INSTRUCTION TO OFFERORS

General Information A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements to include terms and conditions and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

B. The response shall consist of two (2) separate parts; Part I – Technical and Part II - Price

C. Amendments to solicitations If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

D. Late submissions, modifications, revisions, and withdrawals of offers Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.

E. Contract award The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

F. System for Award Management Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

Submission of Offers Technical: All offerors must provide a minimum of (3) Abatement projects completed within the last three (3) years. Contractors shall provide at a minimum: Scope of project, location, technical approach, materials used, original contract award price, final contract award price after any changes. (Limited 3 pages).

Price: Only firm-fixed price offers will be evaluated. An offer using a sliding price scale or pricing subject to escalation based on any contingency will not be accepted and will be considered non-conforming to this solicitation.

Pricing should be submitted as one lump sum price.

https://www.acquisition.gov/

Basis for Award This award will be made based off of Lowest-Price Technically Acceptable (LPTA). The LPTA process is a simplified best value source selection strategy that permits the best value to result from the selection of the technically acceptable proposal with the lowest price. While evaluating quotes utilizing LPTA, price and technical are the two evaluation factors. Price and Technical Acceptability when evaluated are weighted equally.

If the lowest priced evaluated is considered a technically acceptable offer that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers. If the lowest priced offeror is not considered technically acceptable, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is determined to be technically acceptable or until all offerors are evaluated. The Contracting Officer shall then make an integrated assessment best value award decision.

EVALUATION FACTORS

Evaluation Approach.

Price Reasonableness Evaluation. The offeror’s Price Quote will be evaluated based upon the total price proposed.

Price will be ranked from lowest to highest price.

Technical Qualifications. Technical submissions will be evaluated utilizing the table as shown below.

Adjectival Rating Description Acceptable Information provided demonstrates the offeror has the technical know-how to meet the requirements of the solicitation.

Unacceptable Information provided does not demonstrates the offeror has the technical know-how to meet the requirements of the solicitation.

Vendor Responsibility. Federal Databases such as FAPIIS/CPARS will be utilized. Information recorded in FAPIIS and SAM and will be used to determine a contractor’s responsibility.

The evaluation process shall proceed as follows.

Step 1 – Rank all proposals by price and evaluate price reasonableness from lowest price to highest price.

Step 2 – Evaluate the lowest-priced proposal for technical acceptability. The technical portion of the quote will be rated based on the table below as either “acceptable” or “unacceptable”.

Step 3 – Determine the responsibility of the vendor.
