About this file
This document is a Questions and Answers (Q&A) Amendment 2 for Solicitation 140FGA25Q0036, issued by the U.S. Fish and Wildlife Service (FWS) for a remediation project at a former firing range. Key details include clarifications about groundwater sampling (contractors need a statement from the State of Nebraska stating sampling is not applicable), topsoil provision (Refuge will provide topsoil), and sampling requirements for the firing range site. The project involves site characterization, soil sampling, potential remediation of 165 cubic yards from a berm, and off-site disposal of contaminated soil.
The Q&A document addresses multiple vendor questions, including laboratory certification, lead abatement requirements (no specific certification needed), and disposal location for contaminated soil. The solicitation requires a lump sum price for the total project, with contractors responsible for finding a disposal location for contaminated soil. Contractors must perform a sampling grid of the firing range and provide a map of sampling locations. The government emphasizes that one quote is required for the total work, and any additional soil remediation beyond the initial scope could be addressed as an unforeseen site condition through contract modification.

140FGA25Q0036 – Amendment 2 8/25/2025 Q&A Document
1. Global comment: Request the SOW Specification Sections be updated accordingly for the changes (if any) to the requirements, to verify that contractors all bid the same scope of work.
ANSWER: Please refer to the last set of questions for updated responses and changes to SOW.
2. Price Schedule: Please provide a revised Standard Form 18 with identified task breakdown (e.g., Site Characterization, Remediation, Confirmation Sampling, and Reporting) and units. There is only one unit item shown.
ANSWER: Please answer on the SF18 as a “LUMP SUM PRICE”
3. Groundwater Sampling Requirement Conflict Discrepancy between Vendor Q&A Responses to #2, #10, and #12 - Reference: SOW Section 01100, Part 1.2 and Division 2, Section 3.1 of the SOW– FWS has responded both that 1) groundwater sampling is not required for this project and the Contractor must get a waiver from the state of Nebraska that has this explanation, and 2) groundwater sampling is required during confirmatory sampling phase. Is groundwater sampling required for this project?
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
4. Analytical Laboratory: The choices for NELAC-approved analytical laboratories in the state of Nebraska are limited. To ensure the most competitive price for the Government, would another NELAC or NELAP-certified analytical laboratory in another state be acceptable?
ANSWER: NELAC- approved lab must follow all Nebraska regulations if not located in Nebraska.
5. Clarification on Topsoil – Vendor Q&A #3 – If the Refuge is providing the topsoil, but the Contractor is responsible for transporting it to the site and spreading it, where is the Contractor transporting the topsoil from (provided by Refuge)? Please provide an address or coordinates so trucking can be estimated consistently amongst bids. Please revise the SOW if the Refuge is NOT providing the topsoil and expects the Contractor to source and import to the jobsite.
ANSWER: Follow the SOW Part 3 – Execution 3.5 “Refuge will provide topsoil and revegetate the site” Contractor is responsible for ensuring the ground is level after remediation and berm removal.
6. Clarification on Vendor Q&A #5 – Division 1, Part 1.2(A), discusses characterizing the soil of the former firing range, however the answer to the sample depth across the full range area discusses an area 200 meters OUTSIDE of the range for background samples. Both background sampling and areas outside the range are not in the SOW. Is the contractor to assume that background lead samples should be collected in addition to the characterization and confirmation samples (or for total metals as per the SOW)? Are any samples behind the berm required.
ANSWER: No samples behind the berm are required. 200 meters is the length in front of the berm where rounds may have been shot from on the range of firing.
7. Clarification on Vendor Q&A #7 – there does not appear to be any response to question #7.
Please provide.
ANSWER: The Contractor shall be required to perform the sampling grid of the firing range and provide a map of the sampling locations and where the sampling is to be performed.
8. Clarification on the last page of the Q&A file, there is a #27 that does not appear to match any RFI number on previous pages. Please include the question this is in response to.
ANSWER: Unknown mistake
9. In the Q & A issued on August 19, we noticed Question 7 requesting a Sampling Location Map appears to not have been answered. Will this be answered in a future amendment?
ANSWER: The Contractor shall be required to perform the sampling grid of the firing range and provide a map of the sampling locations and where the sampling is to be performed
10. On the site visit, attendees were told that Offerors would be able to dispose of the dirt in the nearby Landfill in Valentine. We have recently been informed that the Landfill in Valentine will not allow any dirt from this project in their landfill. Is FWS aware of this? Please advise on any alternative landfills or if the Offeror should select the disposal location.
