The technical proposal requirements reference a Structural Engineer as part of the proposed team. Is the General Contractor required to retain a separate Structural Engineer for the overall project, or is engineering required only for delegated-design components such as the light-gauge roof trusses, structural cold-formed framing/StiffWall system, connections, and other engineered shop drawings?

Only for the delegated design components.

33. TAB / Commissioning: Please confirm whether HVAC testing and balancing may be provided through the mechanical subcontractor by a qualified/certified TAB firm, or whether TAB must be contracted directly by the General Contractor as an independent third party.

SPECIFICATIONS FOR CONSTRUCTION PROJECTS

DIVISION 01

GENERAL REQUIREMENTS

U.S. FISH AND WILDLIFE SERVICE

01 11 00 SUMMARY OF WORK

A. The Contractor shall furnish all labor, equipment, materials, and supplies necessary to result in fully complete and usable systems and facilities. The Contractor shall bring any discrepancies to the attention of the Contracting Officer (CO) during tendering. Failure to notify the CO of any discrepancies during tendering shall be the responsibility of the Contractor during construction.

B. The Contractor shall not take advantage of any apparent error, omission, discrepancy, or ambiguity on the Statement-of-Work or any other Solicitation Documents. If any error, omission, discrepancy, or ambiguity is found by the Contractor in the Drawings or Specifications, the Contractor shall immediately refer the same to the CO prior to beginning Work on affected task(s), for interpretation and decision via Request-for-Information (RFI), and such decision shall be final.

C. The CO shall have the right to correct apparent errors or omissions in the Statement of Work and to make such interpretations as they may deem necessary for the proper fulfillment of the Contract Documents. During the course of the Work, should any party discover any unaddressed conflicts, ambiguities, or discrepancies between the Drawings and the Specifications to which the Contractor has failed to call attention prior to submitting the offer, then the CO will interpret the intent of the Drawings and Specifications and the Contractor hereby agrees to abide by the interpretation of the CO and agrees to carry out the Work in accordance with the decision of the CO. In such event, the Contractor will be held to have included in the offer the most expensive material and/or method of construction.

D. Schedule of Items

1. Base Bid Tasks shall be included at Contract Award.

2. Option Bid Tasks may be exercised at the time of award or during the Contract Period of

Performance.

3. The price of any necessary ancillary Work (any trade) shall be included as incidental to the price offered for the principal price line(s) listed in the solicitation.

4. The solicitation may include multiple Work Items (price lines), and the USFWS reserves the right to award any (or any combination of) Work Items to the extent of available funds.

E. Unless otherwise stated, the Contractor shall be solely responsible for carrying out all tasks, duties, and obligations specified throughout the General Requirements in fulfillment of the Work.

01 11 10 INSTRUCTIONS

A. Provide a written Action Plan for Demolition, Disposal, Recycling, and Construction Activities, which shall be approved by the CO and the COR before any demolition, disposal, recycling, and construction activities can begin in the area in its entirety. Demolition, disposal, recycling, and construction activities on the Station shall be coordinated with the Station Manager.

B. The procedures, means, and methods of construction are solely the responsibility of the Contractor, and the Contractor may choose any that follow general best practices and are calculated to secure results that satisfy the requirements of the contract; however, this is subject to the right of the CO to reject means and methods proposed which, in their opinion:

1. Constitute a hazard to the Project, Work, persons, or property.

2. Will not produce finished Work in accordance with terms of the Contract.

3. Are contrary to specified means or methods included in the Contract.

C. Unless directly specified in the Solicitation Documents, the Government shall not provide or furnish any products, labor, equipment, materials, utilities, or security.

01 11 20 PRE-OFFER BID MEETING

A. Pre-Offer Bid Meeting: Refer to Solicitation for scheduled meeting day and time.

01 11 25 INQUIRIES

A. Questions shall be directed to the CO; refer to Solicitation.

01 11 30 SPECIAL NOTICES

A. Period of Performance: Refer to Solicitation.

B. Comply with Davis-Bacon Wage Rates and Buy American. The Contractor shall ensure employees and

Subcontractors are paid on time according to a predetermined pay period or pay schedule. The pay period or pay schedule shall be mutually agreeable between the Contractor and its employees and/or Subcontractors.

C. The Contractor or the Contractor’s designated representative (who will directly oversee the construction Work) shall attend a Preconstruction Meeting with the COR prior to mobilization onto the site. The Contractor or the Contractor’s designated representative shall be on site while any contract-related Work is in progress.

