Potable Water Testing Services Statement of Work
I. BACKGROUND
A. The National Institute of Standards and Technology (NIST) campuses in Boulder, CO, Fort Collins, CO, and Gaithersburg, MD, are equipped with drinking water fountains and potable water sinks throughout various buildings. All campuses’ need to ensure potable water meets Environmental Protection Agency (EPA) requirements.
B. Potable Water Sources The contractor shall complete the annual testing of all potable water within the buildings of NIST, Boulder
CO, Fort Collins CO and Gaithersburg, MD. The contractor shall take the necessary water samples to adequately determine if the potable water is free of harmful levels of Aluminum, Copper, Lead, Cadmium, Zinc and Total Coliforms, in accordance with the United States (US) EPA Primary and Secondary Drinking Water Standards for Maximum Containment Levels (MCLs).
II. SCOPE OF WORK
A. Purpose/Objective
1. The contractor shall furnish all labor, materials, equipment, transportation, facilities, supervision, and management, unless otherwise specified herein. The contractor shall take appropriate water samples from all designated source locations. The range of test sources can fluctuate annually as current building modifications continue. The present quantities of test sources are eighty-five (85) sources in Boulder; four
(4) sources in Fort Collins, and two-hundred-sixty-five (265) in Gaithersburg, MD.
2. Current sources are shown in Attachment A for NIST Boulder / Fort Collins, CO Campuses and Attachment B for NIST Gaithersburg, MD Campus. The Contractor shall coordinate site access with the Contracting Officer Representative (COR) or the Alternate Contracting Officer Representative (ACOR) at least fourteen (14) days prior to any-on-site sampling is to occur.
B. Specific Requirements
The contractor shall complete the following tasks:
1. TASK 1: Perform water testing for Aluminum, Copper, Lead, Cadmium, Zinc, and Total Coliform in accordance with the US EPA Primary and Secondary Drinking Water Standards for Maximum Containment Levels (MCLs).
2. TASK 2: Testing shall be conducted per the analytical methods promulgated under the authority of Section 304(h) of the Clean Water Act, specifically, EPA Test Methods: 200.8 - Metals by ICP/MS and SM9223B Enzyme Substrate Test and reported to NIST via a compiled written report within thirty (30) calendar days after taking the samples.
The contractor shall provide new laboratory identification for each sample source showing building number, area location and sample source (example: fountain / sink) for future sampling efforts. Reports shall be submitted as electronic copies. Accepted reports shall be Level II Laboratory Report translations and shall include at a minimum: Case Narratives; Detection Summary; Method Summary; Sample Summary; Sample Results; Surrogate Summary; QC Sample Results; QC Association; Chronicle; Receipt Checklists; and Chain of Custody.

3. TASK 3: Provide three overall Water Quality Editable Consumer Confidence Reports (CCR). One (1) overall Report for NIST Boulder, one (1) overall for NIST Fort Collins Campus and one (1) overall Report for NIST Gaithersburg Campus. The editable CCR reports are due within ninety (90) days of sampling completion for each location. Reports shall be submitted as electronic copies. CLIN X005
4. TASK 4: Provide up to three (3) emergency retests for each location, within 24 hours of the original test.
(1 trip, up to 3 samples, analysis and a standard detailed report within 30 days). Reports shall be submitted as electronic copies. CLIN X003
5. TASK 5: Provide up to five (5) routine retests for each location with a standard detailed report within thirty (30) days. Reports shall be submitted as electronic copies. CLIN X004
III. PLACE OF PERFORMANCE:
A. All work shall be conducted at the NIST/Boulder (site-wide) 325 Broadway, Boulder, Colorado, 80305, NIST
Fort Collins at Radio Station WWV 2000 E. County Rd. 58 Fort Collins, CO 80524 and NIST/Gaithersburg, MD (site-wide) 100 Bureau Drive Gaithersburg, MD 20899
IV. DELIVERABLE SCHEDULE:

