Scope of Work (SOW) Project/Delivery Location:
Florida Panther National Wildlife Refuge (FPNWR) is located approximately 20 miles east of Naples. The Refuge is bounded by Interstate 75 to the south and State Road 29 to the east. The project/delivery locations are labeled in Figure 1 and can include one or more of these labeled locations. The locations labeled in Figure 1 are easily accessible from State Road 29. The locations are gated at State Road 29, and gates must always remain closed after entering and exiting the FPNWR.
Project Description:
This project seeks to provide various sizes of coarse aggregate/fill to improve existing woods roads, firebreaks, trails, and parking areas on the Florida Panther National Wildlife Refuge. Coarse aggregate will be delivered to one or more of the locations labeled in Figure 1 and will be delivered by single or tandem axle dump trucks. Other types of delivery trucks will need to be mutually agreed upon by the Government and Contractor. Delivered rock will either be piled at specified areas at each location, or tailgate spread at one of the locations labeled in Figure 1. Product delivery and tailgate spreading (if requested) won’t occur greater than .4 miles from the locations labeled in Figure 1, and would occur on existing drivable woods roads, driveways and parking lots.
Contractors shall deliver one or more of the following products that get ordered to one or more of the locations labeled in Figure 1:
Product titles/names below are used for convenience only and are not intended to convey any limitation or generic definition.
1) Pea Rock - Shall be in accordance with FDOT Standard Specifications, section 901 (Appendix 1), and shall conform to size #89 of the gradation requirements of Table 1 of that section.
2) 57 Stone Coarse Aggregate - shall be in accordance with FDOT Standard Specifications, section 901 (Appendix 1), and shall conform to size #57 of the gradation requirements of Table 1 of that section.
3) Limerock Base - shall be in accordance with FDOT Standard Specifications, section 911 (Appendix 1).
Shell base may not be substituted for limerock.
4) Rip Rap - shall be in accordance with FDOT Standard Specifications, section 530-2.2 (Appendix 1), and shall be available in the following size ranges: 3-6", 6-12", 12-24", and 24-36".

6) Clean Fill - shall be reasonably free of grass, roots, weeds, sticks, stones, or other foreign material
All materials listed above must be provided from a pit/quarry located within 50 driving miles of Florida Panther National Wildlife Refuge (i.e., 12085 State Road 29 South Immokalee, FL 34142).
Type of Contract:
This is a firm fixed price Blanket Purchase Agreement (BPA) contract. The basis of award is the Lowest Price Responsive Responsible Best Value LOCAL VENDOR preference. Submitted bids shall include all costs to deliver one or more of the products listed above to FPNWR locations labeled in Figure 1.
This award will be dependent upon submitted BPA prices provided by contractor’s quote response (Pricing must be provided on Quote Schedule). The Government anticipates being able to order a combined total of approximately 50-80 loads of limerock base, 57 stone, clean/aka white fill, and/or rip rap under the first call of the BPA. The Government's obligation under this agreement is contingent upon the availability of funds from which payment for BPA Call purposes can be made. The maximum five-year dollar amount is $400,000.00. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this agreement and until the Contractor receives notice of such availability, to be confirmed in an issuance of a “call” by the Contracting Officer.
Extent of Obligation:
It is understood that the government will be obligated for only those services ordered against the agreement by authorized individuals and then only to the extent that they are delivered and acceptable to the government. The contractor is cautioned that acceptance of calls from personnel other than those authorized herein, acting within the scope of their authority, may jeopardize payment. This BPA does not obligate funds.
NOTICE OF INDIVIDUALS AUTHORIZED TO PURCHASE UNDER THIS BPA AND DOLLAR
LIMITATIONS:
All USFWS Warranted Contracting Officers are authorized to place calls under this BPA. Authorized BPA Callers will be revised and/or updated from time to time as the need arises.
CALL LIMITATIONS:
No individual call under this agreement shall exceed $75,000. BPA callers shall not place individual calls that will exceed their specified limitations; likewise, they shall not split calls to avoid exceeding their specified limitation. The Contractor shall not accept calls that exceed the limitations cited in the above paragraph and the Government shall not be held liable for calls that exceed the limitations of the BPA caller.
BPA is not to exceed $400,000.00 for the entire agreement period.
Blanket Purchase Agreement Procedures:
The contractor will receive an email request for services from an authorized BPA Caller; the BPA Caller will request services based on Refuge’s statement of work. The contractor will either accept or deny the work within 48 hours after email request for performance. Once contractor accepts the work by email, a call is placed, and a task order will be issued within 14 days of acceptance. The contractor will have 14 days from the acceptance of a task order to deliver ordered product(s) subject to product availability and circumstances beyond the contractor’s control.
