About this file

This is an amendment to a solicitation for appraisal services related to White Pine County CRDA Round 3 Land Sale Parcels A. The amendment, issued by the Department of the Interior's Interior Business Center, attaches a wage determination document to the original solicitation 140D0426Q0541. The primary modification indicates the addition of prevailing wage requirements through the inclusion of a mandatory wage determination, which contractors must comply with when performing appraisal services for the identified White Pine County real property parcels. This amendment ensures that all work performed under the contract adheres to applicable federal wage and labor standards. No other substantive changes to the original solicitation terms, pricing, delivery schedules, or contract requirements are detailed in this amendment document, as it serves solely to incorporate wage determination compliance into the existing contractual framework.

INSTRUCTIONS TO OFFERORS:

PROPERTY DESCRIPTION

The Department of the Interior (DOI), Interior Business Center (IBC), Acquisition Services Directorate (AQD), on behalf of the Appraisal & Valuation Services Office (AVSO), is issuing this request for quote (RFQ) for appraisal services.

The appraisal assignment consists of preparing market valuations and appraisal reports for two sale parcels, Parcel A and Parcel C, as part of the White Pine County Conservation, Recreation and Development Act (WPCCRDA) 2026 Land Sale Program in White Pine County, Nevada. Both parcels are scheduled for public auction and will be appraised in accordance with the Scope of Work (SOW), applicable federal regulations, and the specified definition of Market Value.

The appraisal will develop current opinions of Market Value for the Fee Simple Estate of each parcel, subject to reservations and encumbrances of record. Existing rights-of-way that will convert to Perpetual Right-of-Way Grants pursuant to 43 CFR 2885.22 are not subject to separate valuation. The assignment will include analysis of each parcel's physical and legal characteristics, access, market conditions, highest and best use, and relevant market data to support credible value conclusions.

i. Identify years of experience appraising rural property in the state of Nevada to UASFLA (Yellow Book) standards. If the appraiser has experience with the subject property type, but not in the local market area, then they must state this fact and demonstrate his/her experience in other areas as well as the actions proposed that will allow them to complete the assignment competently.

ii. Identify types of rural property appraised in northwest Nevada and/or nearby market areas. The appraiser must demonstrate geographic competency in the market area.

iii. Compliance with the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Edition (UASFLA / Yellow Book) is required for this appraisal assignment. Parcel A (NVNV106761852)

Project Overview: WPCCRDA 2026 Land Sale: There are 2 parcels included in this project. These parcels will be brought to public auction for sale. Some of the parcels have Rights-of-Ways that will convert to Perpetuity Right-of-Way Grants at the time of sale as per 43 CFR 2885.22. Thus, these Perpetuity Right-of-Ways do not require valuation within this appraisal. Because of the similarity in the parcels, both of the appraisal assignments (WPCCRDA Land Sale Round 3 – Parcel A and Parcel C) will be awarded to one Appraiser.

This Appraisal Assignment consists of One (1) Sale Parcel to be valued. Provided Subject Property Exhibits identified on Page 7 are included at the end of this SOW.

Note: “Legal Clarification” found on Page 3 of this SOW must be considered in appraisal analysis and the statement must be included in the appraisal report.

SECTION 1 – SUBJECT IDENTIFICATION AND GENERAL INFORMATION

Identification:

Case Name: WPCCRDA Land Sale Round 3 – Parcel A AVIS Number: L260109 Location: White Pine County, Nevada Acreage: 810 Gross Acres Property Type: Vacant Land Case Type: Sale/Disposal (FLPMA Auction)

Client:

U.S. Department of the Interior (DOI). Appraisal and Valuation Services Office (AVSO) and the Bureau of Land Management (BLM).

Intended Users:

The Appraisal Report will be used by the U.S. Department of the Interior staff within AVSO and BLM on behalf of the United States of America. Use of the report by others is not intended.

Intended Use:

The Appraisal Report and Market Value conclusions set forth will be used by DOI (AVSO and BLM) to assist in the FLPMA Auction Sales of the identified property and property rights. The appraisal report is not intended for any other use.

