About this file

This is Amendment 0001 to RFQ #140A0126Q0049, issued by the Bureau of Indian Affairs (BIA) Pacific Region, for an Environmental Assessment (EA) and Phase I Environmental Site Assessment for a 20-acre fee-to-trust land acquisition at Pine Ridge Reservation in South Dakota. The amendment extends the solicitation deadline from September 2, 2026 to September 16, 2026 at 0800 PT and publicly releases all questions and answers submitted to date. The requirement is 100% set-aside for Indian Small Business Economic Enterprises (ISBEE). All interested parties must complete blocks 8 and 15A-C of the amendment and include the completed page 1 with their quotation submission. The period of performance runs from September 24, 2026 to January 31, 2027.

The scope is limited to BIA's approval of the 20-acre fee-to-trust application with no subsequent development or physical land-disturbing activity included. The contractor must prepare an EA complying with NEPA and a Phase I Environmental Site Assessment prepared in accordance with ASTM E1527-21. Key deliverables include analysis of threatened, endangered, and candidate species; wetlands, raptors, wildlife and vegetation; cultural resources; and biological information review. Desktop review of existing records for bald and golden eagles, migratory birds, and other wildlife is acceptable; however, if suitable habitat or concerns are identified, the contractor must notify BIA before proceeding. The contractor is responsible for obtaining South Dakota Natural Heritage Program data and existing raptor or eagle nest survey data. A scoping notice in one newspaper, up to five scoping letters, and a Notice of Availability posted by BIA are required. No public meetings, hearings, or additional comment periods beyond the 15-day BIA review of the draft EA are required. Service Contract Act wage determinations apply to non-exempt technical and clerical labor categories supporting contract deliverables.

Questions & Answers

1. Please confirm that the Proposed Action and scope are limited to the BIA's approval of the 20-acre fee-to-trust application, and no subsequent development or physical land-disturbing activity is included in the Proposed Action.

CONFIRMED - Proposed Action and scope are limited to the BIA's approval of the 20-acre fee-to-trust application, and no subsequent development or physical land-disturbing activity is included in the Proposed Action.

2. Attachment 1 identifies “Threatened, Endangered, and Candidate Species Determinations” and “Wetlands, Raptors, Other Wildlife and Vegetation” as sections of the Environmental Assessment, but the Deliverables and Procedures section does not identify a Biological Assessment or Biological Evaluation as a deliverable. Please confirm whether a stand-alone Biological Assessment or Biological Evaluation is required under CLIN 00010, or whether Endangered Species Act findings are to be documented within the Environmental Assessment sections only. If a Biological Assessment is required, please confirm whether BIA or the contractor transmits it to the U.S. Fish and Wildlife Service, and whether the period of performance is intended to accommodate Section 7 consultation timelines.

At this point, the need for an Biological Assessment or Biological Evaluation is not anticipated, if needed at a later time, an additional RFQ would be issued.

3. Please confirm whether vegetation clearing, including removal of trees or shelterbelts, is part of the proposed action or a reasonably foreseeable consequence of it. The northern long-eared bat was reclassified as endangered effective March 31, 2023, and the accepted presence-absence survey window for acoustic and mist-net methods is approximately June 1 through August 15. That window falls entirely outside the September 24, 2026 through January 31, 2027 period of performance.

Please confirm whether BIA will accept a seasonal clearing restriction documented as an environmental commitment within the Environmental Assessment in lieu of presence-absence survey.

No vegetation clearing, including removal of trees or shelterbelts, is part of the proposed action, there is little to no vegetation, including trees or shelterbelts. The Map shows the location is in town and the site is disturbed.

4. Attachment 1 requires analysis of bald and golden eagles, migratory birds, and other wildlife. The eagle nest occupancy survey window of approximately February through July likewise falls outside the period of performance. Please confirm whether BIA will furnish the South Dakota Natural Heritage Program data request response and any existing raptor or eagle nest survey data for the vicinity of the parcel, or whether the contractor is expected to obtain these, and confirm that desktop review of existing records is acceptable in place of field survey.

The contractor is responsible for this; the BIA will not furnish the South Dakota Natural Heritage Program data request response and any existing raptor or eagle nest survey data for the vicinity of the parcel. As for the desktop review; A desktop review of available records and existing biological information is acceptable for the initial analysis of bald and golden eagles, migratory birds, and other wildlife. If the desktop review identifies suitable habitat, known occurrences, active or potentially active nests, or other concerns that cannot be adequately evaluated using existing information, the contractor shall notify BIA before proceeding so that the need for a field survey or additional coordination can be determined.

Questions & Answers

5. Attachment 1, page 1, requires that the Environmental Assessment comply with “the Bureau of Indian Affairs NEPA Handbook 2026.” Please provide a copy or citation or confirm that compliance is to be measured against 516 DM 10, the 59 IAM 3-H NEPA Guidebook, and 516 DM Chapters 1 through 15 as otherwise stated in Attachment 1.

Will provided upon award.

