About this file
This document is a single source justification for a federal contract award to Hart Energy Mapping and Data Services. The Department of the Interior Bureau of Indian Affairs Central Office requires Hart Energy's energy and mineral GIS data subscription, maintenance, and support services from February 1, 2024 through January 31, 2025 with four optional one-year extension periods. The Office of Trust Services needs this data for the Division of Energy and Mineral Development and the National Indian Oil & Gas Energy and Mineral System to comply with federal laws governing Indian energy development and resource management. Hart Energy will provide subscription access, monthly updates, support, and 24/7 access to its DataLink system containing pipeline, transmission, and renewable infrastructure vector, raster, and table data for natural gas, crude oil, refined products, and other energy commodities. As no other vendor offers comprehensive coverage of these datasets and attributes in a single package at the required level of detail and resolution, this justification cites Hart Energy's exclusive licensing of the data as the basis for a single source award. The notice of intent to award sole source will be posted to SAM.gov.

VERSION 11/15/2022
SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE
SIMPLIFIED ACQUISITION THRESHOLD (SAT)
AUTHORITY: FAR 13.106-1(b)(1)
PR/SOL/CONTRACT # _40641279__________
CONTROL #_24-0072_____________________
1. Contracting Activity: This document is a justification for single source determination under
Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold (SAT) for the Department of the Interior, Bureau of Indian Affairs, Bureau of Indian Affairs (BIA), A16 Central Office
2. Description of supplies or services required to meet agency needs.
• Office of Trust Services (OTS) requires Hart Energy's energy and mineral GIS (Geographic Information Systems) data subscription, maintenance and support. Hart Energy data is needed by the Division of Energy and Mineral Development (DEMD) and the National Indian Oil & Gas Energy and Mineral System (NIOGEMS). The required general dataset groups include crude oil; natural gas; refined products; electricity transmission and renewable energy.
• Anticipated period of performance or delivery date. 2/1/2024 to 1/31/2025 plus four option years
3. Identification of the single source to be solicited.
Name of Proposed Contractor: HART ENERGY MAPPING AND DATA SERVICES Street Address: 1616 South S Voss Road, Suite 1000 City, State, Zip: Houston, Texas 77057-2641
4. Reason for authority cited. The contracting officer has determined the circumstances of the contract deem only one source reasonably available.
• Exclusive Licensing Agreement
5. Rationale: Provide an explanation that supports the reason cited in #4.
The government has a requirement to provide accurate, consistent, and uninterrupted data to continue to comply with the Indian Mineral Development Act of 1982 (Public Law 97-382, 25 USC 2106) and the Energy Policy Act of 2005, Title V – Indian Energy (Public Law 109-
58, 25 USC 3502).
The DEMD requires a justification of other than full and open competition, to purchase a renewal of subscription services for an energy geographic information services (GIS) database, which includes industry datasets for Renewable Energy, Crude Oil, Natural Gas, Refined Products, Liquid Products, in vector, raster and table format from Hart Energy.
Hart Energy will provide subscription, monthly updates, support, and 24-hour access to Hart Energy’s DataLink webpage for Natural Gas, Crude Oil, Refined Products, Other Liquids, CO2 pipelines, Electrical Transmission, and Renewable Energy Infrastructure GIS data to DEMD. It should be noted that a similar geospatial data subscription, updates, and support contract with Hart Energy for this same required data was originally purchased in FY2010 and maintained through FY2023.
These Hart Energy geospatial datasets are used by DEMD in the mission to provide the best possible technical and economic advice and services in assisting Indian mineral owners to achieve economic self-sufficiency by creating sustainable economies through the environmentally sound development of their energy and mineral resources.
Additionally, DEMD uses these Hart Energy geospatial datasets in the software development and GIS presentation of the NIOGEMS, exclusively available to assist Tribal offices and Tribal-supporting federal entities. Developed at DEMD, NIOGEMS is a map-oriented computer application that provides Tribes and federal users with access to natural resource data on Indian and non-Indian owned lands, both in and around reservations, to track and make decisions on leasing, developing, and managing energy and mineral resources.
DEMD has a mandated trust responsibility to provide technical assistance and technical advice to Tribal and Indian mineral owners who want to develop energy and mineral resources on their lands. DEMD accomplishes this through careful and accurate analysis of geophysical and geospatial data as part of DEMD’s compliance with the Indian Mineral Development Act of 1982 (Public Law 97-382, 25 USC 2106) and the Energy Policy Act of 2005, Title V – Indian Energy (Public Law 109-58, 25 USC 3502).
DEMD has studied the market for similar data packages. While other vendors offer subsets of energy or energy product related GIS data sets, or scales of data, they do not contain the number of available datasets, high quantity of attributes and high-resolution geospatial layers for high priority energy product commodities as Hart Energy’s data. Furthermore, other energy systems GIS datasets available in the geospatial data market do not include all types of the needed energy product pipeline, transmission lines, renewable energy infrastructure in vector, raster, and table format, in a single data grouping.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
In accordance with FAR Subpart 5.2, a synopsis of a sole source proposed contract action will be posted to SAM.gov to include a redacted sole source J&A.