D. Remove and dispose of all demolition items in a legal manner off the USFWS property and in accordance with all Federal, State, and Local Regulations.

01 11 40 WORK RESTRICTIONS

A. Accomplish the Construction Work in a manner that does not interfere with ongoing field station operations.

B. Habitat Restrictions: Wildlife habitat issues may restrict building seasons. The Contractor shall coordinate with the COR and the Station Manager for requirements.

C. Work Hours: Unless otherwise specified, onsite construction Work shall be conducted during normal business hours of operation for that facility, except on Federal holidays, unless approved otherwise.

Requests to change working hours shall be submitted in writing to the CO at least 48 hours in advance.

D. Site Access: The Contractor shall have limited use of premises for construction operations during the construction period. The Contractor's use of premises is limited by the need of the USFWS for uninterrupted operations and the right to perform Work in affected areas.

1. Use of Site: Limit use of Project site to areas indicated within the Contract limits or approved of by the Contracting Officer (CO). Do not disturb portions of Project site beyond areas in which the Work is indicated.

2. Time Log: The Contractor shall submit a log recording the time of entrance and time of exit of all personnel, including any Subcontractors and Suppliers.

3. Condition of Existing Building: The Contractor shall maintain portions of existing buildings affected by construction operations in a weather-tight condition throughout construction period. The Contractor shall repair damage caused by construction operations.

E. Housing for Workers and campsites are not available on site unless explicitly indicated otherwise in the Task Order.

F. Government buildings and other facilities are not available for storage of the Contractor’s materials, equipment, or tools. Government-owned equipment is not available for the Contractor’s use to accomplish any Work.

G. Existing Utility Interruptions:

1. Maintain in operating condition all active utilities servicing other facilities.

2. Repair any damage to active utilities servicing remaining facilities.

3. All work will be in accordance with local, state and national building codes and local regulations governing the utility concerned.

4. Limit all service outages to a maximum of 4 hours unless written permission is obtained from the COR and the Station Manager.

5. Do not interrupt utilities serving facilities occupied by the USFWS or others, unless having arranged to provide temporary utility services according to the requirements indicated and under the following conditions:

i. Notify the COR not less than 10 calendar days in advance of proposed utility interruptions.

ii. Do not proceed with utility interruptions without written permission from both the USFWS and the utility company.

01 20 00 PAYMENT PROCEDURES

A. No measurement of the Work shall be made unless unit prices are included in the Project.

B. Payment: Monthly payment shall be made for approved Work performed in accordance with the contract requirements under the items listed in the Schedule of Items and on the basis of the approved Schedule-of-Values.

C. Application for Payment:

1. Schedule of Values:

i. Prepare a Schedule-of-Values in the format (or approved equivalent format) of the USFWS Form E15.

ii. Submit a detailed Schedule-of-Values within seven (7) days prior to the start of onsite construction Work and shall format the Schedule-of-Values to match the Pricing Schedule and provide sufficient additional detail to allow accurate calculation of monthly progress payments.

2. Certified Payrolls: Submit certified payrolls to CO, current to within 1 week of payment application period.

3. Invoicing:

i. Submit the preliminary pay request to the COR via e-mail prior to uploading their pay request to the Internet Processing Platform (IPP) Website (https://www.ipp.gov/). The pay request shall include a Schedule-of-Values with percentage of Work completed.

ii. The COR will return a signed and approved invoice to the Contractor, who shall upload it into IPP.

01 31 00 PROJECT MANAGEMENT AND COORDINATION

A. The Government Standard Forms, specifications, associated plans, solicitation provisions, and contract clauses made a part of the contract are essential parts thereof; the requirements in one are as binding as though contained in all. They are intended to be mutually supplementary to describe and provide for a completed Project.

1. The provisions of Government Standard Forms shall govern in cases of conflict with specifications, contract provisions, and supplemental agreements forms. In all cases of dispute, the CO shall decide which part or parts of the specifications apply to any given parts of the Work with respect to such conflict.

B. Coordination

1. Coordinate scheduling, submittals, and Work of the various sections of specifications to ensure efficient and orderly sequence of installation of interdependent construction elements.

2. Verify that utility requirement characteristics of operating equipment to be delivered in the

Work are compatible with building utilities.

3. Provide field surveying to accurately establish the horizontal and vertical locations of the Work.

C. Government-furnished drawings shall not be scaled to obtain missing or conflicting dimensions. The Contractor shall monitor dimensions and details throughout the progression of the Work. Any errors or discrepancies discovered shall be promptly reported to the COR.

