1. SPECIAL NOTICE TO OFFERORS
The Government intends to evaluate offers and award a contract without discussions. ADDENDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS
I GENERAL
1. The Government anticipates awarding a firm-fixed-price task order to the contractor whose offer is found to be the best value and most advantageous to the Government in terms of price and other factors considered. The Government will evaluate offers based on a comparative analysis of the offers received, considering the factors and requirements outlined in this RFQ.
2. The Government intends to evaluate the offers and award/issue a contract/task order based on the initial offers received. Therefore, the initial offer should contain the best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. This statement is not to be construed to mean that the Government is obligated to conduct discussions or exchanges.
3. Failure to provide a reasonable and complete offer may reflect a lack of understanding of the requirements and may result in the elimination of further consideration.
4. Offers that merely restate the requirement or state that the requirement will be met without providing a supporting rationale are not sufficient.
5. The Contractor shall submit a firm-fixed-price offer according to the Addendum to 52.212-1 Instructions to Offerors. The factors identified below shall be used to evaluate the offer.
6. This acquisition is being conducted under FAR Part 13 Simplified Acquisition Procedures. The principles and procedures of FAR Part 15 do not apply. A contractor may be eliminated from consideration without further exchanges if its offer is not among those considered most advantageous to the Government based on the requirements of this solicitation.
7. The award/task order resulting from this solicitation will be awarded to the responsible Offeror whose offer conforms to the solicitation and is determined to be the best value to the Government considering Price (Factor A), Technical Experience (Factor B), Technical Approach (Factor C), and Past Performance (Factor D). Factor C is more important than Factors B and D.
Factors B and D are equally important. All Technical (non-price) Factors, when combined, are more important than Price (Factor A).
8. By submission of its offer, the contractor is required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being ineligible for award. Contractors must clearly identify any exception to the solicitation terms and conditions and provide a complete accompanying rationale. The evaluation process shall proceed as follows:
II FACTOR A – PRICE:
1. Price submittals will be subjectively evaluated to determine the reasonableness of the offer for the overall price and individual CLIN pricing. The Government will not conduct price realism analysis as part of its price evaluation. The Government will evaluate the offer using price analysis techniques to determine fairness and reasonableness in relation to the SOW requirements. One or more of the following techniques will be used to ensure a fair and reasonable price:
1.1 Comparison of submitted prices received in response to the solicitation.
1.2 Comparison of submitted prices with the IGE.
1.3 Comparison of submitted prices with available historical information.
1.4 A total contract price or individual CLIN price that is found to be either unreasonably high or low in relation to the proposed work may indicate an inherent lack of understanding of the solicitation requirements and may result in the overall offer being removed from further consideration.
PAGE 14 OF 78 1333ND24QNB190380
2. Any inconsistency, whether real or apparent, between submitted performance and price/cost must be clearly explained in the price submission. For example, if unique and innovative approaches are the basis for an apparently unbalanced/inconsistently priced submission, the nature of these approaches and their impact on price must be completely documented.
3. An offer whose price is determined to be unbalanced across CLINs (i.e., unreasonably high for one CLIN and unreasonably low for one CLIN) may not be considered for award and may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
4. The Government reserves the right to request any additional price-related information to determine a fair and reasonable price.
III NON-PRICE / TECHNICAL EVALUATION
1. The Government shall evaluate the non-price / technical portion of the offer. Any aspect evaluated that does not meet the requirements of the RFQ may render the entire offer unawardable. Only those offers determined, either initially or as a result of discussions, as meeting the RFQ requirements will be considered for award. However, contractors are reminded that the Government reserves the right to award this effort based on the initial offers, as received, without discussions.
2. The offers shall be evaluated against the following technical factors:
2.1 FACTOR (B) - TECHNICAL EXPERIENCE
2.1.1 Evaluation of this factor is a subjective evaluation of the Offeror’s assessing the contractor’s experience with similar projects of similar size, scope, and complexity. The assessment of the contractor’s submittals will be used to subjectively evaluate the contractor’s demonstrated breadth and depth of experience in performing similar/relevant projects as defined in the solicitation requirements. Project relevancy will be assessed.
