About this file

This document is a Limited Source/Brand Name Justification under FAR 13.106-1(b)(1) for Simplified Acquisitions. The USDA Agricultural Research Service (ARS) requires a new respirator fit test machine to provide fit testing to ARS employees at the NCAH campus in Ames, IA and surrounding areas. The justification states that the APHIS Respirator Protection Program requires the use of TSI Porta Count fit testing machines, and only TSI Incorporated can fulfill this requirement, as APHIS employees are trained solely on TSI equipment. The estimated total cost is $16,235, and the recommended sole source is TSI Incorporated. This justification supports a special notice for Solicitation Number 1133298GPA for a Respirator Fit Test Machine, which the USDA-ARS intends to procure from a single source.

United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions

1. Identification of the agency and the contracting activity.

USDA - Agricultural Research Service (ARS)

2. Description of supply or service required to meet the agency’s needs.

IH & Safety need a new respirator fit test machine in order to provide fit testing to ARS employees at the NCAH campus in Ames, IA and visiting employees from an area of operation that encompasses parts of Minnesota, Illinois, Wisconsin, Missouri, Kansas, Nebraska, and South Dakota.

3. The rationale or circumstances for limiting competition.

APHIS Fit Tester employees receive their required Fit Tester training and certification at TSI headquarters in Shoreview MN and are only trained on TSI Porta Count Fit Testing Machines. This policy is set forth at the agency level and cannot be deviated from on the local level. Local Porta Count machines must be interchangeable and compatible with established APHIS SOPs and training. Requested Porta Count will be for testing ARS employees at the NCAH campus in Ames, IA and surrounding areas but the employees administering the tests will be APHIS employees trained by and acting in compliance with the APHIS Respirator Protection Program.

IH & Safety require the new fit testing machine from TSI, Inc. for the respirator fit testing of ARS employees on site. Fit testing for employees that require respirators is an annual requirement set by OSHA regulations. Fit testing for ARS employees cannot be delayed. The current model Porta Count 8038 is at the end of its service life after 16 years of service (since 2008).

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

The market research conducted determined that due to APHIS training regulations, TSI Incorporated is the only vendor that can fulfill the requirement.

5. Estimated price, including all options, if applicable.

The estimated total cost is $16,235.00.

6. Recommended source(s).