ANSWER: It is the contractors responsibility to find a location to bring the contaminated soil.
11. In regards to question 22: If confirmatory samples on the berm or firing range area exceed clean-up goals, should the contractor provide separate costs to perform remediation of this additional material? This is above and beyond the current scope of work including 165 cubic yards from the berm.
ANSWER: One quote is required.
12. Question 2 indicates that GW samples shall not be collected. Question 12 indicates that GW sampling would occur “during the confirmatory sampling phase.” Please clarify.
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
13. Question 4 indicates that the contractor needs to be certified in lead abatement in the State of Nebraska, but not the consultant. Question 9 indicates the Contractor and contractor personnel need to be certified in lead abatement in the State of Nebraska. Please clarify if the “consultant” is the contract holder overseeing the work onsite and performing sampling/executing the project, while the “contractor” is the excavation and remediation firm responsible for excavation/sieving/loading soil for off-site disposal.
ANSWER: The consultant/contractor does not need a certification
14. Can current OSHA HAZWOPER 40-hr. training replace a requirement for lead abatement certification in the State of Nebraska?
ANSWER: The consultant/contractor does not need a certification
15. Based on the Q&A, it sounds like the Contractor is to import the topsoil. How deep should the topsoil be? Should Offerors assume the imported topsoil will go over the entire disturbed area?
ANSWER: Follow the SOW Part 3 – Execution 3.5 “Refuge will provide topsoil and revegetate the site” Contractor is responsible for ensuring the ground is level after remediation and berm removal.
16. Based on Question 2 in the Q&A, we understand that groundwater sampling is not currently included in the scope of work. However, the answer to Question 12 indicates that groundwater sampling is required in the confirmation sampling phase.
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
17. Can you confirm that the scope of work does not include groundwater sampling?
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
18. If groundwater sampling is not included in the base scope of work, would the US FWS want an optional line-item cost provided in the event the NDEE does not allow a groundwater waiver and requires groundwater sampling as a condition for receiving the NFA Letter?
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
19. According to the Nebraska DHHS website, a lead abatement certification is required only for activities intended to permanently eliminate lead-based paint hazards. Additionally, based on a phone conversation with the Nebraska DHHS Lead Program, they confirmed that lead contaminated soil or groundwater falls outside of their jurisdiction. Since this scope of work does not involve any lead-based paint, we understand that a lead abatement certification would not be applicable.
ANSWER: The consultant does not need a certification
20. Could you please confirm whether a lead abatement certification is still required under these circumstances? Would alternative health and safety measures (such as using 40-hr HAZWOPER trained personnel and adherence to a site-specific health and safety plan) be acceptable for personnel working with the lead-impacted soil?
ANSWER: The consultant does not need a certification
21. The government response to RFI #2 and RFI # 12 contradict one another. RFI #2 states that groundwater sampling is not required with a variance from the State of Nebraska, while RFI #12 states that groundwater sampling is required during the confirmatory sampling. Please clarify.
ANSWER: The contractor will need a statement from the State of Nebraska stating groundwater sampling is not applicable.
22. The government response to RFI #4 and RFI #9 contradict one another. RFI #4 states that the contractor does not require lead certification, while RFI #9 states that the contract must possess lead certification. Per the State of Nebraska regulations, lead-certification is only required for lead-based paint assessment and remediation, and not for lead contaminated soil assessment and remediation. Please clarify.
ANSWER: The consultant/contractor does not need a certification
23. Please clarify the response to RFI #16. Should the contractor pricing assume the potential for stabilizing the entire 165 cubic yards of material form the berm face.
ANSWER: One quote is required for the total work to complete the remediation.
24. Please clarify the response to RFI #22. The response states that the contract is responsible for all potential remediation costs for areas that have yet to be assessed. This approach does not allow for direct comparison from offerors for a LPTA award. Can the Government please provide an optional CLIN for an assumed additional amount of contaminated soil that may need to be stabilized and disposed of offsite?
ANSWER: One quote is required for the total work to complete the remediation. This is why a lump sum price for this total project has been requested. This is how offeror’s proposals will be compared. If there is an additional amount of soil that is not considered at the time of award based on the statement of work, this could be addressed as an unforeseen site condition in which a modification could be negotiated.
