About this file

This document is an Amendment (Amendment #0001) to Request for Quote (RFQ) 140A0525Q0019 for Remediation Services within the Village of Copper Center, Alaska. The amendment makes two key changes: first, it updates the North American Industry Classification System (NAICS) and Size Standard from "562910 Remediation Services / $25M" to "562910 (Exception) Environmental Remediation Services / 1,000 employees", and second, it publicly releases questions and answers related to the solicitation. The contract's period of performance is set from 04/21/2025 to 06/30/2026.

The amendment includes detailed Questions and Answers that clarify two important aspects of the solicitation: (1) potential use of sister company past performance references, referencing Federal Acquisition Regulation (FAR) standards for contractor responsibility, and (2) pricing submission requirements, specifically mandating that contractors provide an itemized price breakdown for each task in the Performance Work Statement (PWS), with all lump sum totals requiring detailed breakdowns covering material, labor, equipment, subcontracts, travel, overhead costs, and profit.

Questions & Answers

1. Per Sol_140A0525Q0019 Section 4.4(7) on page 27: The solicitation requires offerors to provide three contract references, but it does not state whether sister company past performance can be used to satisfy this requirement.

To support the FAR's goals of full and open competition, the GAO has recognized that an agency may properly attribute the experience or past performance of a parent or sister company to an offeror where the proposal demonstrates that the resources of the parent or sister will affect the offeror’s performance. See, e.g., West Sound Servs. Grp., LLC, B406583.4, B-

406583.5 (July 9, 2014). Similarly, it has determined that a solicitation is unduly restrictive of competition where an agency refuses to consider past performance of sister or other affiliated companies without explanation. See Iyabak Construction, LLC, B-409196 (February 6, 2014).

If an offeror for this solicitation demonstrates that a sister company's resources will affect the offeror’s performance, such as by providing key personnel or other support, will the government credit the sister company's past performance to the offeror?

The past performance references will be used by the BIA to determine that the Contractor is responsible according to the standards of FAR SubPart 9.1.

FAR 9.104-3 Application of standards.

(a) Ability to obtain resources. Except to the extent that a prospective contractor has sufficient resources or proposes to perform the contract by subcontracting, the contracting officer shall require acceptable evidence of the prospective contractor’s ability to obtain required resources (see 9.104-1(a), (e), and (f)). Acceptable evidence normally consists of a commitment or explicit arrangement, that will be in existence at the time of contract award, to rent, purchase, or otherwise acquire the needed facilities, equipment, other resources, or personnel. Consideration of a prime contractor’s compliance with limitations on subcontracting shall take into account the time period covered by the contract base period or quantities plus option periods or quantities, if such options are considered when evaluating offers for award.

FAR 9.104-1 General standards.

To be determined responsible, a prospective contractor must- (a)Have adequate financial resources to perform the contract, or the ability to obtain them (see 9.104-3(a));

(e)Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors). (See 9.104-3(a).)

Questions & Answers

(f)Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a));

2. Per Sol_140A0525Q0019 SF1449 page 2 and Section 4.4(2) on page 27: Do we need to provide lump sums for each task or an overall lump sum that includes all tasks under the performance work statement?

The Contractor shall furnish an itemized price breakdown for each Task listed in the PWS.

All lumps sum totals provided shall include an itemized breakdown. The aggregate of the lump sum totals represents the quoted amount.

The itemized breakdown shall be in sufficient detail to permit an analysis of all material, labor, equipment, subcontracts, travel, and overhead costs, as well as profit, and shall cover all work involved. Any amount claimed for subcontractors shall be supported by a similar price breakdown.
