About this file

This document is an Amendment Attachment with Questions and Answers for Solicitation 140D0425Q0583, addressing a land appraisal for the Havasu Riviera Marina property. The document contains three key questions from potential bidders and the government's corresponding responses, focusing on critical appraisal details: (1) whether riparian or littoral rights should be excluded from the land valuation, (2) how to handle the offshore breakwater's valuation, and (3) inspection requirements for comparable properties. The government clarified that the land should be evaluated as vacant and available for its highest use, the breakwater should be excluded along with other marina improvements, and while on-site inspections are generally required, AVSO will consider a modified inspection scope on a case-by-case basis, subject to written approval from the Review Appraiser.

Amendment Attachment 001 Questions and Answers

Solicitation – 140D0425Q0583

Question No. Question Government Response

1 Riparian or Littoral Rights Given that the assignment calls for a land-only valuation, should riparian or littoral rights associated with the shoreline be excluded from consideration?

No, the land should be evaluated as though vacant, and available for its Highest Use.

2 Breakwater Valuation We note from the aerial imagery that a breakwater—a substantial structure located offshore—serves as a critical element of the marina’s functionality and safety.

• As this breakwater is physically separate from the land and situated in the water, should it be excluded entirely from the valuation?

• Alternatively, since the highest and best use (HBU) of the land under a marina scenario would arguably require the breakwater, should its presence and contributory value be reflected in any way, even under the hypothetical condition of a land-only appraisal?

The breakwater was constructed as part of the Marina construction and should be excluded along with all of the other improvements made by the Concessionaire.

3 Inspection Requirement The Statement of Work (p. 11, bullet 12) states that “the appraiser must personally view and provide color photographs and maps of comparable properties in the appraisal report.”

Several of the most relevant comparable sales for this waterfront land may be hundreds of miles apart. Under the Uniform Appraisal Standards for Federal Land

Acquisitions (UASFLA), the client may allow a modified scope when “a physical on-the-ground inspection may be impossible or not useful” and accept aerial or other remote inspections instead (§1.2.6.3) .

Therefore, for this assignment, is an on-site inspection of every comparable sale mandatory, or would AVSO consider an alternative scope of work—such as remote inspection aided by high-resolution aerial/street imagery, broker-supplied photos, and direct interviews with parties to the transactions—provided that:

• the alternative verification procedures are fully documented in the report.

• appropriate extraordinary assumptions are disclosed; and

• the appraiser still performs field inspections of the subject property and any local, key comparable?

If a modified scope is acceptable, please advise on any minimum documentation standards (e.g., photo resolution, map types) or limits on the number of comps that may be inspected remotely.

AVSO will consider a modified scope for the inspection of sales on a case-by-case basis.

HOWEVER, this would have to be approved by the Review Appraiser in writing during the course of the assignment. At this stage, the case should be bid based on the provided Statement of Work.
