Section 2.0 Statement of Work

Subsea Pipelines and Pipeline Infrastructure Decommissioning

2.0 Introduction

The Bureau of Safety and Environmental Enforcement (BSEE), an agency of the U.S. Department of the Interior (DOI), is charged with promoting safety, protecting the environment, and conserving resources offshore through vigorous regulatory oversight and enforcement of offshore facilities engaged in oil and gas exploration, development, and production operations on the Outer Continental Shelf (OCS). Among other responsibilities, BSEE enforces regulations for decommissioning pipelines and pipeline-related subsea infrastructure on the OCS seabed, and regulations for decommissioning wells, platforms, and other facilities. (See 30 CFR part 250, subpart Q, §§ 250.1700—250.1754.)

Decommissioning generally includes dismantling and removing infrastructure and returning the ocean and seafloor to acceptable, pre-lease or pre-ROW (right-of-way) grant corridor conditions. The Outer Continental Shelf Lands Act (OCSLA) and BSEE regulations establish decommissioning obligations to which a lessee or designated operator must commit to when they sign an offshore lease or to which a pipeline ROW holder must commit to when issued a pipeline ROW grant under OCSLA. This includes the requirement to apply for and obtain approval for subsequent decommissioning and removal of subsea infrastructure. These requirements are designed to minimize the environmental and safety risks inherent in leaving abandoned pipeline subsea infrastructure on the seafloor and to reduce the potential for obstructions or conflicts with other uses of the Federal OCS (i.e., commercial fishing/aquaculture, military activities, transportation industry, other oil and gas/renewable energy operations, etc.).

2.1 Objective

The study seeks to improve BSEE’s management of pipeline subsea infrastructure by assessing the potential environmental impacts from pipelines and pipeline subsea infrastructure (including those decommissioned in-place [DIP]) on the coastal and marine waters, and the associated ecosystems and sensitive habitat/species of the Gulf of Mexico (GOM) OCS.

The current BSEE regulations (30 CFR 250.1751) allows for decommissioning a pipeline in place with the approval of the Regional Supervisor. The study will focus on the contamination risk from residual potentially-hazardous materials within pipelines and associated equipment (i.e., scale, paraffin, chemicals, normally-occurring radioactive material [NORM], etc.), after decommissioning requirements and/or seawater flushing is complete, as per the current regulations in 30 CFR 250 Subpart Q. This study will allow BSEE to better understand the environmental impacts of decommissioning a pipeline in place and provide the information to allow the Regional Supervisor’s to make more informed decisions about when to approve the applications for decommissioning a pipeline in place.

The research report, findings, and conclusions will be made public after the project is completed to assist with direct and cumulative impact analyses prepared under the National Environmental Policy Act (NEPA), which support BSEE’s pipeline permitting program.

2.2 Research Questions

1. What are the environmental impacts of decommissioning pipelines in place?

2. What is the composition and toxicity of a pipeline flushed and decommissioned in place compared to a pipeline that was removed and cleaned onshore?

3. What are the current decontamination best practices for pipeline decommissioning in place?

2.3 Relevance and Importance of the Research

This study will help BSEE address concerns on pipelines decommissioning identified in a 2021 GAO Audit Report Offshore Oil and Gas: Updated Regulations Needed to Improve Pipeline Oversight and Decommissioning | U.S. GAO and reconfirmed in GAO report on BSEE Decommissioning GAO-24- 106229, OFFSHORE OIL AND GAS: Interior Needs to Improve Decommissioning Enforcement and Mitigate Related Risks. The GAO reports point to BSEE’s lack of understanding of the environmental impacts of DIP. The results of this study will be used to provide more insight into the environmental impacts of DIP and help BSEE conduct their reviews of abandonment-in-place requests under 30 CFR

250.1751. The findings and conclusions of this research will be considered influential as it may impact BSEE’s implementation of a current regulation, but does not rise to the level of novel, controversial, or precedent-setting. Since it is influential the final report will be peer reviewed to maintain scientific integrity. The findings of the peer review will be posted along with the final report after it is completed to maintain transparency. The contents of the research report will not be proprietary.

2.2 Tasks:

The contractor shall perform the following tasks:

2.2.1 Task 1: Develop a Project Management Plan

i. The Contractor shall prepare a draft Project Management Plan (PMP) for submittal no later than three (3) days prior to the Post-Award Meeting.

o The Contractor will describe all project responsibilities, any proposed subcontracting arrangements, communication and coordination, record keeping, and scheduling of all tasks, subtasks, meetings, and deliverables. The Contractor shall discuss its procedures for managing the project, criteria for assuring quality and acceptability of the deliverables, and details regarding the schedule and coordination of this project. A project timeline in the form of a gantt chart shall be provided to show the plan for research execution. The Contractor shall also discuss plans for ensuring successful completion of individual tasks on time, on budget, and of the highest quality.

o The plan shall include a Risk Management Plan which describes the range of factors and challenges proposed by the Contractor believed to influence completion of the study, including the Contractors approach for overcoming those factors.

o The PMP should outline the tests that will be conducted to meet the specifications of the tasks below. BSEE is relying on the contractor to propose the research design and methods.

o The Contractor’s Project Manager (PM) shall have sufficient authority to serve as the point of contact with BSEE and to provide leadership to the project team. The PM shall coordinate the execution of all tasks in the project and will be responsible for all deliverables, budget control and quality assurance for all products, compliance, and adherence with the schedule of the purchase order, in addition to ensuring that all personnel work cooperatively to achieve the goals of the requirement. This project requires multiple interactions with BSEE to ensure that these research efforts will best meet BOEM’s needs.

o The Contractor shall include Quality Assurance/Quality Control (QA/QC) procedures as part of the Project Management Plan.