D. Accomplish construction Work in a manner that does not interfere with ongoing station operations, nor allow any construction material, soil, or debris to enter waters of the State.

E. Record Drawings and Specifications: Maintain one set of working drawings and specifications, for record purposes, on the project site while work is in progress. Clearly and accurately record the as-constructed work in red. Record swing-tie distances from permanent points for all underground items. Include modifications and RFIs.

01 31 10 CONTRACT ADMINISTRATION

A. Authority of the COR is limited to the following functions:

1. Inspect, and either accept or reject Construction Work and Materials, including approval or disapproval of materials, submittals, and shop drawings.

2. Ensure compliance with technical contract terms and conditions.

3. Clarify specifications and drawings in which clarification would not result in modifications of contract cost or time. Any resulting disagreements are to be immediately referred to the CO.

4. Verify and recommend payment estimates on progress payments and forward progress payments to the CO for approval.

5. Enforce safety requirements in accordance with the Federal Acquisition Regulations (FAR), OSHA regulations, and any applicable Solicitation Documents and USFWS policies.

6. The COR may perform any duties of the Inspector in Section D.

B. The COR is not authorized to take the following actions, all of which remain the sole responsibility of the CO:

1. Make any changes to the contract provisions, period of performance, or contract terms and conditions.

2. Make decisions concerning any claims and disputes.

C. The COR shall immediately notify the CO of any problems encountered, including, but not restricted to, maintaining completion schedules.

D. Authority of the Inspector: An Inspector employed by the Government may assist the COR in observing the Work, obtaining measurements, and enforcing strict compliance with the terms and conditions of the Contract.

1. The Inspector shall have free access to the jobsite at all times while construction Work is in progress, and the Contractor shall furnish such information and assistance as is necessary.

2. The Inspector shall record the construction Work accomplished.

3. Unsuitable materials or construction Work that does not comply with the terms and conditions of the contract may be rejected by the CO as a result of inspections.

4. The Inspector shall observe and ensure construction is performed in conformance with the contract health and safety requirements.

5. The Inspector shall conduct wage rate interviews and report suspected labor standard violations to the CO.

6. The Inspector shall check and verify the progress payment requests.

E. Do not initiate extra work without written notification to the CO and the COR and receiving written approval in response from the CO.

01 31 20 PERFORMANCE OF WORK BY THE CONTRACTOR

A. Provide the COR all reasonable facilities for obtaining information respecting the character of the materials and progress of the Work. Furnish information to include the number of Workers employed, their pay rate, time worked, and other elements of cost requested by the COR. No personal information from personnel should be included for PII purposes.

01 31 30 GENERAL TECHNICAL REQUIREMENTS

A. Perform the Work in accordance with all Contract documents, including but not limited to drawings and technical specifications, and all provisions of the Contract.

B. The Contractor shall field-verify and validate dimensions, elevations, and Project area features before commencing construction. The Contractor shall promptly notify the CO and the COR of any conflicts upon discovery.

C. The Contractor shall maintain a General Contractor licensure, or equivalent depending on the scope of the work, in the State in which the Project is located.

D. Comply with all State requirements for licensure in the State in which the Project is located.

E. Maintain on staff a Professional Engineer or Professional Architect licensed in the State in which the

Project is located.

F. All Work of each trade must be overseen by individuals licensed and/or certified in that trade in the

State in which the Project is located.

G. Welding shall be performed only by licensed welders and in compliance with American Welding Society

(AWS) recommended practices. Welds shall have structural integrity and be neat in appearance.

01 32 00 CONSTRUCTION PROGRESS DOCUMENTATION

A. Weekly Construction Reports: Submit weekly to COR, to include:

1. Construction Daily Reports: For the Duration of the Construction Contract, submit a

Construction Daily Report for each Work Day, which includes the Contract Number, Title and Location of Project, Report Number, Contractor Designation, Subcontractor Designation, Superintendent Designation, Morning Weather Description, Afternoon Weather Description, Maximum Daily Temperature, and Minimum Daily Temperature. Also, include the Day’s Scheduled Activity Number(s), Work Location(s), Work Description(s), Employer(s), Number of Worker(s), Trade(s), Number of Work Hour(s), Work Item(s) Completed, and Job Safety Checklist(s). The Contractor may include additional entry fields on their Construction Daily Reports at their own discretion.