V. STANDARDS FOR ACCEPTANCE OF DELIVERABLES:
A. The COR will provide comments on each deliverable within fourteen (14) calendar days from receipt of a given deliverable provided by the contractor. The contractor shall make any needed changes to the report(s) within five (5) calendar days from receipt of electronic or written comments from the COR. The COR will provide written notification when a deliverable is accepted.
VI. CONTRACTOR SUPPLIED MATERIALS
A. All equipment and tools to perform the work herein.
VII. QUALIFICATIONS/LAB REQUIREMENTS:
A. The contractor shall perform water quality sampling under the US EPA Primary and Secondary Drinking Water Standards for Maximum Containment Levels (MCLs), including Section 304(h) of the Clean Water Act and specifically, EPA Test Methods: 200.8 - Metals by ICP/MS and SM9223B Enzyme Substrate Testing.
B. State of Colorado:
Certified as an “Environmental Laboratory” by the Department of Public Health and Environment, with successful participation in the on-site inspections for evaluation for compliance with the U.S. Environmental Protection Agency's (EPA) Manual for the Certification of Laboratories Analyzing Drinking Water.
C. State of Maryland:
Certified as a “Drinking Water Laboratory” under Code of Maryland Regulations: 26.08.05, Certification of State Water Quality Laboratories.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

ADDENDUM TO 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
1. SPECIAL NOTICE TO QUOTERS
The Government intends to evaluate quotations and award a contract without discussions.
Therefore, the Quoter’s initial quotation should contain the Quoter’s best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer (CO) later determines them to be necessary. This action is to be executed in accordance with FAR Part 13, Simplified Acquisition Procedures.
1.1 Each quotation shall clearly demonstrate that the Quoter understands both the general and specific technical requirements of the Statement of Work (SOW).
1.1.1 Failure to explain Quoter’s ability to meet all requirements may result in the Quoter's quotation not being considered. Clarity and completeness of quotations are of the utmost importance. Therefore, quotations must be written in a practical, clear and concise manner.
1.1.2 Quotations which merely restate the requirement or state that the requirement will be met without providing supporting rationale are not sufficient.
1.2 This requirement is being awarded utilizing the procedures established in FAR Part 13.
FAR Part 15 procedures do not govern the evaluation of quotations under this solicitation. A Quoter may be eliminated from consideration without further exchanges if its quotation is not among those Quoters considered most advantageous to the Government based on the solicitation criteria.
1.3 Quoter’s may be asked to clarify certain aspects of their quotation to resolve minor or clerical errors and will not constitute discussions.
1.4 Failure to submit any of the information requested by this solicitation may result in unfavorable quotation evaluation.
1.5 Upon receipt, all quotations become Government property. In accordance with FAR Subpart
4.8 (Government Contract Files), the Government will retain the original of all unsuccessful quotations.
1.6 Request for Quotation (RFQ) pricing for base and option period contract line items number (CLINs) 0001 – 4005.
1.6.1 The Quoter agrees to hold the prices in its quotation firm for 90 calendar days from the date specified for receipt of quotations unless another time period is specified in an addendum to the solicitation. Any quotation providing less that the specified acceptance period may not be considered acceptable and may not be considered for award.
1.7 The site visit date for this project is on August 22, 2022 at 10:00 AM EST. Quoters are strongly encouraged to attend to fully inform themselves about the location and conditions under which the work is to be performed. All participants will meet at the visitor’s center on the Gaithersburg campus (100 Bureau Drive, Gaithersburg, MD 20899). Please submit names of the participants by 10:00 AM EST on August 18, 2022 to Julie Morris at julie.morris@nist.gov.
2. INQUIRIES AND QUESTIONS
2.1 The Contracting Officer is the only approved point of contact for this acquisition.

2.2 All requests for clarification, inquiries, and questions concerning this solicitation shall be submitted in writing via e-mail to: julie.morris@nist.gov by 10:00 AM MST, August 26, 2022.
2.3 All questions and responses to questions shall be provided, in writing, without identification of the questioner. Questions and responses will be published to beta.SAM.gov in the form of an amendment to the solicitation. Even if provided in other form, only the question responses included in the amendment(s) to the solicitation will govern performance of the contract.

