Questions and Answers:

Question:

From my reading, Scenario 2 assumes ownership by The Conservation Fund (TCF), a conservation buyer or easement holder, even though they do not currently own the property. This results from the Hypothetical Condition requested in the Statement of Work. As such, I don't believe this scenario would comply with Yellow Book standards for compensation purposes, as it alters market participants, motivations, and potentially the highest and best use—each of which is central to a compliant opinion of market value. Such will need to be labeled as non-compliant with Yellowbook in the report. That said, I understand it may be requested for internal planning or acquisition strategy.

For clarification:

1. Does the Hypothetical Condition also assume that a conservation easement is in place?

Answer: No. There is no existing nor future consideration of any conservation easement associated with this appraisal assignment. The Hypothetical Condition, which has been approved by the United States Department of the Interior Solicitor’s Office, pertains to a dual premise scenario regarding ownership on the effective date of value. The appraiser is to provide an as is market value (under current ownership) and an as is market value, as if owned (hypothetical condition) by the Conservation Fund (TCF), both being the same effective date of value. This dual premise is being instructed based on the United States Department of the Interior Solicitor’s Office Legal Instruction and in compliance with UASFLA, Section 1.2.7.1).

2. If so, will a copy of the easement—reflecting TCF’s terms, restrictions, extinguishment rights, etc.—be made available for review?

Answer: There is no conservation easement. A copy of the access agreement providing legal and physical access onto the site is via a 20’ easement across a neighboring parcel to the east will be provided upon award.

3. Is Scenario 2 intended solely for internal use, or will it factor into acquisition or compensation decisions?

Answer: The appraisal report will be used to assist the bureau in its determination of the amount to be paid as just compensation for the property rights acquired. The appraisal report is not intended for any other use.

4. Should Scenario 2 be included as a separate, supplemental section in the report? Or rather, does AVSO require some form of integrated comparison and reconciliation between both scenarios?

Answer: It is the appraiser’s choice as to how Scenario 2 will be presented (within the same report, supplemental section or separate report. Scenario 2 must clearly disclose its own larger parcel analysis, highest and best use and valuation. This will also be discussed between the appraiser and review appraiser during the pre-work meeting. The appraisal must clearly summarize the differences in the property rights appraised, if any, between the various scenarios (i.e., as is vs hypothetical).