2. Site Observation and Inspection Reports: For the Duration of the Construction Contract, prepare and submit Site Observation and Inspection Reports for each Work Day. Site Observation and Inspection Reports shall be prepared and submitted by the Third Party Testing Company under Subcontract to the Contractor. Where necessary, the Contractor will take corrective actions if the Inspection Company notes any deficiencies.

3. Provide daily activity logs and checklists to record daily activities and submit them weekly to the CO and COR.

4. Provide construction photographs of the Work on a weekly basis and a final set of photographs after date of Substantial Completion and all temporary structures have been removed.

5. Time Logs as per §01 11 40 (D) (2).

B. Schedule:

1. Submit an initial schedule at the Preconstruction Meeting.

2. Develop schedule on commercially available computer scheduling software.

3. Provide schedule showing Work breakdown structure or precedence diagram.

4. Identify day, date, duration, and float for each Work activity.

5. Break down activities by skillset or trade and by geographic location within Work

6. Identify all interfaces with Government that may impact schedule. Keep Government interfaces away from critical path to maximum extent practical.

7. Promptly update schedule to reflect any changes or delays in the Work.

8. Provide 3–4 week look-ahead Schedules. Update Schedule monthly and submit to the COR.

Coordinate activities with Station Manager.

C. Project meetings

1. Preconstruction Meeting: COR will arrange a Preconstruction Meeting prior to start of any construction. Require attendance by all parties affected by the Work. Take and distribute meeting notes to all affected parties.

2. Progress Meetings: Coordinate progress job meetings as required by the progress of the Work and shall require attendance by all parties affected by the Work.

3. Record and distribute meeting notes to all affected parties. Notes shall be distributed within 72 hours of meetings.

01 33 00 SUBMITTAL PROCEDURES

A. Master Submittal List: Submit comprehensive submittal register identifying all submittals required.

Submit register at Preconstruction meeting. Identify each submittal by title and appropriate specification section along with responsible party to review and approve. Sequentially number each submittal.

B. Electronically transmit submittals with the Government-furnished Submittal Form 4-18 that will also be used as the document for approving or disapproving submittals. Government shall furnish R1-67 in Word format for use. Submit R1-67 form in Word format for transmittal sheet of each submittal. Obtain written approval before items are ordered. Use a separate R1-67 form for each broad category of material to avoid confusion should a re-submittal be necessary.

C. Submit all submittals to the COR, viewed and signed by the Contractor, indicating they comply with the contract requirements. Submittals without the Contractor’s signature will be returned without action.

D. Submittals shall contain detailed product literature, shop drawings, material samples, and/or finish samples fully describing the items proposed for installation.

E. Conspicuously mark the item submitted to explicitly indicate the specific options, models, mechanical/electrical characteristics, trim styles, colors, sizes, etc. Annotate the submittal to cross reference to the mark numbers/group numbers shown on the drawings and/or specification.

F. Tab and index submittals containing more than ten pages.

G. Explicitly and clearly indicate all features that differ from the contract requirements.

H. Submittals will be returned to the Contractor within 21 calendar days of the date received by the COR.

I. Submit documentation for all products, materials, and equipment proposed for use.

J. Material Certifications:

1. Submit manufacturer’s certificate indicating that the material or product conforms or exceeds specified requirements. Submit supporting reference data, affidavits, and certifications as appropriate.

2. Certificates may be recent or previous test results on material or product but must be acceptable to the COR.

K. Samples:

1. Submit exact product or material to be used.

2. Submit product sample of size specified and of sufficient size to clearly show the characteristics, integral parts, and attachment of the product or system.

3. Submit interior and exterior color and texture samples at one time for coordinated review by the COR.

L. Submittal reviews by the Government do not waive or alter the contract requirements. Submittal acceptance is not Government certification of materials or products. Any deviation from the contract requirements must be specifically brought to the attention of the CO and the COR in writing and upon the drawings, or by appropriate change order.

01 34 00 BASELINE SUBMITTAL LIST

A. Descriptive Product Literature: Provide Descriptive Product Literature for the principal components of any trade Work. See also individual design drawings and technical specifications for specific requirements.

B. Progress Schedule: Submit the proposed progress Work schedule for approval within 15 days after award of contract. Itemize each principal component/phase of Work and the calendar days of anticipated performance. Submit a revised schedule any time the actual Work progress delays the scheduled time by more than 14 calendar days.