3. SOLICITATION RESPONSE REQUIREMENTS
3.1 The Government will assess quotations based on how well the quoters meet the factors and requirements outlined in this RFQ using the evaluation criteria and instructions therein.
3.1.1 Any quotation that does not meet the stated solicitation requirements may be considered ineligible for award unless the deficiency is corrected through discussions (See paragraph 1).
3.2 QUOTATION REQUIREMENTS
3.2.1 Quotations are expected to conform to solicitation provisions and be prepared in accordance with this section. To aid in evaluation, the quotation shall be clearly and concisely written, neatly presented, indexed (cross-indexed as appropriate), and assembled as required by this instruction to offerors. All pages of each part shall be appropriately numbered and identified with the name of the Quoter, the date of the quotation, and the solicitation number.
3.2.2 Format. Text shall be single-spaced, and able to fit on 8½” x 11”, with a minimum one-inch margin all around (should the Government need to print). Each page with content shall count as a single page. Pages shall be numbered consecutively. Text shall be no smaller than 11-point font. Bolding, underlining, and italics may be used to identify topic demarcations or points of emphasis. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have spacing and text that is easily readable.
3.2.3 Restriction of Disclosure/Proprietary Information. If the Quoter wishes to restrict the disclosure or use of its quotation, individual subcontractor/vendor proprietary information may be submitted via separate binders. The information contained in these binders must be referenced (by binder title, page, and section number as appropriate) within the main quotation where the information would have been included if it were not subcontractor/vendor proprietary. The information in these separate binders is subject to all other requirements of the RFQ, will be included in the page count for the appropriate volume, and must be well-marked to clearly indicate any special handling instructions.
3.2.4 The Quoter shall submit one (1) electronic version compatible with the Microsoft Office 2016 Software Suite and/or Adobe Acrobat (PDF), by email.
3.2.5 Submission Address. Quotes must be submitted via email to Julie Morris at julie.morris@nist.gov.
FACSIMILE QUOTATIONS ARE NOT AUTHORIZED
3.2.6 Submission Due Dates. Quotations must be received prior the date and time in block 8 of the SF 1449. Quotations received after this date and time are considered late and may not be accepted.
4. Factor A – Price Submittal Requirements
4.1 Factor A – Price, shall comply with the instructions in paragraph 3, above, and include the following documents (in the order listed):
4.1.1 The quoter shall complete and submit the Standard Form 1449, Solicitation/Contract/Order for Commercial Items: Complete Blocks 17a, 17b, 19, 20, 21, 22, 23, 24, 26, 30a, 30b, and 30c only. An official having the authority to contractually bind the Quoter’s company must sign the SF 1449 in accordance with the procedures prescribed in
FAR 4.102.
4.1.2 Acknowledge all solicitation amendments using one of the methods set forth in Block 11 of Standard Form 30, the form on which any amendment will be issued.
4.1.3 Complete all required representations and certifications.

5.2 Exceptions, Deviations, and/or Assumptions. This document shall identify and explain any exceptions or deviations taken to any part of the SOW or conditional assumptions made with respect to the technical requirements of the solicitation. Quoters should note that taking exceptions to the Government's requirements may indicate an unwillingness or inability to perform the contract, and the quotation may be evaluated as such.
5.3 Technical Capability Details shall include the following:
Submittal Requirements Contractors shall submit Technical Capability documentation which may include a narrative, charts, graphs, tables, and drawings. Technical Capability is defined as the contractor's demonstration of resources and capability to successfully conduct the requirements of the contract. The technical capability documentation should clearly describe, in sufficient detail, the contractor's resources which will be used to successfully fulfill the technical requirements identified in this RFQ. The documents may include product/ service literature.
If the prime Offeror is proposing a subcontractor or consultant(s) to perform any part of this work, the submittals shall provide documentation of a written agreement between the prime Offeror and the proposed subcontractor which identifies the agreement and the proposed work types.
6. Factor C - Past Performance
6.1 The past performance evaluation will assess the relative risks associated with a quoter’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the quoter’s record of past performance. In this context, “quoter” refers to the prime contractor. Present and past performance shall be evaluated as a measure of the Government’s confidence in the quoter’s ability to successfully perform based on previous and current contract efforts.
6.2 The quoter shall submit a completed Past Performance Questionnaire (PPQ) for two references for past performance of recent work performed within the last five (5) years, and shall be relevant to the complexity, size, and scope of this solicitation’s requirement.
6.3 Quoter’s shall reference the addendum to clause 52.212-2 for further details.
7. Confidential Information
The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of quoter qualifications and quotations submitted to Federal agencies. If a quoter's submissions contain information that they believe should be withheld from such requesters under FOIA on the grounds that they contain "trade secrets and commercial or financial information" [5 USC§552(b) (4)], the quoter should mark its submissions in the following manner "Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act.”

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision- Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit…
