Rachel Carson Multi-Purpose Facility – Bidder’s Questions (Questions received by OPA from Keith Davis via email.)

Response from OPA Response from Contracting Officer

1. There are door hardware items spec’d that do not fall under Buy American. Should we carry the hardware as spec’d at this point and exclude Buy American?

Response from OPA: Provide a product by one of the listed manufacturers that meets the Buy American act requirements.

Response from Contracting Officer: If the American made product exceeds the cost of foreign material by more than 20 percent, the FWS will prepare a waiver under the Buy America Act to allow the foreign made product.

2. Tags:

a. All 60-minute rated Tags vary in required material and finish. Should all of the 60-minute rated openings be receiving the Fire Frames – Timberline Series frames?

Response from OPA: Only door 102 will receive Fire Frame Timberline Series, with 120-minute fire rating for the frame and window, and 90-minute fire rating for the door. Other openings will receive fire-rated stile and rail wood doors and fire-rated wood door frames as described in specification section 081433.

b. Tag 104 is an exterior opening that is scheduled as a wood door and wood frame.

Should this door and frame be quoted as fiberglass?

Response from OPA: Exterior doors S05A, 104, and 122 should be updated to fiberglass doors (type F) and fiberglass frames.

3. Drawings AE101, AE103 & AE106 have a Section designation for Drawing A222 and AE222. I cannot find this drawing. Does it exist?

Response from OPA: A222 should read ‘AE222’ and A221 should read ‘AE221’.

4. Drawings AE701 Partial Basement Reflected Ceiling Plan North, Storage Room 008, is indicating open structure above but Keynote #1 indicates acoustical tile. Please clarify.

Response from OPA: Storage Room 008 will be open to structure above – keynote 1 should be removed from Storage Room 008.

5. There is a lot of mention about the mockup. Can you please clarify the extent required?

Response from OPA: Mockups may be constructed in place and become part of the final construction assembly once reviewed and approved by the Contracting Officer and Architect.

a. Will an onsite building be the location of the mockup?

Response from OPA: Please refer to response #5.

b. Volume #1 of the specifications on page 88 indicated that the Lab mockup to be constructed at the testing facility, please clarify where that would be or if this is needed?

Response from OPA: Laboratory mockups will not be required.

c. Exterior mockup consists of multiple products assemblies and sub-assemblies, please clarify the limits. Some of these products will be exposed to the weather.

Response from OPA: Please refer to response #5. To minimize weather exposure of assemblies, provide appropriate notification to Contracting Officer and Architect for mockup review.

d. Room mockup to include all finishes (how will weather protection be accomplished?)

Response from OPA: Please refer to response #5. Room finish mockup may be located inside.

e. Specification Section 086300 page 589 indicates that a mockup of the skylight will be required. Will a separate skylight be required just for the mockup? If we are proceeding with approved submittals for the requested skylight would any change at that point, be just part of the quality control process? Is a mockup necessary? Please clarify.

Response from OPA: Please refer to response #5. A separate skylight mockup will not be required.

6. Meeting Room 017 shown on Drawing AE102 shows 3 windows and Door 017A. Please confirm these are existing with no work required.

Response from OPA: Door 017A and windows in meeting Room 017 are existing with no work required.

7. Drawing AE620 Window Types is showing a window C8 but I have not been able to locate this window on the project. Can you clarify if this window is being used?

Response from OPA: Window types C8 and C9 are part of the C6 aluminum clad wood window system, located at the ends and rotated 90 degrees at the building corner.

8. We do not see any drawings or specifications for fire suppression. Please confirm this system does not exist and we will not be required to install as part of the scope of work.

Response from OPA: An automatic fire suppression system is not required for the project.

9. Has asbestos abatement already been done? Is all the asbestos noted in the report already removed?

Response from Contracting Officer: All asbestos has been removed from the building.

10. What contractor conducted the asbestos removal?

Response from Contracting Officer: Asbestos removal was completed on 8/10/2021 by MECX 8864 Interchange Dr., Houston, TX 77054-2512 Phone (713) 585-7000, subcontracted to Atlantic Environmental Contractors, 81 East Ave., Lewiston, ME, 04240, Phone (207) 783- 1908.

11. Underground Oil Tank: Where is the underground oil storage tank located? Is it going to be removed? How large is it? Was a permit with the fire department pulled when this tank was installed?

Response from Contracting Officer: The 1955 heating record drawing shows a 1,000-gallon oil tank near the location of existing attached garage (to be removed), before the garage was added onto the house (next to the kitchen). It is uncertain that this underground tank still exists, but some water was pumped from an adjacent old fill line. FWS has found no documentation of this tank, however when the property was purchased, the FWS Realty Department found in their Level I Environmental Assessment some evidence that an underground tank had been removed. Contractors should not include any cost for underground tank removal in their proposals. If a buried tank is found during construction, the issue will be addressed at that time.

12. Can the large garage be used for storage by the contractor(s) during the performance period?

Response from Contracting Officer: The large garage cannot be used for storage of materials or as an office. However, the general contractor can bring their own storage containers to the site.

13. Can the small garage be used for storage and/or office by the contractor(s) during the performance period?

Response from Contracting Officer: The small garage cannot be used for storage of materials or as an office. However, the general contractor can bring their own storage containers to the site.