Contractor Liability:
The Government shall only be responsible for ALLOWABLE charges on authorized BPA calls placed by BPA callers, within caller’s specified dollar limitations. Responsibility for charges other than those cited as “Allowable Charges” under this agreement shall be a matter between the contractor and the person(s) that initiated the call that was not allowable because they were not an authorized BPA caller, or it was not within their dollar limitation. Under no circumstances, shall the BPA caller, the USFWS, or any other activity of the Department of Interior be liable for such charges.
Work Specifications:
Period of Performance: The effective period of this agreement shall extend from October 1, 2022 (12-month base period with four (4) additional one (1) year option periods) not to exceed September 30, 2027.
Cancellation of contract will be governed by a thirty (30) day written notice issued by either party. The Government is not obligated to place any orders under this agreement beyond the first call.
Dependent upon awarded BPA prices, the Government anticipates being able to order a combined total of approximately 50-80 loads of limerock base, 57 stone, clean/aka white fill, and/or rip rap under the first call of the BPA. The Government's obligation under this agreement is contingent upon the availability of funds from which payment for BPA Call purposes can be made.
The service provided herein shall be requested by the Contracting Officer or his/her authorized representative(s), referred to herein as “BPA caller(s).” When a BPA caller places a call, the Contractor will provide the products and services under the terms of this agreement upon ordering, unless mutually agreed upon otherwise by the Government and contractor. The contractor will have 14 days from the acceptance of a task order to deliver ordered product(s) subject to product availability and circumstances beyond the contractor’s control. This timeframe would account for holidays and weather-days within the contract period. The project shall be fully completed within 30 days following issuance of the task order and notification to begin work unless mutually extended for a longer period. Contractor must have work dates and a plan of work approved by the COR 48 hours prior to beginning work so that refuge personnel can be available at time of delivery to inspect product(s) and receive load ticket(s).
All other specifications/requirements described within the Performance Work Statement and Contractor’s proposal shall be adhered to.
Payments:
The Contractor shall be registered in the System for Award Management (SAM.GOV) to participate in this requirement. The SAM can be found at https://www.sam.gov. Payments will be made via Electronic Funds Transfer using the data within the SAM registration database.
The Contractor is also required to be registered in the Invoice Processing Payment Platform System (IPP.GOV) to submit electronic invoices. Any questions regarding this billing system should go to the Customer Support for the IPP directly at telephone: 866-973-3131 or by email: ippgroup@bos.frb.org. The https://www.sam.gov/ mailto:ippgroup@bos.frb.org contractor must submit all cost and pricing data, receipts, and vouchers as an attachment to the electronic invoice in the IPP.GOV that matches and supports what is being invoiced.
Quote Submittal:
Offerors are required to submit a written/electronic quote via email to lee_riley@fws.gov on or before Thursday, September 29, 2022 @ 3:00 pm ED.
Questions shall be submitted ONLY to Lee Ann Riley, Contract Specialist via email no later than Thursday September 22, 2022, C.O.B.
Submittal of price quote must be on the Quote Schedule provided and shall include material/supplies, equipment, manpower, overhead and all necessary components to fulfill this requirement.
Provide itemized pricing for the task if applicable. In order to account for the high variability of course aggregate/fill and fuel prices, offerors may submit quotes as a fixed percentage above the average market price of material. For this purpose, the average market price will be determined by averaging the market price of a given product from all pits/quarries located within 50 driving miles of Florida Panther National Wildlife Refuge (i.e., 12085 State Road 29 South Immokalee, FL 34142). Example: The average market price of 57 stone coarse aggregate is $30/ton in base year, and offeror quotes 25% for base year. In this example, the awarded price for 57 stone in the Base Year would be $30/ton for the 57 stone + $7.50/ton (i.e., 25% of $30) = a total of $37.50/ton to deliver the 57 stone to one or more of the locations labeled in Figure 1.
The Government will award a service contract resulting from this solicitation to the responsible quoter whose offer conforming to the solicitation will be most advantageous to the government in terms.
Award will be made on a competitive basis utilizing the best value where award will be made based on Past Performance and Price. Past Performance and Price are approximately equal.
Note: The contract order is subject to invoicing via IPP.gov.
QUOTE SCHDULE - MUST BE COMPETED
Contractor and shall provide, all materials, equipment, and services required in the Statement of Work and contract documents. Products ordered shall be requested and provided on an as-needed basis based upon the following schedule.
All interested Contractors shall provide a quote for the products described below as follows:
The quoted amounts must be in dollar format ($0.00) or percentage format (%) and include all costs for transportation, margin, applicable fees, etc. If offerors submit quotes as a fixed percentage this means that the offerors are quoting as a fixed percentage above the average market price of material.