C. Schedule of Values: Submit a detailed Schedule-of-Values within 7 days prior to the start of onsite Work.

Format the Schedule-of-Values to match the Schedule-of-Items and show sufficient additional detail to allow accurate calculation of monthly progress payments. Lump sum items shall be broken down into their component parts as applicable with a cost shown for each, such as mobilization, bond and insurance, and the principal components of the Work.

D. Subcontract List: Submit each proposed Subcontractor on a SF 1413 (Statement and Acknowledgment) in accordance with Paragraph (d)(1) of FAR Clause 52.222-11. SF 1413s within 14 days after award of the contract.

E. Key Personnel Names: Within 14 days of starting construction operations, submit a list of key personnel assignments, including superintendent and other personnel in attendance at Project site. Identify individuals and their duties and responsibilities; list work addresses, telephone numbers, and e-mail addresses. Provide names, addresses, and telephone numbers of individuals assigned as alternates in the absence of individuals assigned to Project.

1. Project Superintendent with a minimum of five (5) years of experience in coordinating Subcontractors in the construction industry.

F. Testing Agency Qualifications: For testing agencies specified in "Quality Assurance" Article to demonstrate their capabilities and experience; include proof of qualifications in the form of a recent report on the inspection of the testing agency by a recognized authority.

G. Permits, Licenses, and Certificates: Submit copies of permits, licenses, certifications, inspection reports, releases, jurisdictional settlements, notices, receipts for fee payments, judgments, correspondence, records, and similar documents established for compliance with standards and regulations bearing on performance of the Work.

H. Quality Control Plan (QCP): Prepare and submit a Quality Control Plan (QCP). Provide delineation of Laboratory and Institute (Onsite) Tests and Inspections to be performed by the Contractor’s Independent Testing Agency under Subcontract. Refer to Technical Specifications for Scope and Quantity of Tests and Inspections required for the Project.

1. Refer to General Requirements Division 1, Section 01 44 00 Testing and Inspection and related Technical Specifications for specific requirements.

I. Quality Control Test Reports: For the Duration of the Construction Contract, perform Quality Control Tests and prepare and submit Quality Control Test Reports for each material to be provided and installed.

J. Close-Out Documents: Submit documents listed in Specification 01 78 00.

01 35 00 SPECIAL PROCEDURES

A. Immediately stop Work and notify the Inspector, the COR, and the CO if paleontological, archaeological, or historical remains, including burials or skeletal material, are encountered. The CO will notify the Regional Archaeologist so that the provisions of the National Historic Preservation Act, 16 USC 470f, 54 USC 306108, 36 CFR 800, and other relevant laws, regulations, and standards are followed. Work will cease in the immediate vicinity until permitted to resume by written order from the CO. Work in other areas may proceed as approved by the Regional Archaeologist.

B. Site Safety:

1. The Contractor is responsible for safety on the Project site at all times, from issuance of the

Notice to Proceed until final completion and acceptance of the Work by the CO.

2. The Contractor is responsible for ensuring that all onsite activities, equipment, and facilities constructed by the Contractor, Subcontractor, or Supplier conform fully to the Department of Labor, Occupational Safety and Health Administration (OSHA) standards 29 CFR 1910 (Occupational Safety and Health Standards) and 29 CFR 1926 (Safety and Health Regulations for Construction); and any applicable the DOI policies and the USFWS policies.

3. Adhere to all current Federal, State, and Local safety requirements. In the event where any safety standard referenced herein conflicts with another, the more stringent shall govern.

4. Prepare and submit a Site-Specific Safety Plan, a Job Hazards Analysis (JHA), and a Health and Safety Plan (HSP) that is to include detailed Project data provisions for the identification, evaluation, prevention and control of general Work site hazards, specific job hazards, and potential hazards that may arise from foreseeable construction methods, conditions, and Site conditions, as well as providing a competent person to conduct frequent and regular inspections.

5. Initiate and maintain, throughout the performance of this contract, an effective safety program that provides adequate policies, procedures, and practices to protect their employees from, and allow them to recognize, job-related safety and health hazards.

6. Each employee of the Contractor and all Subcontractors must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the Work environment.

7. Where Work affects transportation assets, provide traffic control conforming to the latest edition of the Manual on Uniform Traffic Control Devices (MUTCD) as published by the US Department of Transportation, Federal Highway Administration as necessary to safeguard the Public, Workers, and Government personnel, to include:

i. Furnishing, transporting, and installing barricades, warning signs, and delivery truck routing signs.

ii. Furnishing, transporting, and installing traffic control devices, such as cones, drums, flashers, barricades, and signs to safely channel or direct traffic.

iii. Flag persons in conjunction with traffic control devices when necessary.

