About this file

This document is a Limited-Sources Justification (LSJ) for a federal contract opportunity under the General Services Administration (GSA) Federal Supply Schedule (FSS) program.

The LSJ describes a new requirement for Environmental Services at Eglin Air Force Base, Hurlburt Field, and Tyndall Air Force Base. The incumbent contractor is Oneida Total Integrated Enterprises, LLC (OTIE), who was previously awarded a GSA FSS order (GS00F0006I/47QFWA19F0029) through competitive procedures. The new requirement is considered a logical follow-on to the incumbent's work, and OTIE's demonstrated expertise and positive performance was a key factor in the LSJ. The contracting officer determined that the anticipated pricing will be fair and reasonable based on OTIE's knowledge of the work and previous pricing. No further market research was conducted, as the original competition was within the 18-month timeframe. The total contract value is not specified. This LSJ was issued due to a protest on a competitively awarded acquisition under the GSA FSS program.

Pursuant to FAR 8.404(d) Pricing, “GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d).” In accordance with FAR 8.405-2(d) Evaluation, the Contracting Officer will consider the level of effort and the mix of labor to perform a specific task being ordered and for determining the total price reasonable.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market Research was conducted as part of the original award, noting that this is a commercial requirement, with many vendors showing the capability to perform this work via a FSS, resulting in this requirement being competitively awarded on GSA Multiple Award Schedule (MAS) 562910REM – Environmental Remediation Services. In accordance with FAR 10.002(b)(1) Procedures, the market research conducted at the time of developing the original requirements still applies as it falls within in the 18-month time frame.