Property Description:

There is One (1) Sale Parcel to be appraised (see Exhibits in the zip file attached to the SOW). Parcel A property is easily accessed along the southern border of the parcel via 212th North Street, which is a frequently traveled, county-maintained, paved road which leaves US Hwy 93 approximately 5 miles north of Ely, in White Pine County, Nevada.

Legal Description:

BLM described legal descriptions as:

Mount Diablo Meridian, Nevada T. 17 N., R. 63 E.

sec. 15, SE1/4SE1/4SE1/4;

sec. 22, E1/2NE1/4 and E1/2SE1/4;

sec. 23.

Purpose of Appraisal and Property Interest to be Appraised:

The purpose of the Appraisal is to form current opinion of Market Value for Fee Simple Estate (subject to reservations of record) of Sale Parcel, based on requirements detailed in this SOW, regulatory requirements, the definition of Market Value provided, and considering all applicable Sale Parcel encumbrances and reservations.

By definition, a Fee Simple Estate is the absolute ownership of realty unencumbered by any other interest, subject only to the limitations imposed by governmental powers;

however, the bundle of rights theory associated with real estate ownership recognizes that something less than the fee estate may be sold.

The Appraiser must immediately notify the AVSO Review Appraiser of any indications of rights contrary to the rights described in this SOW, as any significant differences may result in amended instructions or constitute a new appraisal assignment.

Outstanding Rights:

See Exhibit 7 in zip file. Sale Parcels will be sold “Subject To” existing encumbrances and ownership of all existing encumbrances owned by the United States will be transferred to Sale Parcel Buyers, except for ROWs that are being converted to Perpetual Right of Ways (per 43 CFR 2885.22) and any rights specifically reserved for

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada the United States. Therefore, all property encumbrances that will pass through to the Sale Parcel Buyer must be considered in the Appraisal.

If the Appraiser discovers any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances during the appraisal process that were not presented in this SOW, then the Appraiser must immediately report such findings to the AVSO Review Appraiser.

Reservations:

The United States of America is reserving the following rights associated with the Sale Parcels.

A. A right-of-way for ditches or canals by the authority of the United States pursuant to the Act of August 30, 1890 (43 U.S.C. 945); and

B. All mineral deposits in the land so patented, and to it, or persons authorized by it, the right to prospect for, mine, and remove such deposits from the same under applicable law and regulations to be established by the Secretary of the Interior.

Legal Clarification:

(Minerals Reservation)

Terms and Conditions: All minerals for the Sale Parcels will be reserved to the United States. The Patents, when issued, will contain a mineral reservation to the United States for all minerals. In response to requests to clarify this mineral reservation as it relates to mineral materials, such as sand and gravel, we refer interested parties to the regulation at 43 CFR 3601.71(b), which provides that the owner of the surface estate of lands with reserved Federal minerals may “use a minimal amount of mineral materials for “personal use” within the boundaries of the surface estate without a sales contract or permit. The regulation provides that all other use, absent statutory or other express authority, requires a sales contract or permit. We also refer interested parties to the explanation of this regulatory language in the preamble to the Final Rule published in the Federal Register in 2001, which stated that minimal use “would not include large-scale use of mineral materials, even within the boundaries of the surface estate.” [66 Fed. Reg. 58894 (Nov. 23, 2001] Further explanation is contained in BLM Instruction Memorandum No. 2014-085 (April 23, 2014), available on BLM’s website at:

https://www.blm.gov/policy/im-2014-085

Personal Property: None.

Improvements:

“The BLM reports there are range improvements including fencing and a cattleguard.

The “Contributory Market Value” for these improvements are to be included in the appraisal.”

Property Access:

Provided below is the summary description of the apparent legal access for the Sale Parcel(s) as provided by BLM. If a Sale Parcel lacks legal access from a public road or highway it will be conveyed as such and acquiring future Legal Access will be the responsibility of the Buyer.

(Sale Parcel NVNV106761852) Parcel A is easily accessed along the southern border of the parcel via 212th North Street which is a frequently traveled, county-maintained, paved road which leaves US Hwy 93 approximately 5 miles north of Ely. Additionally, Parcel A can be accessed on the western border of the parcel via 9th West Street, a county-maintained gravel road.

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada

Water Rights: No water resources are being transferred with the Sale Parcel(s).

Environmental Conditions:

There are no known detrimental Environmental Conditions associated with the Sale Parcel(s).

