SECTION 1 – Subject Identification & General Information
Identification Case Name Patoka River NWR Tract F230096
Location Pike County, IN Acreage 1,688.41 ± acres (proposed acquisition) 1,709.40 ± acres (whole ownership) Property Type Non-Federal Vacant Land Case Type Acquisition
Appraiser’s Client U.S. Department of Interior, Appraisal and Valuation Services Office (AVSO)

Wildlife Service (FWS) on behalf of the United States of America
Intended Use The appraisal report will be used by the FWS in conjunction with negotiating the proposed acquisition of the identified property via a land purchase. It is not intended for any other use.
Property Description The whole property ownership is 1,709.40 ± acres. The property to be appraised is comprised of three vacant tracts reported to consist of 1,688.41 ± acres. The approximately 21 acres to be retained by the current landowner are located in Section 5, T 2S, R 7W and generally described as north of the south right-of-way line of the railroad and west of County Road 350 E. The following property descriptions will pertain to the subject property only.
The subject property is located in southwestern Indiana in Pike County. The town of Winslow lies adjacent to the subject property to the northwest. The county seat, Petersburg, is approximately 9 driving miles northwest of the subject property.
Recent and historical use of the property has been for farming, recreational hunting, and timber harvest. FWS estimates that the property is comprised of approximately 572 wetland acres, 991 forested acres (upland & bottomland) and 137 acres of cropland, in aggregate. Per FWS, harvesting of timber has previously occurred, as recently as the past few years on portions, but it is believed that merchantable timber remains. Water features on the property include oxbows and a channel of the Patoka River. Portions of the property were mined and reclaimed. No mining activity has occurred since the 1970s. The mineral estate is intact and there are no outstanding mineral leases or reservations.
The subject property, along with 21 ± acres of additional lands, was purchased by the current landowner on January 09, 2023, via Special Corporate Warranty Deed. A copy of this deed will be provided to the contracted Appraiser upon Award. (***Answer to Q2)
The property has not been appraised by FWS or AVSO in the past 5 years. The property is not currently listed for sale.
Aerial Map
Timber: FWS reports that the property is presumed to contain merchantable timber. However, no additional information regarding potential merchantable timber was provided by FWS or the Property Owner. A timber cruise (by a qualified forester approved by the AVSO Review Appraiser) which complies with AVSO timber cruise specifications may be needed as part of this appraisal assignment. NOTE: Should merchantable timber be discovered, and the Appraiser determines that a timber cruise is necessary, he/she must immediately notify the AVSO Review Appraiser so that arrangements can be made for procurement/completion of a timber cruise. If a timber cruise is needed, the contract award may need to be adjusted to accommodate the procurement of the timber cruise and the period of performance may need to be adjusted to accommodate completion of the cruise and appraisal assignment (Please refer to the Appraiser’s Use of Consultant’s Reports section of this SOW for additional instructions). (***Answer to Q3)
Minerals:
Per AVSO Division of Minerals Evaluation (DME), there is no evidence to support the existence of mineral resources with development potential on the subject property. The Due Diligence Mineral Evaluation will be provided to the Appraiser awarded the contract.
Legal Description NOTE: The Legal Description and acreage have been provided by the FWS Regional Land Surveyor and are reported as adequate for Appraisal Purposes Only. If negotiations are successful a survey of the tract will be completed by FWS prior to acquisition. A copy of the FWS preliminary Land Survey Assessment will be provided to the contracted appraiser upon award. The full legal description must be made a part of the appraisal report. It should be included in the body of the report. Please refer to item #4 of the Special Appraisal Instructions section of this SOW for additional value instructions. Any significant outstanding rights or reservations discovered by the Appraiser must be discussed in the appraisal report in relation to their impact on value.
Personal Property None.
Property Access Numerous public roads provide access to all three areas of the subject property. The public roads providing access to the subject property include:
County Road 200 South, Cato/Winslow Road, County Road 300 South, County Road 350 East, County Road 650 East, County Road 350 South, and County Road 400 South.
Larger Parcel The agency request indicates that the total ownership acres are 1,709.4 acres of land and the acres to be appraised is 1,688.41 ± acres of land.
It is ultimately the Appraiser’s responsibility to identify any and all additional lands that may have an impact on the Larger Parcel analysis.
