Gov’t Response to Industry Questions
1. Q: XXX Company capabilities include some requirements listed in the PWS such as report cards, transcripts, etc. Requiring the LMS to include this functionality may be redundant and increase the cost of the LMS. Does the BIE have specific needs for report cards or transcripts that XXX Company cannot meet? Would the BIE consider integrations with XXX Company instead of requiring that capability in the LMS?
A: The BIE does not have specific needs beyond those in any common school industry.
The BIE would entertain compliant integrations.
2. Q: In Attachment 1 PWS page #15 it states under the 12.3.1 LMS Implementation Plan that “The Contractor shall develop an implementation plan for the LMS including all infrastructure, client and other items needed to successfully meet the BIE’s targeted goal of deployment for the FY2022 school year. The plan shall be submitted with the PWS response as a draft and explain how the contractor shall propose the implementation through a phased approach to ensure the proposed schedule is adhered to.” Does the Government desire to have a draft Implementation Plan submitted with the vendor’s proposal and for such plan to cover ONLY Phase I? (Phase I being the 3 initial schools selected by BIE).
A: Yes. Given the requirements and the timeline proposed the government expects a draft timeline which can be completed with the government’s coordination.
3. Q: In Attachment 1 PWS page #10 under 6.27.f. The LMS shall contain the following user-level functions and features, it states that “Ability to support Special Education (SPED) student with options, including but not limited to, reading and writing accessibility tools (including read aloud, word prediction, speech recognition/voice typing, and translation supports). “dead keys” on keyboards, closed captioning, and video/audio playback.” Does the Government desire the LMS to support these software capabilities or to include these functionalities? Accessibility software is included in device operating systems, browsers, and productivity programs and allows users to set universal settings for their needs. Requiring the LMS to include this functionality would be unnecessary and increase the cost of the LMS. Would the BIE consider allowing the respondents to identify the capability of the LMS to support robust accessibility tools instead of requiring that capability in the LMS?
A: The software should meet federal mandates surrounding Section 508 and submit a complete VPAT for evaluation. This could include third party applications to address Section 508 deficiencies both in the current release and already planned releases. The government will work with the contractor to mitigate any deficiencies within the deployment timeframe.
4. Q: Paragraph 2.2 on page 5 of the PWS states “Implement the LMS to ensure the availability of the solution in support of the first three schools by the end of May 2022.”
How many students/users are estimated for the first three schools to be implemented? Is it the BIE’s intention that all 53 BIE managed schools will be added to the new LMS platform during the 3 years for implementation?
A: Phase 1 will include no more than 1500 students. However, this could be less given time constraints.
5. Q: Item #21 on page 9 of the PWS states the LMS must work with Android, IOS, Windows, Mac, Fire OS, and Unix? Is this an accurate list of operating systems which must be supported, including Unix?
A: This is a variable list of technologies the product should support from a rendering perspective. It is understood that should the product include web and local software rendering on some operating systems, it may not be possible at this time. As such the contractor may note that along with any future support plans. The sentence on page 9 should read, “…. The LMS should work….”
6. Q: Para 7.1 of the PWS states the requirement for the CSP’s 3PAO to complete an assessment of its offering.
a. Q: Are the 3PAO services required if the vendor solution is FedRAMP Moderate authorized?
A: All cloud hosted Infrastructure as a Service (IaaS), Platform as a Service (PaaS), Software as a Service (SaaS) or other ‘as a Service’ offering shall be compliant with FedRAMP requirements. If a bidder’s proposed solution is FedRAMP authorized, the applicable cloud infrastructure is presumably already covered by an assessment that was conducted by a 3PAO.
b. Q: Will the 3PAO be responsible for achieving an ATO (authority to operate) for the selected LMS?
A: The agency-responsible components of the bidder’s proposed solution (i.e., anything not explicitly covered by a FedRAMP ATO) must also complete a security assessment as conducted by an independent assessment organization;
however, that organization is not required to be a FedRAMP-accredited 3PAO.
