About this file

This is a Single Source Justification form (FWS Form 3-0034) submitted by the U.S. Fish and Wildlife Service for a purchase under the Simplified Acquisition Threshold (SAT). The U.S. Fish and Wildlife Service's Joint Administrative Operations Acquisitions Operations office seeks to procure a spare submersible pump (Pentair Fairbanks Nijhuis, 5430 Series, D5433MV) as an exact replacement for two existing Fairbanks model 6" D5433MV pumps currently operating at Sullivan Creek National Fish Hatchery. The required pump specifications include 15 horsepower, 1150 rpm, 230/3 voltage, 25-foot power cords, stainless steel impeller and case wear rings, and must be sized for 1200 gallons per minute at 30 feet total dynamic head.

The justification for sole-source acquisition is based on technical compatibility requirements: the existing effluent system has a unique rail-mounted design with specific tail hooks that only the Fairbanks brand and model can accommodate, and no alternative pump brand fits the existing infrastructure without significant retrofitting and cost increases. The contracting officer determined that purchasing a different brand would necessitate expensive system modifications and could cause operational delays leading to fish health issues, flooding of the egg incubation facility housing 7.4 million lake trout eggs, and inability to maintain proper water quality in brood fish ponds. Fair and reasonable pricing will be determined at the time of award. The Program/Project Officer (Crystal Legault-Anderson) and Contracting Officer (Dana Arnold) certified approval of the sole-source acquisition procedures under FAR Part 13 on November 5, 2026.

1. Description of Need

3. Other Capable Sources

2. Market Research Conducted

Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Instructions: The information in the text boxes are provided as sample language or to indicate a needed fill-in. Sample language should be removed from the final document. All text boxes require information and shall not be left blank.

Text3: No other brand name of submersible pump will fit into our existing effluent system. Purchase of a different brand of pump will cause an increase in cost since we would have to retrofit our existing effluent infrastructure to fit the differing pump. Any delays in replacing one of the other two working Fairbanks pumps, if/when one fails, would also cause fish health issues, flooding of our egg incubation building, which currently houses 7.4 million lake trout eggs destined to multiple fish hatcheries for eventual stocking as fish.
Text2: We need to purchase an exact match, the same exact brand name and model of pump to fit into our existing waste water system. We currently operate two Fairbanks model 6”D5433MV, 15hp, 1150 rpm, 230/3, submersible pumps, sized for the design condition of 1200 gallons per minute (gpm) at 30 feet total dynamic head (tdh), with 25-foot power cords, stainless steel impeller and case wear rings. No other brand name pumps have the needed tail hooks which fit the rail system used to raise and lower the pumps, and only this brand and model of pump fits into our existing effluent infrastructure.
Text1: The fish waste effluent system at Sullivan Creek NFH requires a spare pump (Pentair Fairbanks Nijhuis, 5430 Series, D5433MV) that matches the exact specifications of the two existing pumps currently in operation. Due to the unique build of the system, only an identical pump will fit and function properly with the rail system used for installation and removal, as well as ensuring the pump seats correctly and sits flush with the current effluent piping at the bottom of the rail system. If one of the two pumps in operation fails, and we do not have a spare, our egg incubation building will flood, and we will not be able to clean the silt, feces, food, from our brood fish ponds, which will cause fish health issues. All fish effluent water at Sullivan Creek must be pumped.
Text4: Future acquisitions that do not require an exact matching pump will be competed as required by the Federal Acquisition Regulation.
Text6: Price will be determined fair and reasonable at the time of award.
