All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards.

All supplies and materials to be used in the performance of work described herein are subject to the approval of the Government Complex Representative.

The following is an example list of products that may be used in this contract for custodial services for which biobased products are available. The list is not all inclusive. Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content.

In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products.

The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the Contractor on each anniversary date of the contract shall compile a complete list of biobased products, including the information above, purchased to carry out the contract requirements. http://www.biopreferred.gov/

Within thirty (30) days of contract award, the Contractor shall submit an Operations and Maintenance Plan. This submittal shall be approved by the COR in writing. The Contractor shall not commence work until this submittal is approved by the COR in writing. The Plan must be reviewed and updated annually, and as required by the COR. The Plan must contain and define the following elements:

1. The Contractor’s written policy stating its commitment to the use of biobased products, employee health and safety, and sound environmental management practices.

2. Detail on how the Contractor intends to keep abreast of the development and increasing availability of biobased products and how any new or improved products will be incorporated on an ongoing basis into contract performance.

3. Proposed biobased custodial products which must be selected in accordance with the criteria included above. At a minimum, the Plan must identify products by brand name for each of the product types.

NOTE: A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.

4. The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of biobased products; proper maintenance of equipment; and other procedures/instructions to accomplish work under this contract.

5. The Contractor shall provide data on the quantity and dollar values of biobased products used in this contract. The data will be submitted to the Government Complex Representative quarterly.

A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some biobased products that may function differently than a conventional product. Therefore we will look for a Contractor who will 1) demonstrate products, and 2) when selected, offer any necessary training to all of the construction staff and 3) be available with technical assistance to trouble shoot problems.

The contractor shall coordinate the storage of supplies with the COR.

All materials left on site shall have:

• Legible markings on containers that designate what the product is

• Legible Material Safety Data Sheet (MSDS) in a folder, in the storage closet(s) where the product is stored.

All cleaning products shall be “Green Seal” certified. A listing of Green Seal certified products can be found at http://www.greenseal.org/FindGreenSealProductsandServices.aspx. Any exceptions to this requirement must be approved in advance by the COR.

http://www.greenseal.org/FindGreenSealProductsandServices.aspx

Executive Order 13101, Greening the Government through Waste Prevention, Recycling and Federal Acquisition requires items designated by the Environmental Protection Agency (EPA) be purchased with the maximum recycled content possible. The Contractor is required to use products with the highest recovered material content whenever they are commercially available at a reasonable price. The Contractor shall purchase these products containing the highest content of recovered material possible unless products are not: 1) available competitively within a reasonable timeframe, or 2: available at a reasonable price. For a full listing of products and EPA’s recommendations for recovered material content see http://www.epa.gov/cpg/products.htm.

If one of the two exceptions above applies, the contractor shall furnish the COR a written justification prior to purchase of the listed items without the minimum recommended recovered material content.

Waste receptacles containing food or liquid waste shall be completely emptied to include removing the soiled liner and replacing with a new liner. When the contents of a receptacle are dry (i.e. paper, candy wrappers, or plastic bags) the waste may be removed from the receptacle and deposited in a larger container for disposal, leaving the unsoiled liner. At least one extra plastic liner shall be placed in the bottom of each can. The contractor will identify the standard used and how they will monitor quality assurance at the initial meeting with the COR.

3.2 Performance Standards

The objective of this contract is to provide clean facilities and a healthy and safe environment for employees and visitors. Specifically:

(a) The Contractor shall ensure that the building presents an overall appearance of cleanliness.

The definition of clean is to remove dirt, water streaks, gum, grease, tar or any other extraneous matter from all surfaces or objects in order to present an overall appearance of cleanliness.

(b) The Contractor shall ensure that the facilities are sanitized and kept free from accumulations of dust.

(c) The Contractor shall furnish all necessary labor, supervision, equipment and supplies (as outlined in sections 1.6 & 1.7) to adequately maintain the facilities at an acceptable level of cleanliness that is consistent with comparable industry standards (i.e. BOMA and NAPC).

The Contractor shall re-perform services within 24 hours of notice by the COR. The Government may have services which were not acceptably performed by the Contractor performed by other means.

Attachment 1 - DOI Clause 144807-12

CONTRACTOR PERSONNEL CLEARANCE AND IDENTITY CREDENTIALS SEPTEMBER 2006

(a) FWS rules regarding physical security and personnel security apply to all personnel in FWS facilities.

FWS Human Resources Division is responsible for maintaining these rules and procedures.

