About this file

This is a Questions and Answers document for federal contract 140FC126Q0026, issued on 21 July 2026, addressing clarifications related to trail reconstruction and improvement work at an Aviary facility.

The document clarifies four key aspects of the procurement. First, gravel specifications for reconstruction work will consist of gabion material for the base layer with ¾ to 1 inch gravel on top. Second, the contract is structured as a firm-fixed-price completion-type contract with a lump-sum price, and offerors must price based on completing the entire scope of work rather than a unit price per linear foot; the estimated 425 linear feet of access and safety trails to be reconstructed is provided solely to convey approximate magnitude, and any variance between actual and estimated lengths remains the contractor's responsibility without grounds for contract modification or equitable adjustment. Third, the awarded contractor is permitted to utilize existing site utilities including potable water, electrical service, and restroom facilities within the Aviary throughout project duration. Fourth, a portion of the Aviary parking area may be designated for contractor use to accommodate personnel vehicles, construction vehicles, and trucks as needed for project operations.

Attachment 3 – Questions and Answers

21 July 2026

Question 1: Please confirm the specific type and specifications of the gravel to be used if available.

Answer: We will use for the areas that need reconstruction in gabion for the base and ¾ to 1 inch on top.

Question 2: The Scope of Work indicates that approximately 425 linear feet of access and safety trails are to be reconstructed and improved. Based on our initial site visit, it appears that the actual length may exceed the stated quantity. Please confirm whether pricing should be based on the specified 425 linear feet. In the event that the final required length exceeds 425 linear feet, will any additional quantities be addressed through a contract modification or other equitable adjustment mechanism?

Answer: The estimated 425 linear feet is provided solely to convey the approximate magnitude and overall scope of the required work. Offerors shall base their pricing on completing the entire requirement in accordance with the solicitation, drawings, specifications, and site conditions, rather than on a unit price for a specific trail length.

This procurement is a firm-fixed-price, completion-type contract. Accordingly, the Contractor is responsible for completing all work necessary to satisfy the contract requirements for the agreed-upon lump-sum price. The estimated trail length is not intended to establish a payable quantity (linear foot). Therefore, if the actual length required to complete the specified scope differs from the estimate, such differences are considered part of the Contractor's responsibility under the firm-fixed-price completion contract and do not, by themselves, constitute grounds for a contract modification or equitable adjustment.

Question 3: Please confirm whether the awarded contractor will be permitted to utilize existing site utilities, including potable water, electrical service, and restroom facilities located within the Aviary, for the duration of the project.

Answer: Yes

Question 4: Please confirm whether a portion of the Aviary parking area may be designated for awarded contractor use, including personnel vehicles, construction vehicles, and trucks, as necessary to support project operations.

Answer: Yes