The Appraiser must conduct all research necessary for a well-supported Larger Parcel(s) conclusion presented in the appraisal. As the Appraiser, you must identify a larger parcel (or potentially multiple larger parcels) which satisfies the tests of unity of title/ownership, unity of highest and best use/integrated use, and contiguity/proximity as it relates to highest and best use in accordance UASFLA, Sections 1.2.7.3.1., 1.4.3 – 1.4.7., 4.3.3 –
4.3.4.5. and 4.6.1.1. This is considered an integral part of the highest and best use analysis. Section 2.3.3.1.2 of UASFLA requires that the Appraiser must describe the factual basis and analysis that led to the larger parcel determination and the determination itself be reported. The Appraiser should also keep in mind that in situations where there are multiple larger parcels present, the appraisal assignment is to estimate the market value of the property in its entirety. This may require estimating the value of each larger parcel, but simply adding those values together to estimate the value of the whole would violate the Unit Rule.
The appraiser should be aware that there is the potential for the subject property to consist of multiple larger parcels. It is requested that the Appraiser please notify the AVSO Review Appraiser, after property inspection, to discuss the Appraiser’s preliminary larger parcel determination(s) and support. If multiple larger parcels are concluded, each larger parcel identified will require a separate valuation analysis. It will be the engaged Appraiser’s decision as to the presentation within a single report or multiple reports.
Appraiser’s Use of Consultation Reports
FWS reports that the subject is presumed to contain merchantable timber of contributory value. Please notify the AVSO Review Appraiser if you determine a timber cruise is necessary to achieve credible assignment results.
Note: this notification generally occurs subsequent to inspecting the subject property and often after completing preliminary highest and best use analysis and identifying potential comparable sales.
Please note that justification supporting your determination that a timber cruise is necessary to achieve credible assignment results must be provided to the AVSO Review Appraiser. Assuming adequate support exists, the AVSO Review Appraiser will contact FWS to coordinate for a timber cruise to be completed. This may result in the contract award with the Appraiser needing to be adjusted to accommodate the procurement of the timber cruise and the period of performance may need to be adjusted to accommodate completion of the cruise and appraisal assignment.
Should a timber cruise be necessary, please note that Section 1.13 of UASFLA states “the appraiser cannot merely accept such consultant reports as accurate, but rather must analyze such reports and adopt them only if reasonable and adequately documented and supported. The results of secondary valuation reports (minerals, fixtures, or timber valuations) cannot simply be added to the value of the land to arrive at a value of the property as a whole. To do so would violate the unit rule and professional standars. The appraiser must consider these components of the property in light of how they contribute to the market value of the property as a whole.
Ownership/Occupant Information will be provided to the contracted Appraiser upon Award.
Tenancies Approximately 141.5 acres are currently under an Agricultural Lease (Crops)
Cash Rent agreement through December 23,2023. A copy of the lease will be provided to the contracted Appraiser upon Award. The Appraiser should confirm with landowner whether, there are any other leases and/or rental agreements on the property.
Contact Information All necessary contact information will be provided to the Appraiser upon contract award.

SECTION 2 – Appraisal Requirements & Instructions
Appraisal Standards
1. Uniform Standards of Professional Appraisal Practice Standards 1 & 2 (USPAP-2020/2021 edition)
2. Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA 6th edition, 2016)
3. Uniform Relocation Assistance and Real Property Acquisition Act of 1970 (PL91 – 646) as amended; Federal Regulations 49 CFR, Part 24
Market Value
Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition (Interagency Land Acquisition Conference, 2016), p.10.]
Date of Value
The date of value is the date of the last property inspection, which should be within 30 calendar days of the submission of the initial appraisal report, unless the AVSO Review Appraiser approves in advance other conditions in writing.
Extraordinary Assumption (EA)
EA – Property Rights Appraised: A current title commitment was not provided for this assignment.
An older title commitment issued January 13, 2023 when the current owner acquired the property was received but it is uncertain if the information encompasses all the outstanding rights or reservations currently found on the subject property. The AVSO Client, Fish and Wildlife Service (FWS), has requested that I assume there is clear title to the property being appraised and that there are no additional encumbrances or restrictions (including mineral or other reservations) that could materially affect value. Use of this statement is consistent with FWS policy. A change in the estate appraised, when final title is obtained, could require an amendment of the appraisal or re-appraisal of the property so that the estate appraised matches the estate to be transferred.
