Solicitation Questions & Answers 25 Jun 2021

1. Q: Will this be a follow-on requirement to any work performed currently or in the past, or will this be a new requirement?

Government Response: This is a new requirement.

2. Q: While many tasks may be able to be worked simultaneously, some actions may be best suited for sequential work as lessons and facts learned effect the required inputs. Would the Government consider adjusting the deliverable dates? The contract states that it is a four-month project; however, the timeline for deliverables is 65 days. It would make sense that the initial reviews and findings could be accomplished in the first 60 days of the contract period; the second phase of developing and offering recommendations based on those findings would better be developed in the second 60-day window, allowing for better and more robust recommendations.

Government Response: Government agrees to the recommendation. SOW deliverables have been updated. NOTE: Due to the background check timeline of 30 days, an 30 additional days have been incorporated into the delivery of tasks 1-4.

3. Q: Neither the solicitation nor the SOW provides requirements for proposal response page count, content, or evaluation factors. Assuming there is a requirement for a technical response, past performance, and cost/price. Can the Government provide any further guidance on contents, page count restrictions if any and planned evaluation approach?

Government Response: This is no page count and content should be based on the provided SOW. See page 16, 52.212-2 for evaluation factors.

4. Q: (SOW paragraph 4.4) FBI reports. It appears that the review is specifically of the IAD investigations and not the FBI investigations, which would leave a lot of room for blame transference and could create a significant gap in our ability to fully appreciate what was done, when and by whom. As the deaths are actually investigated by the FBI, we really need to review those case files in conjunction with the IAD files. Will the team be provided access to review the related FBI investigation report?

Government Response: The Team will only be provided the content which is currently in the possession of the BIA IAD.

5. Q: For a full understanding of standards and conditions, we would need to see all relevant medical records (including EMT run sheets and medications administered by medical personnel); Staff Response Reports; ER Treatment Records; Autopsy Reports; Toxicology Reports, etc. Are these provided either as part of the report or separately?

Government Response: The Team will be provided the full content of what’s currently in BIA IAD’s possession. Case dependent, the recommended information will be provided if possessed by BIA IAD.

6. Q: As part of the fieldwork requirement, will interviews be allowed of staff members, inmates, and investigators?

Government Response: In the cases where the facility is a BIA Direct service programs interviews will be allowed of the OJS employees. In the cases which occurred at tribal facilities we have no authority to require them to submit to interviews. Due to the short nature of Indian Country detention is it unlikely that inmates would still be incarcerated. In many cases reviewing the administrative investigative case file will be the primary information source of information.

7. Q: If interview is allowed, under what conditions and/or restrictions?

Government Response: Facility management would arrange for interview accessibility.

8. Q: What are the scheduling and notification procedures for access to facilities, staff, or inmates?

Government Response: Vendor would submit requests for access and the request will be forwarded to the facilities for arrangements.

9. Q: (SOW, para 2) the statement is made, “Finally, staffing levels have grown since 2004, and the percentage of certified correctional officers has increased” … upon award can we be provided charts/metrics to see the actual numbers and data from which these statements were generated? There may be correlation with other examined data.

Government Response: Staffing data will be made available if requested.

10. Q: What, if any documents or files generated as a result of an ICD, will be withheld or excluded from our review?

Government Response: BIA IAD will provide the full case file and all associated information in possession.

11. Q: Should we experience delays in access and/or interview authorization, will these delays extend the contract?

Government Response: If there are any delays, the government will investigate the reason for such delays. If validated as government causes delays, the Contracting Officer may extend the contract.

12. Q: (SOW para 4.4.2) Does the scope of the policy review focus on only the ICD investigations or will the expectation be for us to review the entire policy and procedures provided related to, for example, all aspects of care, custody, control, UOF, transportations?

Government Response: This will only be focused on policies related to the ICD and or the investigations of the ICD.

13. Q: (SOW para 4.4.2) When comparing the investigations to “common industry standards” will we have full and timely access to the following?

a. training records of guards and staff (dispatch, surveillance teams, onsite medical)

b. any additional location specific policies, procedures or directives.

c. All audit and site assessments related to the matter being investigated such as data related to DOI OIG published Report No. 2015-WR-012, SOPs, Handbook or Process Guides.

Government Response: We will provide access to the data which is available within OJS.

14. Q: (SOW para 4.5.1) Explain the scope related to “…examine, document, understand and assess the state of the BIA” as to only the ICD process or is it more general?

Government Response: The focus will be retained to the closed ICD investigations along with the investigative thoroughness.

15. Q: (SOW para 4.5.3) Is this “briefing” on the entirety of the final review or is a briefing expected on a case-by-case basis for each ICD case review?

Government Response: This will be a case-by-case basis which allows the vendor and the BIA to discuss each case and answer (if allowable) any clarifying questions or concerns.

16. Q: (SOW para 4.7.1) The expectation of “on-the-ground” fieldwork or virtual examinations in reviews was stated here and in other sections. Are these reviews relegated to ONLY the locations of the 16 ICD reports or can they be views of locations outside of the 16 reports to be reviewed?

Government Response: The vendor and OJS can discuss any need to conduct interviews beyond the scope of the 16 ICD, generally interviews should be focused upon the 16 ICD investigations.

17. Q: (SOW para 4.7.1) Is there a limit placed on the number of these virtual and/or site reviews?

Government Response: None beyond reasonable information collection from those directly involved with the ICD investigations or who were involved with the facilities where the incidents occurred.

18. Q: (SOW para 4.8 Task 4) Will we have full access to investigator training and histories such as: Qualifications held by investigators, job description for positions involved in investigations of ICDs, minimum standards for their position and all training records?

Government Response: This may be difficult as not all investigators still work for the BIA IAD; however, we can work with IPA and attempt to garner training files.

19. Q: (SOW para 5 Deliverables and Schedule) Are all aspects of these 16 case reviews, policy, procedure, training, historical comparisons of cases, and on-the-ground or virtual site assessments expected to be completed in 60 days or are tasks 1-5 given 60 days each? As a note, having additional time would allow for better pricing as 60 days for the entirety of the review of reports, SOPs, Handbooks and Process guides can be a very tight window and would depend on a lot of currently unknown factors.

Government Response: See #2

20. Q: Would you consider any alternate pricing? Our concern is that Firm Fixed price with such a narrow timeframe and unknowns related to the 16 case reviews and scope of the project will require worst case assumptions.

Government Response: This requirement will remain Firm Fixed Price.