14. Are there articles that describe the construction of the home by Elmina Sewall that can be shared with the bidders?

Response from Contracting Officer: The known original building drawings have been uploaded to SAM.gov. These drawings are FOR REFERENCE ONLY, NOT TO BE ASSUMED AS

ACCURATE AS-BUILT DRAWINGS.

15. Will the list of contractors and subcontractors who visited the site (today) be shared with all bidders?

Response from Contracting Officer: The records of attendance for the site visits on 09-22-2022 and 09-28-2022 are attached to this .pdf document.

16. Section A 52.236-1 Performance of Work by the Contractor states that “The contractor shall perform on site, with its own organization, work equivalent to at least 100% of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction, and the Contracting Officer determines that the reduction would be to the advantage of the Government”. Generally, contracts of this type stipulate the prime contractors must self-perform a minimum of 15% of the contract. Please clarify the intent of the 100% statement.

Response from Contracting Officer: The subject clause has been removed.

17. We respectfully request the schedule to be changed from 5 to 10 pages. Please Confirm.

Response from Contracting Officer: A 10-page schedule is acceptable.

18. Is there a Masonry Cleaning & Restoration Specification?

Response from OPA: A masonry cleaning & restoration specification is not included.

19. Drawing C-001 Civil Notes & Legends Civil Notes paragraph 6 - Has the "Stormwater Permit" been obtained?

Response from OPA: Yes, a copy of the Maine DEP Stormwater Permit is attached.

20. Questions regarding the photovoltaic system and the Buy American Act:

Can someone provide documentation of the specific Buy American requirements for this project? We want to make sure we're all on the same page and have the correct info.

What is the difference between component analysis and subcomponent analysis?

Which is required for this project? If you have specific documentation or descriptions of this, that would be helpful.

What does the waiver/exception application process look like?

Could you provide documentation about the specific trade agreements that impact the Buy American requirements and exceptions? In other words, are we able to procure from approved non-U.S. manufacturers due to trade agreements? And if so, which ones?

Response from Contracting Officer: If the American made product exceeds the cost of foreign material by more than 20 percent, the FWS will prepare a waiver under the Buy America Act to allow the foreign made product.

Item # Page Label Comments Response

1 General Question Can the RFI deadline be extended to 10/07/2022 to allow for all RFIs to be received from subcontractors from all the site visits? The deadline will not be extended.

2 General Question

Bid Alternates 1 & 2 - Please confirm that just the cost to furnish and install the solar panels themselves are to be included in the bid alternate, and that all electrical/sitework preparations should be included in the base bid.

Roof flashing from flat roof to pitched roof is inappropriate for that application. Please provide updated detail. Terminate crown molding over flat roof area. At transition, provide additional membrane flashing layer with lap sealant.

4 6/AE520

Framing detail: No flashing shown, and no backing shown to attach to the elevator shaft. Also, the trim is called out to be Wood, but this should be PVC. Provide aluminum flashing at wall-to-roof connection. Crown molding, trim, and soffit panel to be PVC.

5 3/AE521

Flat roof to existing roof: No blocking shown at roof intersection, please provide detail which shows how this should be securely attached

Keep existing exterior sheathing up to top plate- first flat truss will be inboard. Attachement not required between new flat truss and existing but new end truss can be nailed to exterior sheathing for stability in construction. Blocking not shown at existing building roof but expected to be present (VIF). Flat roof trusses to have engineered panel blocking at bearing walls (See Sketch SK- S1 attached).

6 3/AE520

EPDM roofing is called out, but it calls for heat-welding at all seams, but this is not appropriate for this system. Please clarify appropriate method for seaming. Provide manufacturer's standard seaming materials and installation methods, refer to spec section 075323

7 1/AE623

Blocking is not shown between 8/12 roof and LVL connection, please update detail to show how this should be securely attached Refer to detail 4/SF504 for hanger on LVL. No blocking required.

It is unclear how many locations this detail occurs. Please provide an allowance all bidders should carry for this unknown quantity. Condition only directly observed at one location.

9 1/SF101

Note 13: It is unclear if the rotted sill condition is limited to the one area shown on the drawings, or if it exists elsewhere. Please provide an allowance all bidders should carry for this unknown quantity. Unit price and base bid quantities section of spec section 01.2200: Unit Prices

10 1/AD120

Note calls to remove and store chimney. Are we removing and storing the entire chimney, or just from the roof up (aka granite section)? Also, if the chimney is being stored, what is its future use? We do not see anywhere it calls for re-use Remove and salvage stone veneer from chimney. Return material to government.

11 Allowance request

Plaster ceiling repairs: A majority of the plaster ceilings are called as existing to remain, but will likely need to be repaired from other minor work occurring in the area. Please provide an allowance all bidders should carry for plaster repairs. Include a $6,000 allowance for miscellaneous plaster repairs.

12 General Question

Please confirm the requirements for appropriately abandoning the well. Should this be filled with concrete, abandoned in place, dug and remove, etc? Are there any state or Federal environmental requirements which need to be met for this? Requirements for abandoning the well are included in Specification Section 33113, Potable Water Supply Wells, Paragraph 3.3.

13 General Question

At existing wood windows, is it acceptable to replace existing weight and pulley mechanism with spring mechanisms? This will affect the pricing of if the window needs to be rebuilt entirely, or if a spring mechanism is acceptable, leaving windows in place and installing spring mechanisms without removing Replacing existing weight and pulley mechanisms with spring mechanisms is acceptable at existing wood windows.
