THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES FOR CERTAIN COMMERCIAL ITEMS UNDER THE AUTHORITY OF FAR 13.

This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-01, dated January 22, 2019.

1352.215-72 INQUIRIES (APR 2010)

Offerors must submit all questions concerning this solicitation in writing to both the Contract Specialist forest.crumpler@nist.gov and the Contracting Officer Patrick.staines@nist.gov. Questions should be received no later than five calendar days after the issuance date of this solicitation. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, on the question responses included in the amendment to the solicitation will govern performance of the contract.

The associated North American Industrial Classification System (NAICS) code for this procurement is 333242 with a small business size standard of 1,500 employees.

This acquisition is available for Full and Open Competition.

BACKGROUND:

The National Institute of Standards and Technology (NIST) requires a quantity of seven (7) Resist Curing Hotplates to support nanofabrication in the Center for Nanoscale Science and Technology (CNST), NIST’s nanotechnology user facility. The system will be sited in a class 100 clean room in the CNST NanoFab and used as a shared resource accessible to researchers from industry, academia, NIST, and other government agencies. These tools are required for photoresist stabilization steps after photoresist coating, before and after exposure and developing. These processes create a stable surface polymer layer which does not deform under physical contact, can be printed with design pattern by lithography tool, and resist ion implantation and plasma etch damage. The wide varieties of material systems and volume of projects encountered in CNST NanoFab demand highly uniform, flexible, and readily available photoresist curing hotplate groups to provide researchers consistent patterns and efficient processing steps.

All items must be new. Prototypes, used or remanufactured equipment and components will not be considered for award.

All offerors shall provide a firm-fixed-price quotation for the Contract Line Items (CLIN) listed below.

CLIN 0001 - Resist Curing Hotplates, meeting the minimum requirements set forth below.

Minimum Requirements

1. GENERAL DESCRIPTION

a. High uniformity resist curing hotplate.

b. The system shall be bench-top stand-alone configuration.

c. System dimensions shall not exceed 350 mm Width, 500 mm Depth, 320 mm Height.

d. The system shall be compatible with Class 100 (ISO 5) clean room environment.

e. The system shall meet all safety standards set forth in the Semi S2-0709 standard.

f. The electrical utility requirement for the system shall be standard US 120 V, single phase, 50/60 Hz.

2. SYSTEM CAPABILITIES

a. Uniform temperature range: 50 °C to 250 °C with 0.1 temp.

b. Curing area: ≥ 200 mm x 200 mm.

c. Temperature non-uniformity over 200 mm x 200 mm area: ≤ ±0.5 %.

d. The heated surface shall be stainless steel or anodized aluminum material and has smooth surface finish preventing from resist trapping.

e. The main tool body should be stainless steel construction.

f. The surface of tool body should have proper heat insulation.

g. System shall have nitrogen-based proximity, vacuum and contact bake supporting wafer sizes from 75 mm to 200 mm.

h. System shall have lift-pins supporting SEMI-spec silicon wafer substrates ranging from 100 mm to 200 mm with 0.1 mm step resolution.

i. System shall include hinged lid with proper heat insulation (top surface should be cool for contact).

j. System software shall have user level control.

k. System software shall have operator-accessible temperature data recording.

l. PID temperature controller with digital set point/actual temperature display.

3. Documentation to include a User Manual and a Service Manual.

4. Delivery shall be FOB Destination and shall occur not later than 90 days ARO. These items are in great need, so a shorter delivery time will be given Greater Consideration.

Inspection/Acceptance Visual inspection upon receipt of goods.

Warranty The contractor shall warrant the entire system for a period of at least one year. The warranty must include unlimited telephone/e-mail support for questions regarding operation. All costs including parts, labor, travel, and other expenses necessary to repair the system will be borne solely by the contractor at no additional cost to the U.S. Government. Warranty shall commence upon acceptance of the requirement

FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

INSTRUCTIONS:

System for Award Management (SAM) Registration

In accordance with FAR 52.204-7, the awardee must be registered in the System for Award Management (www.sam.gov) prior to award. Refusal to register shall forfeit award.

DUE DATE FOR QUOTATIONS

Offerors shall submit their electronic quotations, via email, so that NIST receives them not later than 12:00pm Eastern Time on May 24, 2019. E-mail quotations shall be submitted directly to the Contract Specialist at forest.crumpler@nist.gov and the Contracting Officer at Patrick.staines@nist.gov.

Please reference the RFQ number in the subject line of email communications. Offerors quotations shall not be deemed received by the Government until the quotation is entered in the e-mail inbox set forth above.

