About this file

This is a Questions and Answers document for federal solicitation 140D0426Q0201, addressing inquiries regarding the lease and valuation of a marina property with deferred maintenance issues.

The document clarifies eight key questions concerning property documentation, dredging requirements, lease information, maintenance cost estimates, and property use restrictions. Dredging estimates for dock areas and channel clearance to navigable water depths in Piscataway Creek and near the Potomac River will be provided by the prospective lessee to the contract appraiser, though the appraiser is advised against blind reliance and should independently verify this information through market data and conversations with dredging companies. A copy of the existing lease (currently on a 60-day recurring basis following the original lease's November 11, 2019 expiration) will be provided. The government confirms that deferred maintenance itemization and repair cost estimates compiled by the prospective lessee will guide the appraiser, but the appraiser must independently report maintenance issues based on physical inspection and investigation. The property has been marginally operational in recent years, with the restaurant and boat repair shop vacant for over two years and boat slips underutilized due to water depth inaccessibility; income and expense data for the past three to five years should be requested from the current lessee. Property use is restricted to historical operations including public boat launch, restrooms, boat slips/docks, restaurant, marina service building, fuel services, and parking, with no redevelopment to alternative uses such as residential subdivisions authorized. Renovations are expected to address only deferred maintenance items, with no additional improvements anticipated.

Solicitation – 140D0426Q0201

Question No.

Question Government Response

Context for questions 1&2: A question regarding the documentation of the level of deferred maintenance.

Lease Attachment D

E. Dredging (If the Premises will be used as a marina, the below listed items are needed but not required).

I understand watercraft access to the marina may have (or had) some hindrance (potentially only low tide).

I note there is no dredge volume estimate for a channel clearance from the marina to navigable water depth in Piscataway Creek and/or near the Potomac River.

Has this potential hindrance been documented and quantified?

Will the AVSO reviewer be able to resolve this issue through an expanded hypothetical condition?

Will copies of the old lease be provided?

Will an estimate of the cost of the deferred maintenance items be provided?

Will an estimate/quote of the costs to repair in the as renovated condition be provided?

Will income and expense data for the last 3 to 5 years of Marina operations be provided?

Is there any scenario where the property can be redeveloped to another use (ex. Residential subdivision) while maintaining a public boat launch and bathrooms as stipulated in the property use section of the SOW?

Do renovations in the as renovated condition include more than just curing the deferred maintenance?

Responses

1. Dredging estimates (including identification of individual dock areas, itemization of volume of material in CY, and costs) is included in the itemization and estimated costs of deferred maintenance compiled by the prospective lessee. This information will be provided to the contract appraiser. While this information may serve as a guide for the contract appraiser, reliance on the data will be at the appraiser’s discretion. Investigation (likely through conversations with the prospective lessee) and verification of the information is critical and should be corroborated with additional market data (i.e. cost comparables, conversations with dredging companies, etc.) when possible. Blind reliance on the information provided by the prospective lessee is not advised. It is unknown if additional dredging (other than dredging noted in the prospective lessee information) is needed (i.e. channel clearance from the marina to navigable water depths of Piscataway Creek and/or near the Potomac River). This should be investigated by the contract appraiser. Additional costs, if applicable, related to additional dredging should be considered in the valuation.

2. While hypothetical condition related to the noted hindrance is not currently approved, there is potential for consideration of a hypothetical condition based on information (currently unknown) discovered by the contract appraiser.

3. Yes – a copy of the old/current lease will be provided. The property is currently leased (has been leased) on a 60-day recurring basis, following expiration of the original lease on November 11, 2019.

4. Itemization and estimated costs of deferred maintenance were compiled by the prospective lessee.

This information will be provided to the contract appraiser. These may serve as a guide for the contract appraiser, but sole reliance on the deferred maintenance items and associated repair costs (reported) is not advised. The appraiser must report issues of deferred maintenance based on, for example, what is observed during the physical property inspection and/or other information gleaned as part of the investigation and analysis of the subject property.

5. See answer to No. 4 above.

6. The property has been marginally/partially operational in recent years. The restaurant and boat repair shop are currently vacant (and purportedly have been for 2+ years) and the boat slips are notably less than fully occupied (due to inaccessibility resulting from lack of water depth as a result of the need for dredging.). The actual wet slip occupancy rate is unknown. The only other known operations are related to boat storage. A request for income and expense data (including actual rents paid) for the last 3 to 5 years should be made to the current lessee.

7. The property may only be used in a manner consistent with historical operations to include public boat launch and restrooms, boat slips/docks, restaurant, marina service building (including office space, restrooms/showers, and laundry facilities), fuel services, and parking. These have been identified as authorized uses. The premises may also be used for marine-related purposes generally consistent with the property’s history. These are detailed in RFP# L-NACE-001-2025 (pages 4-5) which is included as an attachment to the SOW. No additional authorized uses (i.e. redevelopment to another use such as residential subdivision even if public boat launch and bathrooms are retained) are anticipated.

8. Renovations - other than curing of the deferred maintenance – are neither known to exist, nor anticipated.