2.2.2 Task 2: Literature Review

i. The literature review should be an Information Search and Synthesis (ISS) on:

a. Current understanding of decommissioning in place; including environmental impacts, toxicity levels expected of a pipeline flushed and decommissioned in place compared to a pipeline that was removed and cleaned onshore, and current decontamination best practices,

b. The contaminants, materials, and the concentrations that are considered harmful to the environment,

c. In-situ, onshore and/or offshore pipeline decanting, contaminant-removal, and equipment decontamination techniques and how that correlates to decommissioned in place pipeline data,

d. And International standards to help define environmental standards for pipeline removal and abandonment; including mitigation measures to reduce/negate impacts.

ii. The review should look at U.S. and international standards and regulations, industry and academic projects, as well as any other information available as of the year 2024.

iii. The review should provide a consensus from all material reviewed of the best practices for pipeline decanting, contaminant-removal, and equipment decontamination techniques that BSEE can use in review of Decommissioning in Place (DIP) proposals.

iv. The information from this Literature Review is crucial for the determination and establishment of optimal management practices applicable to forthcoming DIP proposals.

Furthermore, it will be included as part of the associated NEPA review with the explicit purpose of identifying potential mitigation strategies for incorporation into the development and implementation processes. This review shall be included in the final report.

2.2.3 Task 3: Develop a Sample Collection Plan and Associated Collection Kits

i. Develop a scientifically defensible plan and associated protocol for collecting representative sampling materials, fluids, and water from the vicinity of the inside of a minimum of ten (10) decommissioned pipelines and five (5) decommissioned pipeline infrastructure components (e.g., Pipeline End Manifolds and Terminations [PLEMs/PLETs], valves, and other connections). The sampling plan, associated protocol, and outlined procedures should consider material collection from the following:

o An offshore vessel, upon completion of a pipeline/pipeline infrastructure decommissioning and removal.

The offshore sampling will only take place once the pipeline(s) and/or component(s) are brought to the surface, secured, and accessible.

BSEE will assist with collection of samples by qualified BSEE personnel (after training) and/or contractor access to the vessel for already scheduled pipeline decommissioning for the sampling to take place.

o An onshore equipment, scrapping, and/or recycling yard.

The yards considered for onshore sampling are located along the Gulf coasts of

Louisiana and Texas in industrial areas that support offshore operations (i.e., Venice, New Orleans, Houma, Morgan City, New Iberia, and Cameron, Louisiana and in Galveston, Houston, Corpus Christi, and Brownsville, Texas).

BSEE will assist with yard identification for the sampling and/or manage the material collection in coordination with the awarded contractor. The onshore sampling must comply with the applicable regulations and only consider components yet to receive steam, mechanical, or solvent treatments to ensure that the encrusting or remnant contaminants remain for sampling and testing.

ii. The sampling plan, associated protocol, and outlined procedures must also consider the following components:

o Sample bottle or container type and pre-collection preparation;

o Sample collection equipment (i.e., surface swabs, scrapers, sludge samplers, pipettes, bailers, Coliwasa units, etc.);

o Sample collection techniques for the various materials and equipment;

o Sample storage, preservation, and transportation procedures;

o Sample labeling and chain-of-custody procedures;

o Equipment cleaning and reuse methodologies (if applicable), and o Sampling safety considerations.

iii. Assemble a minimum of 20 Collection Kits pending BSEE approval of the selected sampling plan. After approval, ship the kits to the following address for secure storage and quick access until use by qualified BSEE personnel to collect samples:

Bureau of Safety and Environmental Enforcement Attention: Office of Environmental Compliance 1201 Elmwood Park Blvd New Orleans, LA 70123

iv. Coordinate with BSEE on the timing of upcoming decommissioning and removal operations to allow for logistic coordination and travel to the Gulf of Mexico (GOM) region to conduct the sampling, as outlined in Section 2.2.2. i. A. and B. above.

v. To allow for increased targets-of-opportunity, the awarded contractor is also required to provide virtual training on the collection process and procedures, support sampling by qualified BSEE personnel using the available Collection Kit(s), and facilitate the transfer of the BSEE-collected sample(s) to the identified laboratory (See Task 3). This will allow qualified BSEE personnel to take the samples reducing response time and ensuring proper sampling for the testing.

vi. The Sample Collection Plan shall include a laboratory testing program that uses the information from the Task 2: Literature Review to determine the tests to determine the associated contaminants/levels that have the potential to impact the OCS water quality and resources. The testing program should include, at the minimum, the necessary tests to determine composition and toxicity of the samples.

2.2.4 Task 4: Analysis of Materials Collected from Task 3

i. Conduct the necessary laboratory analyses to assess the approximate composition and toxicity levels of the materials collected during the field sampling efforts. It is the Contractor’s responsibility to ensure that the testing is carried out in such a manner acceptable to the US Environmental Protection Agency (USEPA) laboratory standards or the US Coast Guard (USCG) laboratory standards. The laboratory must be in compliance with the USEPA Good Laboratory Practice Standards (GLPS) and the USCG Recognized Laboratory.