Larger Parcel:

Although there may be substantial Federal land holdings in the neighborhoods surrounding the Sale Parcel(s), there are no known damages to the remaining Federal lands as a result of the Parcel Sales.

Section 1.2.8 of UASFLA, 6th Edition p. 18, states:

It is recognized that federal agencies may use (or are directed by statute or other authority to use) these Standards outside the realm of acquisitions/exchanges (for sales or conveyances of federal land, leases, and fee determinations). In these situations, the scope of work may be modified. For example, some of the special rules and methods, including the Larger Parcel analysis and the Before and After Methodology, may not apply in these appraisal assignments. Additional Hypothetical Conditions related to Highest and Best Use and Ownership may be required as well. The protection of the public trust remains paramount and must be the foundation that Appraisers and Client Agencies operate from when making these determinations.

Considering all factors of this Parcel Sale, no Larger Parcel analysis is required for this assignment. Its omission does not have an impact on the Credibility or Reliability of the Appraisal Valuation.

Owner/Occupant: United States of America under the administration of the BLM.

Leases/Tenancies:

Grazing lease will be terminated upon sale.

The subject property falls within the boundary of a BLM Grazing Lease allotment.

Consistent with UASFLA, the BLM grazing permit is not part of this appraisal assignment and must be excluded from the valuation of the Subject Property. As stated in UASFLA 4.11.2. Federal Grazing Permits (bold added for emphasis):

In federal acquisitions involving ranch lands, appraisers must disregard any value added to those lands as a result of their actual or potential use in combination with adjacent federal lands under revocable grazing permits… By law, these federal permits to use the public domain for grazing are revocable and create no property rights in the holder. Thus, while grazing permits typically remain with a privately owned base property for many years, permits revert to the federal agency when the base property is sold and may or may not be granted to the new owner. As a result, in federal acquisitions, privately owned lands cannot be aggregated with permitted public lands for valuation purposes, as “[t]o require the United States to pay for this value would be to create private claims in the public domain.” Appraisers must therefore disregard the use or potential use of the subject property in conjunction with federal grazing permit lands—even if “this element of value would be considered by a potential buyer in the open market”—because the government “need not compensate for value which it could remove by revocation of a permit for the use of lands that it owned outright.”

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada

Because Congress elected not to create compensable rights out of what are now licensees, landowners “have no compensable right in the land covered by their grazing permits or in the permits themselves.” As a result, federal grazing permits cannot be considered in estimating market value.

Therefore, in the context of the analysis for this sale, the Federal properties will be treated as though they are held in fee, sandwiched between other fee land and Federal owned BLM managed land. In general, the only entities that can apply for BLM grazing permits are those that own or lease private lands (known as the base property) within the boundaries of a specific BLM Grazing Allotment. As the subject tracts will be treated like private lands within the boundaries of an existing allotment, consideration should be given as to whether market participants would consider livestock grazing a potential use. Even though Nevada is an “open range” state where landowners have no obligation to put up fences to keep their livestock on their own property, there is an exception for federal lands. As a result, when “Exchange of Use” does not exist, the landowner is responsible for constructing fences needed to ensure their livestock do not trespass onto the federal lands.

The contact information for the BLM Natural Resource Specialist that is familiar with the Subject Property, and the surrounding BLM Grazing Allotments will be provided upon contract award. It is the appraiser’s responsibility to determine if fencing would be required for the subject property to accommodate livestock grazing on private lands within an established BLM Grazing Allotment, and how that cost may impact the financial feasibility of such a use.

Owner Contact: The Appraiser will be provided with Owner Contact information upon Contract Award.

Subject Property Exhibits:

The following Subject Property Exhibits are included at the end of this SOW as Addenda.

SECTION 2 – APPRAISAL REQUIREMENTS AND INSTRUCTIONS

Appraisal Standards and Other

Requirements:

1. Uniform Standards of Professional Appraisal Practice (USPAP)

2. Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA), 6th Edition

Market Value:

Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th ed., Section 1.2.4, pg.

10, The Appraisal Foundation, 2017.]

Date of Value:

The effective date of value must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves, in advance, other conditions in writing. It is not a requirement that the effective date and date of inspection be the same date.

