(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. NOTICE TO CONTRACTORS (CPARS)

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JUL 2010)

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. (e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation, and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). (f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30-day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

(End of notice) DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP)(APR 2013) Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. GENERAL

The U.S. Fish and Wildlife Service (USFWS) Don Edwards San Francisco Bay National Wildlife Refuge (Refuge) is seeking to procure materials for use in performing maintenance on the Refuge levee systems and trails.

Statement of Work:

The Contractor shall procure and deliver concrete and/or stone materials meeting the material qualities and quantities set forth in this contract. The Contractor shall deliver the materials to two Material Staging Areas and two Delivery Areas within the Refuge as shown in Figures 1, 2 and 3 (Attachment 1).

Material Qualities:

Materials may consist of natural stone or concrete. If concrete, no protruding reinforcing steel will be allowed. The material qualities will not be required to meet California Department of Transportation (CALTRANS) hardness, durability and standards due to the material’s intended life-cycle and low-energy environment. The materials, however, shall not be soluble as they will be used in a wet or submerged environment. Siltstones, calcite or gypsum rich stones are not acceptable. The minimum unit weight of materials shall be 145 pounds per cubic foot (pcf). The maximum unit weight of the materials shall not exceed 165 pcf.

Material gradation is relatively important to ensure stones/concrete interlock when placed on slopes or in the water. The following material size gradations are desired. The Contractor may propose similar gradations that are an equal mix of both gradations or have a larger overall size. The maximum D50 size shall not exceed 11-inches.

4-inch to 10-inch granite gabion stones are an acceptable gradation and material for the intended use.

The breadth and thickness of any piece of stone less than one-third its length shall be minimized or avoided. Material shall be of angular shapes which will form a stable protection structure of required depth. Rounded boulders or cobbles shall not be used.

All natural stone import materials will require contaminant screening and shall be reviewed and approved by the San Francisco Bay Regional Water Quality Board (RWQB). The contractor shall follow the process described in the ‘Master Quality Assurance Project Plan’ (QAPP) for Don Edwards San Francisco Bay National Wildlife Refuge (Attachment 2). The QAPP requires a quality assurance officer (QAO) to be responsible for verifying the imported materials meet the requirements in the QAPP. The QAO will be qualified, assigned and paid by the Contractor. Provide documentation of material approval to the USFWS prior to commencing hauling operations.

If the source originates from a previously Regional Water Quality Board (RWQB) approved source, and/or the screening levels are below detection limits, the source can be immediately approved by the QAO. If screening results show that one or more of the chemical constituents exceed screening criteria, consultation by the QAO with the RWQB will be required. This can take from a few days or a couple of weeks.

Material Delivery:

Attachment 1 figures illustrate the access routes to the material staging areas. The Contractor will be required to obtain all hauling permits required by the City of Mountainview and Sunnyvale.

Prior to delivery operations, the Contractor shall prepare a Material Delivery Plan (Plan) for approval by the USFWS. The Plan will include required hauling permits and address barricades and warning devices as necessary to safeguard the public, workers, and government personnel. Where project work affects public roads, provide signage in accordance with the current edition of the Manual on Uniform Traffic Control Devices (MUTCD) as published by the US Department of Transportation, Federal Highway Administration. Public Access to the Bay Trail system shall be maintained throughout the delivery operations. The Plan will also include a proposed delivery schedule and proposed hauling equipment. Further, the Contractor shall coordinate with USFWS personnel in identifying and planning the placement of materials in delivery areas 1 and 2.

Sharp turns along the identified access routes narrow levees will require hauling equipment with the ability to safely maneuver to the material delivery and staging areas.

Equipment access to the levees after a rain event is prohibited if the rain event has saturated the surface materials resulting in rutting during delivery operations.

Several locked vehicle gates exist along the access routes within the Refuge. Coordinate with the USFWS for access through the gates. Gates will remain locked during delivery unless actively monitored.

The USFWS anticipates construction work under a separate construction contract to begin on or around September 1, 2020. Access Route 1 is an access route for this work. Contractor shall anticipate additional access limitations and shall coordinate with the USFWS on the delivery schedule and access if delivery activities to Material Staging Area 1 occur after September 1, 2020.

Access Route/Material Staging Area 1 (Figure 2, Attachment 1): Access route 1 to material staging area 1 transits through the City of Sunnyvale and the Sunnyvale Water Pollution Control Plant. Coordinate hauling operations with Sunnyvale Water Plant Management. Document this coordination and any delivery requirements in the delivery plan. Two locked vehicle gates exist on this access route within the Refuge. Coordinate with the USFWS for access through the gates. Material staging area spans approximately 0.67 acres. Stage materials to ensure stable side slopes and to height not to exceed 10 feet.

Access Routes 2 and 3, Material Staging Area 2 and Delivery Areas 1 and 2 (Figure 3, Attachment 1): Access route 2 to material staging area 2 transits through the City of Mountainview. Access will begin from Highway 101 and will utilize surface streets to N. Shoreline Blvd. and then either Crittenden Lane or cross Parking Lot E within Shoreline Park to the lower maintenance road on the east edge of Shoreline Park. Access route 3 also transits through the City of Mountainview to access delivery areas 1 and 2. Route 3 begins at Highway 101 and will utilize surface streets from San Antonio Road, to Terminal Blvd., to the Shoreline Lake Dam levee.

Access Route 2 which accesses material staging area 2 will also be used to access the levee that encompasses Pond A2W and Delivery Area 2. The entire levee perimeter can be accessed by vehicles. The Contractor shall assess site conditions and propose appropriate equipment to access the perimeter levee. Off-road equipment that minimizes rutting or damage to the levees is preferred.

Access Route 3 will be used to access Delivery Area 1. This route traverses the levee that encompasses Pond A1. This perimeter levee is not accessible to vehicles south of Delivery Area 1. The levee at Delivery Area 1 is highly eroded and caution will be taken when accessing. The Contractor shall assess site conditions and propose appropriate equipment to access the perimeter levee. Off-road equipment that minimizes rutting or damage to the levees is preferred.

Material Quantity:

Contractor shall deliver:

1.Approximately 35-percent of the total materials to Material Staging Area 1.
2.Approximately 65-percent of the material to Material Staging Area 2.
3.A minimum of 200-tons to Delivery Area 1.
4.A minimum of 20-tons to Delivery Area 2.

Period of Performance:

Material Staging Area 1: The Contractor shall deliver materials during the week, Monday through Friday, between the hours of 8:00 am to 5:30 pm.

Material Staging Area 2 and Delivery Areas 1 and 2: The Contractor will be confined to a work window between September 1 and October 31, 2020. Materials shall be delivered during the week, Monday through Friday, between the hours of 8:00 am to 5:30 pm.

All materials are to be delivered by October 31, 2020.

Method of Evaluation:

Bids received that provide certified documentation that the materials proposed meet the minimum quality requirements will be evaluated on Unit Price only.

Measurement and Payment:

Payment for the Task 1 in the Bid Schedule, as further specified herein, shall include all compensation to be received by the CONTRACTOR for furnishing all tools, equipment, supplies, and manufactured articles, and for all labor, operations, and incidentals appurtenant to the items of work being described, as necessary to complete the various items of the WORK all in accordance with the requirements of the Contract Documents, including all appurtenances thereto, and including all costs of permits and cost of compliance with the regulations of public agencies having jurisdiction, including Safety and Health Requirements of the California Division of Industrial Safety and the Occupational Safety and Health Administration of the U.S. Department of Labor (OSHA). (e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