6. Attachment 3 provides Service Contract Act Wage Determination 2015-5377, Revision 32, and Section 3.1 incorporates FAR 52.222-41, FAR 52.222-42, FAR 52.222-55, and FAR 52.222-62.

The requirement is for professional environmental planning and analysis services. Please confirm whether BIA asserts Service Contract Act coverage for this requirement, or whether the exemption for bona fide professional employees at FAR 22.1003-4 applies. If the Service Contract Act applies, please identify the labor categories BIA considers non-exempt so that they may be priced against the wage determination. The SCA does apply to any non-exempt support or technical labor categories utilized to execute the contract deliverables (such as drafting maps, formatting reports, compiling administrative records, or conducting clerical/technician tasks).

Wage Determination No. 2015-5377 (Revision 32), supporting technical and clerical classifications.

The Government does not provide the specific labor categories for this requirement. It is the responsibility of the contractor to review the SOW to ensure employees are being paid at or above the rate listed for the class of work being performed.

7. Attachment 1 states that the completion date is four months from the start date, and the SF 1449 establishes delivery of January 31, 2027. Several elements of the work depend on Government or third-party response times, including the 15-day BIA review of the draft Environmental Assessment, agency and Tribal consultation responses, and receipt of any Government-furnished project information. Please confirm whether BIA will consider a no-cost extension to the period of performance where completion is delayed by a Government or third-party dependency outside the contractor’s control.

Any adjustment to the period of performance would be at the discretion of the Contracting Officer and would require appropriate Government authorization and contract modification. Contractors should not assume that a no-cost extension will be granted for delays associated with Government or third-party review or response times and should plan their work to meet the established completion date.

8. Page 2 of the SF 1449 describes the requirement as an "Environmental Assessment (EA) for the Pine Ridge Gaming Acquisition (Grass Property)" and states that "This project involves a gaming Fee-to-Trust acquisition." Attachment 1, Statement of Work, does not reference gaming and does not include gaming-related analysis. Please confirm whether the EA is to be prepared to the scope stated in Attachment 1 as written, or whether it must also analyze proposed gaming development on the parcel, including facility operations, traffic, socioeconomic and fiscal effects, and any associated public involvement beyond the scoping described in Attachment 1.

EA is to be prepared to the scope stated in Attachment 1 as written. The word “gaming” was mistakenly included. Any assumptions made by the vendors are done at their own risk.

Questions & Answers

9. Section 4, Attachments, identifies Attachment 1 as "Statement of Work (SOW), Phase I Environmental Site Assessment for Fee-to-Trust Land Acquisition." The attachment provided is titled "Environmental Assessment for Pine Ridge Reservation" and describes a NEPA Environmental Assessment. Please confirm whether a Phase I Environmental Site Assessment prepared in accordance with ASTM E1527-21 is also required under CLIN 00010, or whether the requirement is limited to the NEPA Environmental Assessment described in Attachment 1.

The Phase I Environmental Site Assessment must be prepared in accordance with both NEPA and

ASTM E1527-21.

10. Attachment 1 requires a Cultural Resources section and a Cultural Resources Impacts/Mitigation subsection, but does not identify a cultural resources field survey, a survey report, or a consultation deliverable in the Deliverables and Procedures section. Please confirm whether BIA expects a Class III pedestrian survey of the approximately 20-acre parcel with an accompanying report, or whether the contractor's responsibility is limited to a records search, coordination support with the Tribal Historic Preservation Officer and State Historic Preservation Officer, and the analysis section within the EA. If Section 106 consultation is required, please confirm whether BIA initiates consultation.

BIA’s expectation is that the contractor’s cultural-resources responsibilities are limited to conducting an appropriate records and literature review, preparing the cultural-resources and impacts/mitigation sections of the EA, and providing technical support for coordination and consultation with the Tribal Historic Preservation Officer and State Historic Preservation Officer. If BIA determines during the review process that a Class III survey is necessary to satisfy Section 106 requirements, that work would require separate authorization and, if applicable, a modification to the contract.

11. The Deliverables section of Attachment 1 identifies a scoping notice published in one newspaper, up to five scoping letters, and a Notice of Availability posted by BIA. Please confirm that no public meetings, public hearings, or comment periods other than the 15-day BIA review of the draft EA are required under this order.

CONFIRMED no public meetings, public hearings, or comment periods other than the 15-day BIA review of the draft EA are required under this order.

12. The SF 1449 cover page carries the Women-Owned Small Business (WOSB) header, while Block 10 of the same form and Section 1.3 of the solicitation both state that the requirement is set aside 100 percent for Indian Small Business Economic Enterprises. Please confirm that the ISBEE set-aside governs.

The RFQ is 100% set-aside for Indian Small Business Economic Enterprises.

13. Is any development planned for the 20 acres?

Unknown.

14. What is the current state/operation of the property?

Currently, no operation on land.

Questions & Answers

15. Will the existing building be demolished?

Unknown.

16. What is the age of that building?

Unknown.

17. Has the land been previously surveyed for cultural resources?

The land will be surveyed by the Regional Archeologist and the Tribal Historic Preservation Officers within the tribe.