The assessment of the contractor’s relevant experience will be used as a means of evaluating the capability of the contractor to successfully meet the requirements of the solicitation. The Government will only review three (3) Relevant Experience projects in the order of submission. Any projects submitted in excess of the three (3) relevant projects will not be considered.
2.1.2 Basis of evaluation: The submitted minimum technical experience requirements must be complete. The technical experience (Factor B) will be evaluated on a Satisfactory/Unsatisfactory basis.
• The Offeror will be rated satisfactorily based on its submitted experience with recent and similar projects to the solicitation documents and requirements.
• The Offeror will be rated unsatisfactory if it fails to address or sufficiently address one (1) or more of the requirements.
2.2 FACTOR (C) - TECHNICAL APPROACH
2.2.1 Evaluation of this factor is a subjective evaluation of the Offeror’s understanding of the contract requirements (clauses, provisions, and the SOW) and demonstrated ability to meet contract requirements and SOW tasks based on its proposed technical details.
2.2.2 Technical details that do not adequately address how the Offeror proposes to meet the requirements may not be deemed as the best value to the Government. A technical approach, which is primarily a copy-and-paste version of the SOW requirements and performance standards, will not be considered for award.
PAGE 15 OF 78 1333ND24QNB190380
2.3.3 Basis of evaluation: The submitted minimum technical capability requirements must be complete. The technical approach (Factor C) will be evaluated on a Satisfactory/Unsatisfactory basis.
• A satisfactory rating will be achieved based on the Offeror’s ability to identify the major areas of work and show a logical and realistic approach to work execution in accordance with the SOW.
• The Offeror will be rated unsatisfactory if it fails to address or sufficiently address one (1) or more of the requirements.
2.3 FACTOR (D) – PAST PERFORMANCE
2.3.1 Evaluation of this factor shall be accomplished by the Government, including but not limited to the resources identified in FAR Part 13. The past performance evaluation will assess the relative risks associated with an offeror's likelihood of success in fulfilling the solicitation's requirements as indicated by the offeror's record of past performance. In this context, "offeror" refers to the prime contractor. Present and past performance shall be evaluated as a measure of the Government's confidence in the offeror's ability to successfully perform based on previous and current contract efforts.
2.3.2 Past performance will be determined to be relevant if it demonstrates performance on a contract/task order involving work that is similar in nature, size, and complexity to the requirements being procured under this solicitation. Past performance will be determined recent if the relevant work was performed within the past three (3) years.
2.3.3 If an offeror has no record of recent or relevant past performance, the Offeror will not be evaluated favorably or unfavorably. During comparative evaluation, Offerors who can demonstrate recent and relevant past performance will be evaluated more favorably.
2.3.4 Offerors are reminded that the Government will review any or all of a combination of past performance information submitted by the Offeror as required per the solicitation and past performance data available in the Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov/ and in the Federal Awardee Performance and Integrity Information System (FAPIIS) at https://www.fapiis.gov/. The Government reserves the right to obtain past performance information from any available source besides those specified and may contact customers other than those identified by the Offeror when evaluating past performance. Offerors are reminded that the burden of proving low-performance risk rests upon the Offeror.
2.3.5 The Offeror shall provide up to three (3) references which shall be for recent work performed and shall be relevant to the complexity, size, and scope of this solicitation’s requirements (if previous work of this nature has been performed). Each reference shall be limited to three (3) single-sided pages.
2.3.6 For each past performance reference, Offerors shall list:
i. Name/address of organization contract was with
ii. Contract or project number/title
iii. Period of performance of contract
iv. Brief description of contract/project scope and dollar value (total contract value inclusive of any options)
v. Point of contact information for reference (name/title/phone number/e-mail address)

Part 1: GENERAL
1.1 INTRODUCTION:
1. This document is intended to provide the necessary information/requirements for all contractors performing work at
Department of Commerce (DOC) facilities. It is understood all information in this document may not apply for the specific project described in the Statement of Work; however, it is the responsibility of the contractor to ensure the requirements are met when applicable.
