United States Department of the Interior
INTERIOR BUSINESS CENTER
Washington, DC 20240
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
AUTHORITY: FAR 6.302, 41 U.S.C. 253(c)
Solicitation #140D7019R0007
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR 6.3 and in accordance with the requirements by FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition for the Department of the Interior, Interior Business Center (IBC), Acquisition Services Directorate (AQD), Division IV (D4), in support of the Department of Homeland Security (DHS), Science and Technology Directorate (S&T), Office of National Laboratories (ONL), Plum Island Animal Disease Center (PIADC).
2. Nature and/or description of the action being approved.
DHS S&T PIADC has a need to award a Small Business Innovative Research (SBIR) Phase III contract to Red Balloon Security (RBS) to upgrade and expand the existing PIADC Building Management System (BMS) production and test & development (T&D) environments. RBS will upgrade existing Siemens panels and install new Siemens panels with RBS’ Symbiote Defense technology. Only Siemens Building Automation System hardware and software will be compatible with the existing PIADC BMS. In addition, Cisco network switches will need to be provided to support the upgrade, expansion and reconfiguration of the network. RBS’ Symbiote technology was developed under SBIR Phase II contract D15PC0113. This SBIR Phase III contract award is derived from, extends, or completes efforts made under the prior SBIR Phase II funding agreement and is authorized pursuant to 15 U.S.C. 638(r)(4). This award is for a one-year base period of performance. This contract will be awarded to:
Red Balloon Security 336 W. 37th St Ste 1024 New York, NY 10018-4592
DUNS: 078682097
CAGE: 6TM83
The resulting contract will be funded using Research, Development Acquisition and Operations (RDAO) five (5) year funds.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
RBS will provide to the Federal Government the Symbiote Defense technology developed through SBIR Phase I and Phase II awards performed through multiple agencies. This contract action will upgrade, reconfigure and expand the existing PIADC BMS, production and test & development (T&D) environments, as necessary to enhance system cyber security through the injection of Symbiote Defense technology and to extend monitoring capability to high priority areas within Bldg. 101 in order to monitor and detect potential abnormal conditions in biocontainment airflow.
Enhancements installed as part of this effort will minimize the potential for or prevent the release or transfer of airborne biological agents outside of containment. Priority will be given to rooms, spaces and areas where the risk of airborne release is highest while also considering the utilization needs of the research staff.
The total estimated value inclusive of all optional tasks is $1,346,519.46. This action will not include FAR 52.217-8, Option to Extend Services.
4. An Identification of the statutory authority permitting other than full and open competition.
FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 41 U.S.C. 3304(a)(1)
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
The PIADC BMS is a Siemens system. Only Siemens products and software are compatible with the system. Changing to another building automation system product would require replacing all of the existing equipment, software, programming/graphics and retraining of local staff. A complete replacement of the system would not be cost effective. The upgrades made to the Siemens system as part of this project will support regulatory requirements for bio-containment facilities.
Red Balloon Symbiote Defense technology is only available on Siemens building automation system products.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The potential exists for the Select Agent Program, the regulators for the PIADC facility, to limit operations at the facility due to biosafety concerns if this solution is not implemented in a timely manner. Any impairment to the PIADC mission would present an unacceptable risk to DHS S&T PIADC and could compromise the nation’s readiness and capability to effectively respond to a foreign animal disease outbreak. Due to its unique capabilities, (i.e., compatibility with existing system components, familiarity with operational requirements and Symbiote Defense technology) Siemens is the only source that can perform the required effort at this time.
SBIR Phase III contracts are exempt from FAR Subpart 5.2 based on the SBIR Phase I award being in accordance with FAR 5.202(a)(7) The proposed contract action results from acceptance of a proposal under the Small Business Innovation Development Act of 1982 (Pub. L. 97-219)
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on a comparison to current market rates for the same or similar work.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
Minimal market research for this effort was conducted where timely implementation of the reconfiguration of the existing system and integration of the new integrated Symbiote technology were the goal. The existing BMS is run off of Siemens panels and software and changing to a new system would cause a significant duplication of costs.
9. Any other facts supporting the use of other than full and open competition;
such as:
None
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
None
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Currently PIADC has not taken any additional efforts to remove or overcome any barriers to competition. PIADC is currently scheduled to transition operations to another site at which time PIADC will be closed. It is not practical to replace the Siemens BMS system.
Commercialization/implementation of the current Siemens/Symbiote Defense product supports the long term goal for the SBIR effort which is to expand the use of the Symbiote Defense product to other Building Automation Systems. This effort directly support increased Cyber-Security of Siemens and will encourage the use of the