Extraordinary Assumptions:

The Sale Parcel(s) may be encumbered with various term ROW Grants, some of which may survive sales of the Sale Parcel(s) when the lands are transferred out of Federal ownership; and others that may be relinquished before the transfers occur. Therefore, to properly develop credible opinions and conclusions in the appraisal, term ROW Grants that will survive the sales are to be based on the Extraordinary Assumption that as of the date of value the ROW Grants not relinquished will continue into perpetuity, i.e., at the end of each term, the ROW Grant will be renewed for another term.

The Sale Parcel(s) may currently be encumbered with ROWs that will be replaced with Perpetual Right of Ways prior to transferring the lands out of Federal ownership. Since the relinquishments and sales will not happen until after the Date of Appraisal, but prior to issuance of the Patent, for purposes of reasonable analyses, the valuations may be based on the Extraordinary Assumption that as of the Date of Value the existing subject ROWs will be converted to Perpetual Right of Ways as per 43 CFR 2885.22.

No other Extraordinary Assumptions are allowed without prior written approval from the AVSO Review Appraiser.

Hypothetical Conditions:

None. If the appraiser determines that Hypothetical Conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval.

Jurisdictional Exceptions:

Note that the definition of market value includes reference to a reasonable Exposure Time. USPAP’s SR 1-2 (c) (iv) requires that “When reasonable exposure time is a component of the definition for the value opinion being developed, the appraiser must also develop an opinion of reasonable exposure time linked to that value opinion.”

However, UASFLA 4.2.1.2 states, “Appraisers should not link an opinion of market value made for federal acquisition purposes to a specific exposure time. This jurisdictional exception is required for appraisals applying the federal definition of market value.” In order to be consistent with UASFLA the appraiser is instructed to employ a Jurisdictional Exception and not develop an estimate of exposure time. The regulations requiring the exception to USPAP SR 1-2 (c) (iv) should be cited as

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada

UASFLA 4.2.1.2 and 49 C.F.R, Part 24.103. Any other jurisdictional exceptions require approval from the AVSO Review Appraiser.

Reporting Extra-ordinary Assumptions, Hypothetical Conditions and Jurisdictional Exceptions:

The appraiser must clearly identify all Extraordinary Assumptions and Hypothetical Conditions wherever the final opinion of value is stated, including the Letter of Transmittal and the Summary of Salient Facts, Certification, and General Assumptions and Limiting Conditions.

As required by USPAP, the appraiser must include a statement that the use of any Extraordinary Assumptions and Hypothetical Conditions might have affected the assignment results.

Jurisdictional Exceptions, other than the approved one regarding Exposure Time, must also be disclosed in the same manner as directed above for Extraordinary Assumptions and Hypothetical Conditions.

Property Inspection:

The Appraiser must Inspect the Subject Property and all the Market Comparable Properties used in direct comparison, unless the AVSO Review Appraiser has approved other conditions in writing.

The Appraiser must give the property owner, or the owner’s designated representative (BLM Realty Specialist), an opportunity to accompany the Appraiser during the property inspection, and the results of such offer must be stated in the appraisal report Certification.

The subject lands are under Federal ownership, so Property Inspection Certificates are not required. However, the Appraiser must notify both the BLM Realty Specialist and the AVSO Review Appraiser when the property inspections will occur, as one or both may wish to accompany the Appraiser on the inspections.

Pre-Work Appraisal Meeting:

The Appraiser will be required to attend a Pre-Work Appraisal Meeting with the assigned AVSO Review Appraiser, the BLM Realty Specialist and/or other BLM Agency Representative, and/or other Interested Parties. The appraiser shall coordinate with the BLM Realty Specialist, AVSO Review Appraiser, and other relevant parties to establish the date and time for the Pre-Work Appraisal Meeting. Whenever feasible, this meeting should be conducted prior to commencement of any work on the subject property.

If any significant items of concern are observed during the Property Inspection, from aerial photographs, or other materials discovered and researched during the appraisal process that were not discussed in the Pre-Work Appraisal Meeting, then the Appraiser must contact the AVSO Review Appraiser (RA) before continuing with the appraisal assignment.