2. Specifics of the activities are described in the attached Statement of Work and supporting documentation.
3. Questions about the requirements can be addressed to the Contracting Officer (CO) and Contracting Officers Representative
(COR)/Project Manager designated for the specific task order.
1.2 BACKGROUND
The Office of Facilities and Property Management (OFPM) Division manages and provides services to the DOC staff in support of their research, technical, and administrative programs. DOC agencies serviced by OFPM include but may not be limited to: The National Oceanic and Atmospheric Administration (NOAA), The National Telecommunications and Information Administration (NTIA), and The National Institute of Standards and Technology (NIST).
1.3 HOURS OF OPERATION
1. DOC hours of operations are from 7:00 AM to 5:00 PM, Monday through Friday, on normal Federal workdays. Should the
Contractor desire to work at times other than those specified above, the dates and hours must be scheduled at least 10 working days in advance and approved in writing by the Contracting Officer’s Representative (COR).
2. Use the Main Entrance at the DOC site for materials supply and entry for:
a. Special arrangements may be made through the COR for delivery of material/supplies, and/or overtime beyond these hours or on holidays.
b. Check-in required at DOC Visitor’s Center located at the site main entrance.
3. Employee identification shall include the name, country of citizenship, employer, and green card (if applicable) is needed for each Contractor and Subcontractor's employee working on the DOC site. These shall be submitted to the COR for review 10 days prior to the work date. After hours work will require a hard badge from the General Contractor and a COR/Federal escort 100 percent of time if accessing DOC buildings (see section 3.3). Follow the specific procedures pertaining to security and work hours prescribed by the COR/Security. Contractor vehicles must show current registration and proof of insurance.
4. Department of Homeland Security (DHS) Advisory System:
Note: The following paragraphs describe the threat levels that may be changes at any time due to national security issues. If a change is issued by the DHS all changes in procedures/directions for entering and performing work at the site will be communicated to the contractor through the COR. Contractor’s access to the DOC campus grounds may occasionally be restricted as a result of a change in the Nation’s Threat Level when publicly announced by DHS.
5. National Terrorism Advisory System (NTAS)
a. The National Terrorism Advisory System, or NTAS, replaces the color-coded Homeland Security Advisory System (HSAS).
This new system will more effectively communicate information about terrorist threats by providing timely, detailed information to the public, government agencies, first responders, airports and other transportation hubs, and the private sector.
b. It recognizes that Americans all share responsibility for the nation’s security and should always be aware of the heightened risk of terrorist attack in the United States and what they should do.
6. NTAS Alerts
a. After reviewing the available information, the Secretary of Homeland Security will decide, in coordination with other
Federal entities, whether an NTAS Alert should be issued.
PAGE 23 OF 78 1333ND24QNB190380
b. NTAS Alerts will only be issued when credible information is available.
c. These alerts will include a clear statement that there is an imminent threat or elevated threat. Using available information, the alerts will provide a concise summary of the potential threat, information about actions being taken to ensure public safety, and recommended steps that individuals, communities, businesses and governments can take to help prevent, mitigate or respond to the threat.
d. The NTAS Alerts will be based on the nature of the threat: in some cases, alerts will be sent directly to law enforcement or affected areas of the private sector, while in others, alerts will be issued more broadly to the American people through both official and media channels.
e. NTAS Alerts contain a sunset provision indicating a specific date when the alert expires - there will not be a constant NTAS Alert or blanket warning that there is an overarching threat. If threat information changes for an alert, the Secretary of Homeland Security may announce an updated NTAS Alert. All changes, including the announcement that cancels an NTAS Alert, will be distributed the same way as the original alert.
f. Contractor coordinates procedures with COR.
g. Threat Levels:
i. Low Condition (Green): A Low Condition is declared when there is a low risk of terrorist attacks.
1. Federal departments and agencies will implement general and agency-specific Protective Measures to assure that all facilities and regulated sectors take reasonable measures to mitigate vulnerabilities to terrorist attack.
2. Contractor coordinates procedures with COR.
ii. Guarded Condition (Blue): A Guarded Condition is…
