About this file
This document is a Justification for Other than Full and Open Competition (JOFOC) for the repair of the concrete headbox structure at the Craig Brook National Fish Hatchery in East Orland, Maine. The hatchery requires urgent repairs to address an increasing number of leaks caused by failing link seals. Due to the specialized materials and application methods required, and the short timeframe needed to complete the work before June 2024, the agency has determined that Savy and Sons is the only reasonably available source to perform the repairs. The contract action is authorized under the exception for unusual and compelling urgency. The corresponding federal contract opportunity, Solicitation Number 140FC224P0033, was awarded to an unknown vendor on March 25, 2024 for an unknown amount to rehabilitate the headbox at the Craig Brook National Fish Hatchery.

Justification for Other than Full and Open Competition (JOFOC)
A. Background
a. Description
This documentation supports the justification for contracting without providing for full and open competition.
b. Agency Requirement The Craig Brook National Fish Hatchery in East Orland, ME requires urgent repairs to an increasing number of leaks in the concrete head box through pipe penetrations with failures in the “link seals”; the gasketed space between the pipes and the structure. The concrete structure known as the “head box” provides the only clean, treated water source for the entire hatchery providing up to 2.3M gallons per day at peak flow for endangered Atlantic salmon and wastewater process operations. The link seals installed at the construction of the head box have steel hardware that has been corroding and failing at an alarming rate causing water under head pressure to leak at various degrees on 80% of the existing link seals. Due to the age of the hardware, they are all starting to fail at a similar rate. Attempts have been made to temporarily repair the leaks as catastrophic failure could result at any time causing the complete loss of water to the hatchery and thus, a detrimental and total loss to the endangered Atlantic salmon brood stock population in the State of Maine. Due to this structure being the only water source, methods of repair need to be rapid and permanent eliminating the need to replace faulty seals again in the future. This will require the use of specialized materials and application methods in multiple layers.
c. Statutory and/or Regulatory Authority
The use of other than full and open competition for this contract action is authorized by 41 U.S.C.
253(c)(2) - Unusual and compelling urgency and FAR 6.303 (Non-Commercial Items).
B. Justification
a. Nature of Action Being Approved
Water source structure leak repair.
b. Efforts to Maximize Competition No action was taken to identify alternative capable sources due to the highly specialized materials such as epoxytech, hydrophobic injectable polyurethane foam, hydraulic cements and their unique certified methods of application required to perform the repairs successfully and permanently. To minimize risk to the hatchery, it will also require a small window of acceptable time frame to complete the work which is at minimal flow rates, complete before June 1st 2024. Delays from logistics and mobilization must be reduced if possible.
c. Market Research
No market research was conducted as this is an urgent repair. Savy and Sons is familiar with the hatchery and was responsive to the need. Savy and Sons has the appropriate NASSCO and NACE coatings certifications and experience repairing failed link seals in critical areas where the requirements and limitations are extremely challenging.
U.S. Fish and Wildlife Service Requisition No.
Water source structure repairs Purchase Order No.

d. Additional Supporting Information
Urgent repair requires a contractor to be able to secure limited, time sensitive materials quickly and schedule to work in a remote area.
e. Interested Sources
Savy and Sons, 612 Church St. Amston, CT 06231
f. Removal of Barriers to Competition Ideally structure leaks that need to be repaired in a routine non-urgent manner allows for appropriate competition in the future when the repair can be delayed, such as a singular repair. This larger scale and complex type of repair requires qualified competent service technicians. This an urgent repair where delays can threaten hatchery operations and brood stock line of endangered Atlantic salmon.
C. Recommendation and Certification by Program Office
Based on the above justification, I recommend this acquisition to be conducted using sole source acquisition procedures as specified in FAR 6.303 (Non-Commercial Items). I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
Program/Project Officer Date
D. Contracting Officer Certification and Approval
Based on the above justification and having determined the price to be fair and reasonable, I hereby certify that the circumstances of this contract action deem only one source reasonably available and approve the use of sole source acquisition procedures for this purchase.
Contracting Officer Date
E. Concurrence by Chief of Contracting Office
I hereby concur that the circumstances of this contract action deem only one source reasonably available.