Addendum to FAR 52.212-1, Quotation Preparation Instructions:

Technical Quotation (Vol. I), Past Performance/Experience (Vol. II), Price Quotation (Vol. III), Terms and Conditions (Vol. IV)

Incomplete quotations may be considered non-responsive and removed from further consideration. Quotations are expected to conform to solicitation provisions and be prepared in accordance with this section. To aid in evaluation, the quotation shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the offeror, the date, and the solicitation number.

Volume I - Technical Quotation:

The offeror shall submit an electronic technical quotation, via email. The technical quotation shall address the following:

Technical Capability:

The offeror shall provide documentation that demonstrates that the proposed service shall be capable of meeting or exceeding the minimum requirements.

The offeror must submit a technical response that fully demonstrates the ability to meet the needs of this requirement. Submitted response should include, but not limited to, all relevant information on the contractor’s ability to provide products that meet the specifications and a quantity that can meet the amount required to fulfill the agency’s needs.

Volume II – Experience and Past Performance:

Past Performance:

The offeror shall provide past performance information regarding relevant contracts over the past three years with Federal, state, or local governments, or commercial customers.

A list of references, preferably at least 3, if available, to whom the same or similar product has been provided. The list of references shall include, at a minimum:

1. The name of the reference contact person and the company or organization;

2. The telephone number and email address of the reference contact person;

3. The contract or grant number, the amount of the contract and the address and the telephone number of the Contracting Officer if applicable; the date of delivery or the date services were completed and a description of the equipment sold to each reference.

If the offeror has no relevant past performance, it may include a statement to that effect in its quotation. The government reserves the right to consider data obtained from sources other than those described by the offeror in its quotation.

Experience:

The offeror shall provide information which demonstrates the offeror’s experience in sucessfully providing similar Resist Curing Hotplates that met the required specifications and delivery dates.. The contractor shall provide a list of at least three similar awards for similar service supplied in the past five (5) years. Information shall demonstrate how the offeror provided similar services to those described in the statement of work.

Volume III - Price Quotation:

The offeror shall submit an electronic copy of the completed price quotation. The price quotation shall be separate from any other portion of the quotation. The offeror shall propose a separate firm-fixed-price, for each CLIN. Price quotations shall remain valid for a period of 90 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable).

Volume IV – Terms and Conditions:

Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b) (11)):

If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.

Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

FAR 52.212-2, EVALUATION - COMMERCIAL ITEMS (Oct 2014) The specific evaluation criteria to be included in paragraph (a) of that provision are as follows:

Evaluation Factors:

Award shall be made to the offeror whose quotation offers a Technically Acceptable quote that offers the best value to the Government. The Government will evaluate quotations based on the following evaluation criteria: 1) Technical, 2) Past Performance, 3) Experience and 4) Price.

Technical Capability: Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed service meets or exceeds all requirements in the Statement of Work. Quotations that do not demonstrate the proposed service meets all requirements will not be considered further for award. If an offeror does not indicate whether its proposed service meets a certain requirement, NIST will determine that it does not.

Past Performance: The Government will evaluate the Offeror's past performance information and, if appropriate, its proposed subcontractors' past performance to determine its relevance to the current requirement and the extent to which it demonstrates that the offeror has successfully completed relevant contracts in the past five years. In assessing the offeror's past performance information, NIST will evaluate contractor’s ability to deliver, in a timely fashion, the products meeting the stated requirement. Evaluation of this factor will be based on information contained in the technical portion of the quotation and information provided by references. The Government will evaluate past performance information by contacting appropriate references, including NIST references, if applicable. The Government may also consider other available information in evaluating the Offeror's past performance. The Government will assign a neutral rating if the offeror has no relevant past performance information.

Experience: NIST will evaluate the extent to which the offeror’s proposal demonstrates experience in successfully completing at least three (3) deliveries of the same or similar hotplates within the established delivery schedule.

Price: The Government will evaluate price for reasonableness.

(1) In accordance with Sections 744 and 745 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

NIST LOCAL-53 Contract Performance During Changes in NIST Operating Status Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), that will impact normal days of business operation, such as inclement weather, power outages, etc. In circumstances such as these, the Contractor must call the appropriate NIST campus status line to verify the operating status:

During a lapse in appropriation, access to Government facilities and resources, including equipment and systems, will be limited to excepted personnel for both Federal employees and Contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless you have been, or are notified that you are to work under an excepted status, you will automatically enter a temporary work stoppage. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at https://www.nist.gov/ and/or the NIST operating status lines. Additionally, Contractors are encouraged to monitor public broadcasts or the Office of Personnel Management’s website at www.opm.gov for the Federal Government operating status.

NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer’s Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.

Contractors with supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would cause the government to incur additional obligations during the lapse in appropriation may continue performance.
