About this file

This is a Standard Form 30 Amendment of Solicitation/Modification of Contract issued by the Interior Business Center, Acquisition Services Directorate on April 27, 2026. The amendment extends the solicitation closing date to 5:00 PM Eastern Time on April 28, 2026, for solicitation number 140D0426Q0360. The document provides a question and answer section addressing valuation methodology for two noncontiguous parcels in a proposed federal partial acquisition related to a conservation easement in Wicomico County, Maryland. The answer clarifies that the appraiser must identify larger parcel(s) based on unity of title, unity of highest and best use (integrated use), and contiguity/proximity, and must investigate potential unity of ownership across adjacent and nearby properties that may be under the same ownership as the tracts to be encumbered.

The amendment also adds FAR clause 52.222-90, Addressing DEI Discrimination by Federal Contractors (Deviation Date: April 2026), which prohibits contractors and subcontractors from engaging in racially discriminatory diversity, equity, and inclusion activities defined as disparate treatment based on race or ethnicity in recruitment, employment, contracting, program participation, or resource allocation. Contractors must comply with information requests from the Contracting Officer, report known or reasonably knowable subcontractor violations, and include this clause in all subcontracts at any tier, except where performance is outside the United States. Noncompliance may result in contract cancellation, termination, suspension, or declaration of ineligibility for future Government contracts.

Questions and Answers:

Question:

Should the two noncontiguous parcels be valued separately or a as a single economic unit?

Answer:

As this request is for a proposed federal partial acquisition, the appraiser must identify the larger parcel, or larger parcels (should multiple larger parcels be determined), which satisfies the tests of unity of title, unity of highest and best use (integrated use), and contiguity/proximity as it relates to the highest and best use. UASFLA requires that the factual basis and appraiser’s analysis that led to the larger parcel determination and the determination itself be reported. The appraiser must conduct all research necessary for a well-supported larger parcel(s) conclusion presented in the appraisal. This is considered an integral part of the highest and best use analysis.

(UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3)

As noted previously, the proposed CE encumbers two non-contiguous tracts. Per Wicomico County, MD GIS data, it appears that additional properties (both adjacent and nearby) are potentially under the same ownership as the tracts which are to be encumbered. Unity of ownership is one of the factors influencing the larger parcel determination. This is potentially critical in the determination of the larger parcel(s), both before and after establishment of the proposed conservation easement.

Ultimately it is the Appraiser’s responsibility to identify any and all additional lands contiguous or proximate to the subject property having unity of ownership/title in conjunction with unity of highest and best use/integrated use for the purposes of determining the larger parcel(s).

The following clauses is added to the solicitation:

Revolutionary FAR Overhaul 52.222-90 Addressing DEI Discrimination by Federal Contractors (Deviation Date: Apr 2026)

(a) Definitions. As used in this clause— Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations;

or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.