Note: The Owner’s Policy of Title Insurance obtained when the current landowner purchased the property will be provided to the Appraiser awarded the contract. This document is being provide as a reference tool only and the above EA still applies as this policy would not reflect any changes to title from the date of policy to the effective date of appraisal.
The Appraiser may not assume or invoke any EA’s without documented prior written approval. If the Appraiser determines that any additional EA’s are necessary for the completion of the assignment, he/she must contact the Review Appraiser for prior written approval (UASFLA, Section 1.2.7.1.).
Hypothetical Conditions (HC’s)
No HC’s have been identified which are necessary for the completion of this assignment. The Appraiser may not assume or invoke any HC’s without documented prior written approval. If the Appraiser determines that hypothetical conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval (UASFLA, Section 1.2.7.1.).
Jurisdictional Exceptions (JE’s)
The only JE that is authorized for use is in regard to the definition of market value and the development and reporting of a reasonable exposure time linked to the value opinion. Contrary to USPAP, Section 1.2.4. (and 1.2.7.2.) of the Uniform Appraisal Standards for Federal Land Acquisition states that opinions of market value linked to a specific exposure time and marketing time “… are not appropriate for just compensation purposes, and must not be included in appraisal reports prepared under these Standards.” Because the Appraiser is performing the appraisal in compliance with UASFLA, the Jurisdictional Exception Rule is being invoked. Sections 1.2.4 and
1.2.7.2 of UASFLA provides the legal authority for invoking the Jurisdictional Exception Rule to void Standard Rules 1-2(c) and 2-2(a) (v) of USPAP.
If the Appraiser believes that USPAP’s Jurisdictional Exception Rule needs to be invoked to comply with any additional law or UASFLA regulation, he/she must contact the AVSO Review Appraiser to obtain prior written approval.
Placement in Report
The Appraiser must clearly identify and discuss the implications of any authorized Extraordinary Assumptions and Hypothetical Conditions (including a statement that their use might have affected the assignment results) within the General Assumptions and Limiting Conditions and Scope of Work sections of the appraisal report along with the Jurisdictional Exception (assignment condition) per UASFLA Sections 2.3.1.7 & 2.3.1.8. Please also identify any authorized EAs and HCs wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of the Salient Facts.
Property Inspection
The Appraiser must physically inspect the subject property and all of the market properties used in direct comparison, unless the AVSO Review Appraiser has approved other conditions in writing (UASFLA Section 1.2.6.3.).
For appraisals with an intended use of acquisition or exchange, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions (Section 1.2.6.4), require the Appraiser to offer the property owner and/or the owner’s representative an opportunity to accompany the Appraiser during the property inspection. The Appraiser must certify in the report that such an offer was extended (UASFLA Section 2.3.1.4.).
Permission to enter upon and appraise the property has been granted. The landowner’s contact information and the document granting permission to appraise will only be provided to the contracted Appraiser. Please contact the owner directly, after engagement, to arrange a date and time for inspection. You must notify the AVSO Review Appraiser in advance of when the property inspection will occur.
Pre-Work Meeting
The contracted Appraiser will be required to participate in a pre-work meeting (via phone) with the assigned AVSO Review Appraiser. The AVSO Review Appraiser will coordinate the date and time of the pre-work meeting directly with the Appraiser once the contract is awarded.
Controversies/Issues
No controversies/issues have been identified. Should the Appraiser identify controversies or issues during the course of assignment, he/she must immediately notify the AVSO Review Appraiser.
Legal Instructions None
Special Appraisal Instructions
1. Even though communication is encouraged with the Property Owner and the client agency, only the AQD Contracting Officer, in conjunction with the assigned AVSO Review Appraiser’s concurrence, can modify appraisal instructions (in writing).
2. The Appraiser may not communicate assignment results to any party except AVSO unless authorized to do so in writing by AVSO.
3. Any communication (verbal or written) with the Client Agency Realty Contact shall include the assigned AVSO Review Appraiser.
