Descriptions/Specifications/Work Statement
Summary of Work:
The U.S. Fish and Wildlife Service (USFWS) Contracting and General Services (CGS) Region 1 has been tasked to solicit for Papahanaumokuakea Marine National Monument, Honolulu, Hawaii. The Contractor would prepare a cultural resources overview to access to Nihoa and Mokumanamana, Papahanaumokuakea Marine National Monument (Monument), Northwest Hawaiian Islands.
These activities constitute undertakings subject to review and compliance with Section 106 of the National Historic Preservation act (NHPA). While the FWS has exercised Section 106 for access and activities at the islands over the past decade, a comprehensive identification of potentially affected cultural resources has been lacking. Therefore, the contract will be designed to obtain cultural resource overview concerning access to Nihoa and Mokumanamana, Papahanaumokuakea Marine National Monument, Northwest Hawaiian Islands.
The purpose of the contract will be to compile, describe, and present the history, archaeology, and culture of the resources at the principal landing, access, work and camping locations on Nihoa and Mokumanamana. The expected end-product/deliverable is a professional technical cultural resource report (report) and appendices. The Contractor will fulfill the Purpose (above) and complete the tasks using professional archaeological methods including archival research, informant interviews, fieldwork, data analysis, and report preparation. The fieldwork for this contract involves direct observation, mapping, photography, in-field description, and analysis. Excavation or artifact collection is not permitted.
The cultural resources report will serve as the “historic property identification” for the undertaking and APE. The report will be used, in part; to put all interested and consulting parties on the “same page” It will provide a baseline for building consensus for long term use and management of the activity locations in particular, and the islands in general. The report will represent the identification, evaluation and assessment-of-effect steps for NHPA Section 106 process. The report will be key to creation of a “final” NHPA Section 106 agreement document that would eliminate the need to consider NHPA Section 106 every time the co-trustees, their agents and permittees visit the islands to do the usual, routine, desire, activities and management actions. The work will follow standard professional practices and techniques, including the standards and procedures established by the Hawaii State Historic Preservation Office, and Secretary of Interior Standards and guidelines on archaeological research.
All islands are closed to the public. All access and research at the islands is governed and requires permit approval from, the co-trustees of the Monument (FWS, NOAA, State of Hawaii and the Office of Hawaiian Affairs). Access to Nihoa and Mokumanamana requires that the contractor have access to a ship that meets the regulations of transit and access to the Monument, and a zodiac or equivalent for landing. The Contractor will need to take into consideration the access to permitting and a ship to access the islands.

(a) Definition. “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.
(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may—
(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
(2) Reduce the contract price to reflect the reduced value of the services performed.
(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—
(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