Controversies/Issues:

None known. Should the Appraiser identify any controversies or issues during the course of the assignment that were not previously discussed with the Review Appraiser (RA), then the Appraiser must immediately notify the RA before proceeding with the assignment.

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada

Legal Instructions:

See Legal Clarification of Mineral Reservation. Should the appraiser require additional Legal Instruction during the course of the Appraisal assignment, he/she must immediately notify the AVSO Review Appraiser.

Special Appraisal Instructions:

1. The Appraiser must deliver an Appraisal Report that complies with both the current USPAP and UASFLA 6th Edition. Further, the Appraisal Report must conform to the sequence and content outlined in UASFLA 6th Edition, Appendix A (Pages 208-212; Appraisal Report Documentation Checklist) and Appendix B (Page 213-214; Recommended Appraisal Report Format for Total Acquisitions).

2. The Appraiser’s “Scope of Work as outlined and defined in USPAP”, to be used in this appraisal assignment must be sufficient to produce credible and reliable appraisal assignment results for the intended use of the Appraisal Report. 3. The Appraisal Report must include a thorough Market Analysis Section contemporaneous with the Effective Date of Appraisal in support of the specific Highest and Best Use Conclusion and Market Condition Adjustments &/or No Market Condition Adjustment, if warranted. The Market Analysis Section should specifically address the Market Conditions and Supply and Demand Aspects for Subject’s Property Type in the subject’s market area. The data and conclusions generated through Market Analysis are crucial components for other portions of the valuation process, including the Highest and Best Use Conclusion. As applicable, this Market Analysis Section can include interviews with real estate market participants (such as brokers, lenders, Buyers, sellers), economic trends in the market sector and location, listing and sales activity or non-activity, commodity pricing, and changes in the financial markets.

4. For all Sale Parcels, where a change in Zoning may be possible, the Appraiser must contact the appropriate Zoning Administration Jurisdiction in the course of this Appraisal Assignment and provide a narrative detailing the Investigating Research conducted together with a Discussion within the Appraisal Report regarding the Zoning possibilities, land use plan and overlay districts as it relates to the Highest & Best Use of the Subject Property. This discussion is considered as part of the Legal Permissibility component in the Highest and Best Use, As Vacant, analysis and conclusion.

Expected details include the steps required to accomplish the change in Zoning, specifics about the Zoning to which the Subject Property will be changed, and likelihood of achieving the change in Zoning. Additional information is found in UASFLA 2.3.2.3.8. Zoning and Other Land Use Regulations.

5. Confirmation (Personal Verification) of Comparable Sales with knowledgeable parties involved in the transaction is expected as per UASFLA. The “Buyer” is often considered the most informative party in a real property transaction including what intended use the Buyer expects to apply to the land purchased.

6. AVSO is the Appraiser’s sole Client. The appraiser may not communicate assignment results to any party except AVSO until authorized to do so in writing by AVSO.

7. Any communication (verbal or written) with the Client Agency (BLM Realty Specialist) and/or Interested Party shall include the assigned AVSO Review Appraiser.

8. Even though communication is encouraged with the Client Agency (BLM Realty Specialist), only the assigned DOI Contracting Officer, in conjunction with the AVSO Review Appraiser’s concurrence, can modify the Appraisal Instructions. Any contract modifications must be in writing.

9. If the Appraiser encounters any obstacles that are outside of and beyond the normal appraisal process and requires rectifying in order to move forward, the AVSO Review Appraiser is to be contacted immediately by the Contract Appraiser.

General Appraisal Requirements and Instructions:

1. The appraiser must have training and experience in appraising property similar to the subject property involved in this appraisal assignment pursuant to UASFLA.

2. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located. Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.

3. Compliance with UASFLA is required for this appraisal assignment. The appraiser must have completed a UASFLA training course and passed the exam if one was part of the class. UASFLA states that a report prepared in accordance with UASFLA Sections 2.3, 2.4, and 2.5 is consistent with and/or exceeds the requirements for an appraisal report under Standard 2 of USPAP.

4. The AVSO SOW and other assignment instructions must be included within the Addenda of the appraisal. Reference to these documents should be provided in the body of the report.

5. The appraiser must appraise the subject property in its “as-is” condition unless authorized in writing by the AVSO review appraiser to do otherwise.

