Notice of Intent to Sole Source Department of the Interior, Bureau of Land Management Klamath Falls Resource Area Septic Tank Cleaning Services

Proposed Action:

The Government intends to award a sole source, firm-fixed-price (FFP) acquisition with Modoc Services, Inc. for Klamath Falls Resource Area Septic Tank Cleaning Services. This non-competitive action is being issued by the Department of the Interior (DOI), Interior Business Center (IBC), Acquisition Services Directorate (AQD), on behalf of the Bureau of Land Management (BLM).

Place of Performance:

The toilets and tanks to service are located at various campgrounds and recreation sites throughout the Northwest Oregon District of the Bureau of Land Management.

Description of Requirement:

The intent of this contract is to clean and pump vault toilet and holding tanks at each individual recreation site, then remove and dispose of all effluent in an acceptable manner at a licensed disposal facility in accordance with all state and federal rules, regulations, laws and specifications of this acquisition.

The contractor will provide all labor, supplies, supervision, materials, equipment, and transportation necessary to provide cleaning and pumping of vault type toilets and holding tanks (host tanks, step tanks/wet wells). Then remove and dispose of all effluent in an acceptable manner in state permitted disposal areas in accordance with all state and federal rules, regulations, laws and specifications of this contract.

a. Work Locations are described in the schedule and Vault Toilets (VT) and tanks to be pumped are on attached project location maps.

b. The Contractor is responsible for all work completed including sub-contractors; all sub-contractors must meet the same requirements outlined in the contract as the primary Contractor.

c. The Contractor shall be properly licensed and is responsible for obtaining all necessary permits and licenses for pumping, hauling and disposing of the effluent.

d. The Contractor shall be responsible for making disposal arrangements, including disposal of all sewage, debris, and trash, and payments of all fees.

e. Contractor shall pump all wet effluent from toilet vaults. Vaults must be pumped dry, with less than one inch of effluent remaining in the vault for each pumping.

f. Vaults may contain trash such as beverage containers, plastic bags, etc. Removal of these items is a requirement of the contract. Contractor must have capability to remove garbage/trash deposited in vaults. Contractor shall be responsible for the removal, transport and proper disposal of trash and refuse found within the vault.

g. The Contractor shall be responsible for preventing spillage during pumping and hauling of all waste material. Handling of all waste material shall be in accordance with all applicable health regulations.

h. The Contractor shall utilize biobased products and materials to the maximum extent possible, in accordance with Section Special Contracting Requirements 6.0, Green Procurement.

i. Upon completion of pumping the vault, contractor shall clean up any spill or contamination of the interior walls or floors of the toilet room and any spillage on the surrounding soil. Any contamination in the toilet room will require a thorough cleaning with a disinfecting solution approved by the Contracting Officer to include walls, floors, ceiling, and fixtures at the Contractor’s expense.

j. Immediately upon completion of pumping the vault, the Contractor will be required by the project inspector to charge the vault with not less than 75 gallons of clean water and no more than 100 gallons of clean water.

k. Sewage removed from BLM vaults must be disposed of in a licensed and/or permitted sewage disposal facility. Proof of proper disposal is required. For each haul, the contractor shall provide the Government’s representative with a mobile waste hauler manifest from a licensed disposal facility documenting proper disposal and gallons pumped from vaults.

l. The disposal, transportation, and use of chemicals shall conform to all Federal, State, and local laws and ordinances.

Response Information:

This action is being processed in accordance with FAR 6.302-5(b)(6). Interested parties may identify their interest and capabilities regarding this requirement by submitting a capabilities statement by the date specified herein.

A period of performance of one 12-month base year and four 12-month option years is anticipated for this effort. The Government will consider all capabilities statements received by 5:00 P.M. EST, Tuesday, April 20, 2021. Please be advised that it is the offeror’s responsibility to ensure the Government receives your submission on or before the specified due date. Submissions shall be sent electronically to Jacqueline Hernandez, Contracting Officer at jacqueine_hernandez@ibc.doi.gov and Norman Bissett, Contract Specialist at norman_bissett@ibc.doi.gov. Submissions shall not exceed ten (10) pages. Paper copies will not be accepted. Late responses will only be accepted if they contain extraordinary value to the Government. Submissions should be in a Microsoft Office compatible format (i.e., Microsoft Word, PowerPoint, Excel, etc.) or Adobe Acrobat and not contain text smaller than 11-point font. The maximum file size of the submission shall not exceed 8 MB. Tables, graphs, etc. will count against the total page count. Font size smaller than 11 may be used to label tables and graphs but may not be smaller than 8-point font. All data received in response to this Special Notice that are marked or designated as corporate or proprietary information will be fully protected from release outside the Evaluation Panel. Proprietary information and trade secrets, if any, must be clearly marked on all materials. All information received that is marked Proprietary will be handled accordingly. Please be advised that all submissions become Government property and will not be returned. All Government and contractor personnel reviewing responses will have signed non-disclosure agreements and understand their responsibility for proper use and protection from unauthorized disclosure of proprietary information as described in 41 USC 423. The Government shall not be held liable for any damages incurred if proprietary information is not properly identified. Responders are advised that the Government will not reimburse for any information or administrative costs incurred in response to this Special Notice; all costs associated with responding to this Special Notice will be solely at the interested parties' expense. This is NOT a request for competitive quotes. A determination by the Government not to compete this proposed action based upon responses to this announcement is solely within the discretion of the Government. Information received is solely for the purpose of determining whether to conduct a competitive acquisition. The Government reserves the right to issue a Request for Quote (RFQ) as a result of this announcement. Please be advised that this announcement may constitute the only notice that will be posted for this acquisition, based on the review of any responses to this notice. Marketing brochures and/or generic company literature will not be considered. Not addressing all the requested information may result in the Government determining the responder is not capable of performing the scope of work required.
