About this file
This amendment to a solicitation provides clarification on several points for a contract to rehabilitate an observation tower at Medicine Lake National Wildlife Refuge in Montana. The period of performance will be controlled by two notices to proceed, with construction starting in April 2022. The response due date is extended to September 3, 2021. Clarification is provided on past performance examples requested and on submitting bid bonds electronically. The scope of work involves rehabilitating the one hundred foot tall tower constructed in 1936 to current building codes, including replacing wood treads, landings, and guardrails, and repairing concrete piers to better serve public safety.

Solicitation Amendment
Document 140F0121R0089-0002
Document Title Rehabilitate Observation Tower, Medicine Lake NWR MT
A. The purpose of this amendment is to clarify the period of performance, clarify the past performance requirements and extend the proposal due date.
B. The following contractor questions and Government responses are provided for contractor use:
1. Contractor Question: The period of performance runs through most of the winter and as cited is not feasible to complete the work during the winter weather experienced in Montana. How does the Government intend to resolve this?
Government Response: The Government intends to issue two (2) Notice to Proceeds (NTP) which control the period of performance. The first NTP would allow the contractor to process material submittals, place orders for materials, equipment, invoice for certain stored materials and accomplish other administrative actions. The construction NTP would be delayed until/about April 2022 and begin the 180-calendar day period of performance. The period of performance dates cited in the solicitation document are system generated and are not controlling, the NTP controls the dates for the 180-calendar day period of performance. Certain elements of work may be coordinated with the Government and accomplished during the first NTP period. Invoicing for stored materials would be for higher valued items such as the steel and lumber. The stored materials being invoiced for would need to be available for a joint contractor and Government inventory, prior to invoicing. The Government has a 10 ft. x 20 ft. storage shed available for stored materials on-site.
2. Contractor Question: Please explain the requirements for the Past Performance cited in the Factor 2 Technical Proposal, Sub-factor 3: Organizational Capabilities and Past Performance.
Government Response: Past Performance requirements are cited in Federal Acquisition Regulation (FAR) Part 15. Specifically, 15.305 (2) Proposal Evaluation, as cited in the solicitation excerpt. For this solicitation we’ve asked for 3 to 5 recent and relevant examples of “similar building or tower type projects, which were completed by your firm within the previous five years”. We recognize this fire tower project is somewhat unique to the Department of Interior agencies, the Federal and State Forestry Services. Therefore, we chose the wording “similar building or tower type projects”. As cited in the FAR reference, 15.305 (2) past performance evaluation will:
“…(iii) The evaluation should take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition.
(iv) In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance…” Your Technical Proposal for this subfactor should explain the relevance of your past example projects, to this project. Firms that have no relevant past performance will be rated Neutral, the offeror will not be evaluated favorably or unfavorably on past performance.