8. Unless otherwise specified, buried utilities have not been located by the Government. The

Contractor shall have all underground hazards and utilities investigated and located prior to construction and shall protect all utilities throughout the Work. Notification of effected utility companies is the responsibility of the Contractor.

C. Hazardous Materials: The proposed Work areas are believed not to contain any materials regulated as “hazardous” or similar designation. However, immediately stop Work and notify the COR in writing should any unknown hazardous materials be encountered.

01 40 00 QUALITY REQUIREMENTS

A. The Contractor shall be responsible for Quality Control (QC), but such authority may be delegated to Subcontractors or construction managers to ensure the construction process and final product meet specified standards. QC involves on-site inspections, material testing, and monitoring workmanship to identify and address defects or issues promptly. The Contractor and Subcontractors are responsible for detecting and rectifying deficiencies to prevent any compromise to the overall quality of the Project.

Detailed records of inspections, observations, corrective actions, and completion must be maintained throughout the QC process.

1. The Contractor is responsible for ensuring the overall quality of all its own Work and the Work performed by their Subcontractors under this contract.

2. All Work performed must meet or exceed the standards outlined in the technical divisions of this specification.

3. If the CO identifies Work that does not comply with the specifications or drawings, the Contractor will be notified in writing of the nonconformance. The Contractor must correct the deficiencies and provide the CO with written documentation of the corrective actions taken within seven (7) calendar days.

4. Supervision: During all onsite Work, maintain onsite at least one qualified Project Manager or Project Superintendent with a thorough understanding of the Project and capable of reading, write, and conversing fluently in the English language.

B. Noncompliance with Quality Control Requirements: Failure of the Contractor to comply with the above requirements may be cause for Termination-for-Default.

C. Quality Control Procedures:

1. Monitor quality control over the Contractor staff, Subcontractors, Suppliers, manufacturer's, products, services, site conditions, and workmanship.

2. Comply fully with manufacturer's published instructions, including each step-in-sequence of installation.

3. Request clarification from CO before proceeding if manufacturer's published instructions conflict with Contract Documents.

D. Comply with specified standards as a minimum quality for Work, except where more stringent tolerances, codes, or specified requirements indicate higher standards or more precise workmanship.

E. Perform Work by persons who are thoroughly qualified and trained in their respective trade, to produce workmanship of specified quality.

F. Perform tests required by governing authorities and utilities having jurisdiction.

G. Maintain check-off list of Work that does not comply with Contract Documents, stating specifically what is non-complying, the date on which faulty Work was originally discovered, and the date on which faulty Work was corrected. There is no requirement to report deficiencies corrected same day it was discovered. Submit copy of Non-Compliance Check-Off List of non-complying Work items to CO on a weekly basis.

H. Prior to final acceptance by CO, submit a certification signed by the Contractor to the CO stating that all Work has been inspected and all Work, except as specifically noted, is complete and in compliance with Contract Documents.

01 41 00 REGULATORY REQUIREMENTS

A. Regulatory Requirements:

1. Comply with all applicable Federal, State, and Local environmental laws, regulations, and standards, including but not limited to the Federal Acquisition Regulation (FAR) and those related to building design and construction, noise levels, air and water quality, and cultural resources.

2. Design and construct in accordance with all applicable Federal, State and Local codes and regulations (latest edition at the time of contract award), with the following establishing the minimum requirements:

ii. National Fire Protection Association (NFPA) 101 Life Safety Code

3. The more stringent code provision(s) shall govern in any conflict between code provisions. In any instances where the Design Drawings and Technical Specifications do not specify explicit materials or methods, the Contractor shall perform the Work in accordance with the minimum requirements of the code applicable to the Work.

4. Failure of this document to provide all applicable codes does not absolve the Contractor from such requirement. It is the responsibility of the Contractor to identify and apply all applicable codes to the Work.

B. Permit Responsibility:

1. Customary mechanical and electrical trade permits may be required. The Contractor shall arrange for, obtain, and pay for any customary mechanical and electrical trade permits and licenses.

2. Include fees for items above as a line item in the Schedule-of-Values.

3. The Contactor shall obtain natural resource permits associated with in-stream Work.

4. The Contractor is solely responsible for paying any fees, permits, inspections, taxes, and similar associated with the Work, unless otherwise specified.