4. The area of acquisition is estimated to contain 1688.41 ± acres, with the actual acreage to be acquired dependent upon completion of a formal survey. Consequently, it is requested that in addition to stating the final conclusions(s) of the larger parcel(s) within the appraisal report, the unit value (e.g., $XX/acre) for the larger parcel(s) also be stated along with the range of acreage withing which that unit value(s) would be valid (e.g., $XX/acre is valid for a range of XX-XX acres). This is an assignment condition and to be reported as such within the appraisal report:
NOTE TO INTENDED USER: This range in acreage is only applicable to the footprint of the Appraised larger parcel(s) as a result of the completed survey and considers no material changes to the physical characteristics of the larger parcel(s). This tool is meant to assist the acquiring agency in rectifying the value of an appraised larger parcel after completion of survey. The range in acreage within which the concluded unit value(s) would be valid is not intended for use by the client to add additional lands/tracts to the proposed acquisition or to allow the retention/removal of lands/tracts from the proposed acquisition after the appraisal has been completed. Addition or removal of a tract(s) from the appraised larger parcel could change the physical characteristics of the property and require amendment of the appraisal or reappraisal.
General Appraisal Requirements & Instructions
1. The appraisal is to be documented in an “Appraisal” reporting format (USPAP Standard 2-2 (a)).
UASFLA page 56, Section 2.2 states that a report prepared in accordance with UASFLA reporting formats set forth under sections 2.3, 2.4 and 2.5 (Appendix B, C, and D) are consistent with and/or exceed the requirements for an appraisal report under Standard 2 of USPAP. All appraisals complying with UASFLA should reasonably conform to the report formatting outlined in UASFLA, (Sections 2.3., 2.4., 2.5., and Appendix A, B, C and D, depending on applicability).
2. The Appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located as demonstrated by provision of a copy of the state certificate. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)
3. Documentation of the comparable sales and other market data utilized in the appraisal must comply with reporting requirements of UASFLA Sections 2.3.1.6., 2.3.3.2.1., 2.3.3.4., and the Uniform Relocation Assistance & Real Property Acquisition Policies Act 1970. For instance, the latter requires “A description of the comparable sales, including a description of all relevant physical, legal and economic factors such as parties to the transaction, source and method of financing, and verification by a party involved in the transaction.” Color photographs and maps of comparable properties shall be included in the appraisal report. AVSO will accept aerial photographs for comparable properties, if the aerial photographs accurately represent the comparable property as of the date of sale. The Appraiser must photograph any unusual property features from the ground.
4. If sales to governmental entities, including sales to non-profit entities with the intention of transferring the sale property to a governmental entity, are included in the appraisal report, they are subject to extraordinary verification and treatment. They must be documented in accordance with the guidelines found in UASFLA Sections 1.5.2.4 and 4.4.2.4 and Appendix E. Each of the items of Section 1.5.2.4/Appendix E must be specifically addressed when communicating the confirmation of any government sales.
5. The AVSO Statement of Work, any other written assignment instructions and pages 1 & 2 of the
Contract Award document must be included within the Addenda to the appraisal report, along with the Appraiser’s license, to include temporary license, if applicable, and qualifications. The appraisal report will be reviewed for compliance with the terms of this Statement of Work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.
6. The Appraiser must appraise the subject property in its “As Is” condition unless otherwise instructed herein or authorized in writing by the AVSO Review Appraiser to do otherwise.
7. The Appraiser shall consider the appraisal report and all DOI internal documents furnished to the Appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO Review Appraiser.
8. AVSO will not normally accept custody of confidential information. Should Appraiser find it necessary to rely on confidential information, he/she will contact the AVSO Review Appraiser for instructions. The AVSO Review Appraiser will view the information and provide further instruction to the Appraiser regarding handling and storage of the confidential information.
9. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.
10. If including any proprietary information in the appraisal, Appraiser must gain concurrence from
AVSO Review Appraiser and deliver the proprietary information in a separate binder.
11. The Appraiser must indicate whether he/she has (or has not) performed any services, as an Appraiser or in any other capacity, regarding the subject property within the three-year period immediately preceding submitting the bid for the assignment. If a service has been provided regarding the subject property, the service provided must be specified and appropriately disclosed following the direction of the USPAP Ethics Rule, Conduct Section. This disclosure must be made within the bid proposal and also noted on the signed certification page of the completed report.