7. Q: The top of page 18 of the PWS states “If the Contractor is proposing an already
FedRAMP certified product, please provide the Joint Authorization Board (JAB) provisional authorization.” Does this imply that non-FedRAMP authorized solutions may be proposed?
A: All cloud hosted Infrastructure as a Service (IaaS), Platform as a Service (PaaS), Software as a Service (SaaS) or other ‘as a Service’ offering shall be compliant with FedRAMP requirements prior to going into production. A currently non-FedRAMP authorized solution may be proposed under one of two scenarios:
• the bidder’s proposed solution does not include any cloud-hosted infrastructure
• the bidder’s proposed solution includes cloud-hosted infrastructure, but the solution is not yet FedRAMP authorized at the time of the proposal. Under this scenario, the bidder may wish to strengthen the proposal by demonstrating how all performance objectives (to include “Implement the LMS to ensure the availability of the solution in support of the first three schools by the end of May 2022”) can be achieved.
8. Q: If already FedRAMP authorized, does BIE require the LMS solution to have a JAB authorization, or is an Agency sponsored authorization acceptable?
A: Under either scenario, the agency-responsible components of the bidder’s proposed solution (i.e., anything not explicitly covered by a FedRAMP ATO) must also complete a security assessment as conducted by an independent assessment organization and be granted an ATO prior to going into production.
9. Q: Item #10 on page 8 of the PWS states “The Contract shall explain the use of Data Sync if proposing integration with Microsoft Teams.” Do BIE schools all currently have access to Microsoft Teams? Is Teams the BIE’s preferred platform for online course delivery?
A: No. Schools are not bound to Microsoft Teams and other products may be proposed.
10. Q: Item #8 on page 7 of the PWS identifies systems to which the LMS solution must integrate. Would BIE please provide additional details regarding the use of each system and the requirements for LMS integration with each?
A: The Contractor may provide an Application Program Interface (API), Web Services Description Language (WSDL), or Simple Object Access Protocol (SOAP) like models so that the Department may work to interface to those, and potentially other product technology adopted in the future.
11. Q: In paragraph 12.3.3 on page 16 of the PWS it states, “The Contractor shall provide services to capture all information technology requirements and provide optional services to perform the migration.” Would BIE identify the LMS solutions from which data will be migrated and estimate the number of courses, types of courses (e.g., SCORM, other), and amount of data to be migrated?
A: It is unclear at this time how much data will be migrated as this will need to be investigated as part of the move from existing platforms. The BIE will work with the contractor to coordinate this objective.
12. Q: With regards to the various plans identified in Task III – Plans, would the BIE confirm that it expects vendors to submit draft plans for each area in its proposal, and these draft plans will be finalized post award?
A: Unless otherwise stated, it is expected that vendors submit draft plans.
13. Q: Offeror Reps and Certifications-Commercial Items - An authorized official of the firm shall complete and sign clause. What is required in this section?
A: Read the instructions in the first sentence of the provision.
14. Q: (Sol p. 2, column 19) What is the difference between Item No. 00002 and Item No.
00003?
A: CLIN 002 refers to contractor services and personnel. CLIN 003 refers to the LMS initial school software cost, user licenses, and administrative and management licenses.
15. Q: (Sol pp. 2-5) What is the meaning of “perpetual license software” for items No. 00002
– No. 09001?
A: Perpetual software license is a type of software license that authorizes an individual to use a program indefinitely. Generally, outside of termination, a perpetual software license allows the holder to use a specific version of a given software program continually with payment of a single fee.
16. Q: Do “Task I – LMS Training” and “Task III – Plans” apply to Options 1-9, or just the
Base Year? For example, “Travel” is applied to Base Year and Option 1 – the additional years on the excel are in grey. This is not the case for Training and the Plans as the color is extended to Option 9.
A: This should be for the base of 3 years only.
17. Q: Can you quantify how much content will need to be developed over 3 years, and will this content be unique to each of the 53 managed schools?
A: It is unclear at this time how much content will be developed over three years. This will be coordinated and managed with the BIE, schools, and contractor implementation teams. It is expected however that within three years all 53 schools will utilize this single solution.
