RFID Inventory Management Systems for use on Medical Equipment, are a specialty items with the RFID community. The quantity of vendors who can provide RFID tags for Medical and non-Medical items is very limited. Some vendors provide tags for medical only and other vendors provide tags for non-medical only. The Vendor Selected is the only one that we could find that provided tags for Medical and Non-Medical items on the same inventory management system.

6. Market Research.

HHSAR 326.602-2 states “this subpart applies to all acquisitions above the micro-purchase threshold, including simplified acquisitions, made by IHS, and any HHS operating divisions or agency outside of IHS conducting acquisitions on behalf of IHS.”

In consideration that AQD is conducting this acquisition on behalf of an organization within IHS the Buy Indian Act applies

Search Results from the Tableau database using the NAICS code 334118, 58 Indian Owned Small businesses were identified.

Sources Sought Notice was posted on SAM.gov on May 12, with Indian Economic Enterprise (IEE) responses due May 23, 2023. The Sources Sought Notice specifically requested firms with Medical and Non-Medical RFID Inventory Systems that are also IEEs.

No responses from any IEE were received, three responses were received. As a special note, none of the companies who responded showed documentation of an RFID system for Medical and Non-Medical as required in the Notice.

Sources Sought Notice was posted on SAM.gov on June 23, 2023 for Small Businesses responses due June 30, 2023. The Notice included the same language requesting firms with Medical and Non-Medical RFID Inventory Systems. Two responses were received, however, the two contractors would be teaming for this requirement and they recommended a different RFID system than the one the Client submitted with their documentation. The documentation did not state if this system could accommodate Medical and Non-Medical items.

Based on the lack of IEE responses, a Buy Indian Act Waiver will be processed.

Subsequently, this acquisition will be Sole Source to the Vendor identified by the SME from

NNMC.