6. Market value cannot be based on speculative or unsupported HBU conclusions. The appraiser must show that a proposed use is reasonably probable. If several uses appear financially feasible, each must be evaluated for supply, demand, and market participant purchasing power to identify the single most productive use. Broad or vague HBU conclusions should be refined into specific, realistic uses that provide the highest return. The appraiser should apply the appropriate level of market analysis, as outlined in The Appraisal of Real Estate, 15th Edition, and follow USPAP’s Scope of Work Rule for proper support.

7. The appraiser’s conclusion of HBU must be an economic use. Uses based on preservation, conservation or open space, among other priorities, typically lack the competitive supply and demand necessary to indicate an open market and therefore cannot be considered in determining market value for federal acquisitions (UASFLA, p. 106 Section 4.3.2.3).

8. The appraisal report must include a market analysis that reflects conditions as of the effective date of value. This section should support the HBU conclusion and any other market condition adjustments or explain why no adjustment is needed. It should describe current market conditions and supply-and-demand factors for the subject’s property type in its market area. Market analysis is essential because

Document Title WPCCRDA Land Sale Round 3 Parcels A & C - White Pine County, Nevada it informs other parts of the valuation, including the HBU. Depending on the assignment, the section may include interviews with market participants, economic trend data, listing and sales activity, commodity pricing, and financial market changes.

9. The use of sales to the government or an environmental or other public interest organization requires strict adherence to the extraordinary verification process noted in UASFLA 1.5.2.4 and summarized in Appendix E. The appraisal report must include adequate discussion relating to each of the steps in the extraordinary verification process.

10. Quantitative adjustments are preferred, but they must be supported with real market data.

Unsupported quantitative adjustments are not acceptable. Qualitative adjustments should be used only when the market does not provide enough data to measure the difference. When using qualitative analysis, the appraiser must clearly explain the reasoning for each element of comparison. All adjustments must be supported by credible, well-documented market data. The appraiser cannot rely on vague “trends” or subjective opinions without market evidence. Market support may include discussions with buyers, sellers, brokers, attorneys, etc.

11. Comparable sale sheets, rental sheets, rates of return, and any other market data used in the appraisal must be adequately researched and documented. Comparable sale write-ups should describe all important physical, legal, and economic details, such as buyer and seller, financing, and verification with a party of the transaction. All required information per UASFLA 2.3.3.2.1 must be included for each sale. Please refer to the AVSO Review Checklist included as an exhibit of this SOW.

12. The appraisal report must include photos of the subject property. The appraiser must personally view and photograph all comparable properties (unless the AVSO review appraiser has approved other conditions in writing) and include photos, parcel maps, topographic maps, and aerial maps in the report. Any unusual features must also be photographed.

13. The appraisal report will be reviewed for compliance with the terms of this SOW (including all cited standards). Any findings of inadequacy will require clarification and/or correction.

14. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO review appraiser.

15. AVSO will not normally accept custody of confidential information. Should the appraiser find it necessary to rely on confidential information, he/she will contact the AVSO review appraiser for instructions. The review appraiser will view the information and provide further instruction to the appraiser regarding handling and storage of the confidential information.

16. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.

17. If including any proprietary information in the appraisal, the appraiser must concurrence from AVSO review appraiser and deliver the proprietary information in a separate binder.

18. If the appraiser has performed any services regarding the subject property within the past three years, he/she must disclose this information prior to the contract award, and in the quote.

By definition, a Fee Simple Estate is the absolute ownership of realty unencumbered by any other interest, subject only to the limitations imposed by governmental powers;

however, the bundle of rights theory associated with real estate ownership recognizes that something less than the fee estate may be sold.

The Appraiser must immediately notify the AVSO Review Appraiser of any indications of rights contrary to the rights described in this SOW, as any significant differences may result in amended instructions or constitute a new appraisal assignment.

Outstanding Rights:

See Exhibit 9 in zip file. Sale Parcels will be sold “Subject To” existing encumbrances and ownership of all existing encumbrances owned by the United States will be transferred to Sale Parcel Buyers, except for ROWs that are being converted to Perpetual Right of Ways

If the Appraiser discovers any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances during the appraisal process that were not presented in this SOW, then the Appraiser must immediately report such findings to the AVSO Review Appraiser.