(b) Each contractor (or subcontractor) employee requiring recurring access to FWS facilities and/or information systems will be required to submit to a background investigation in accordance with FWS procedures. The type of background investigation required is based on the risk/sensitivity level designation, as described in the Statement of Work. For most facilities, this clearance is required to obtain a DOI-issued identification credential (badge), but the investigation is required whether or not the facility has a badging/credential policy. This clearance/credential requirement does not apply if the contractor does not have any unsupervised building access and will only need building access for less than 6 months or only occasional building access (such as for periodic equipment maintenance). In those cases, building procedures for visitors will be applied.

(c) The contractor will provide a listing to the COR/Government Point of Contact (POC) at least 2 weeks before starting work (or as otherwise specified in the contract) identifying contractor and subcontractor employees requiring access to FWS facilities or systems for performance of work hereunder.

(d) The Contractor employees are required to complete the applicable clearance request forms by the COR/Government POC. The following forms, or their equivalent may be used to initiate the credentialing process: SF 85 or SF 85-P (which includes authorization for credit check), SF 86, OF-306, and/or other forms designated for this purpose by the Office of Personnel Management (OPM), Federal Protective Service, or other federal agency in whose space work will be performed under this contract.

The SF 86 must be completed on-line at http://www.opm.gov/e-qip/ and printed out by the employee.

Contractor employees must present themselves for fingerprinting, together with the printed SF 86, other completed forms, at least 14 calendar days before starting work under this contract. If fewer than 14 days remain before the scheduled start of contract performance, the contractor employee may be allowed temporary, supervised access but must complete this application process as soon as practicable, normally within a day of his or her first arrival at the facility. An employee's refusal to provide or authorize provision of information may constitute grounds for denial or revocation of credentials. Government personnel may contact the contractor/subcontractor employee being screened or investigated in person, by telephone or in writing, and the contractor agrees to make them available for such contact. If a contractor employee already holds a credential issued by a Federal agency after clearance through OPM, provide documentation supporting this status to the COR/Government POC. FWS Human Resources officials will determine if the existing clearance can be accepted without further investigation.

(e) Badges/credentials issued upon satisfactory completion of a preliminary National Agency Check (NAC) may be revoked if the subsequent NAC with Inquiries (NACI) investigation produces an unfavorable determination. Individuals who do not pass the background investigation cannot be permitted to hold a building pass, allowed entry into the building for contract work, or permitted access to FWS systems (whether remote or on-site). In such cases, the Contractor will be required to sign (or have their subcontractor sign) a notification form indicating that their employee has been informed of the results of the background check. The Government will be the final authority in determining access privileges. The Government's exercise of its right to grant or revoke the access of particular individual(s) to its facilities, systems, or parts thereof shall not constitute a breach or change to the Contract, regardless of its impact on any individual's ability to perform work under the Contract.

(f) During all operations on Government premises, contractor personnel shall comply with the rules and regulations governing the conduct of personnel and the operation of the facility. Government-issued identity credential must be worn upon entry and displayed at all times on Federally controlled property, unless otherwise instructed by the COR/Government POC.

(g) The Government reserves the right to require a re-submission of clearance forms and a new background investigation at any time. Failure to provide the documents within the specified time period will result in removal of the employee until such time that the documents are submitted and clearance granted. Should removal be necessary, salary/wages and other costs associated with the removed employee are not allowable or allocable under this contract. If removal would result in understaffing or non-performance of contract requirements, the Contractor shall provide a qualified and cleared replacement. Failure to do so will entitle the Government to a downward adjustment in price reflecting the reduced level of performance.

(h) When any of their personnel leaves the company's employment, is reassigned to other work, or otherwise no longer requires access to FWS facilities or FWS computer systems, the contractor shall immediately advise the COR/Government POC so that those user accounts and credentials can be cancelled. The contractor will ensure that the ID badge and keys (if any) are retrieved and promptly returned to the COR/Government POC, who will forward them to the issuing FWS HR official. The COR/Government POC must be notified in advance of any potentially unfriendly termination of an employee or subcontractor.

(i) The contractor will report any lost keys or badges to the COR/Government POC within 24 hours. The COR/Government POC will relay the information to the responsible HR official. All badges and keys shall be returned to the COR/Government POC at the completion of the contract.

(j) The requirement of this clause must be included in any subcontracts in which subcontract workers will need building or unsupervised system access as described in paragraph (b).
