This announcement constitutes the only solicitation; quotations are being requested, and a separate written solicitation document will not be issued. This solicitation is being issued under the authority of FAR Part 13 Simplified Acquisition Procedures.

This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-99, dated July 16, 2018.

The associated North American Industrial Classification System (NAICS) code for this procurement is 333517 with a small business size standard of 500 employees. This acquisition is 100% set-aside for small businesses.

The National Institute of Standards and Technology (NIST) requires an upgrade to it its OMAX Maxiem 1515 Waterjet including accessories, installation, and training in accordance with the attached Statement of Work.

Period of Performance:

Delivery, installation and training shall be 30 days after award.

SHIPPING/PLACE OF PERFORMANCE

The items shall be shipped F.O.B. Destination to:

The National Institute of Standards and Technology 100 Bureau Drive Building 231 Gaithersburg, MD 20899

FOB DESTINATION MEANS: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.

EVALUATION CRITERIA AND BASIS FOR AWARD

Award will be made to the Contractor whose quote is evaluated as technically acceptable, offers the lowest evaluated price, and is responsible within the meaning of FAR 9.104.

To be considered technically acceptable, the quote must be evaluated as acceptable for all of the following factors:

Factor 1 – Prior Experience NIST will evaluate whether the contractor has at least 2 years of prior experience servicing the OMAX equipment listed in the SOW-Appendix 1.

Factor 2 - Qualifications of Personnel NIST will evaluate the extent to which the Contractor’s quote demonstrates its ability to provide personnel with the requisite skills and experience to fulfill NIST’s requirements, as detailed in the SOW.

Factor 3 – Access to Replacement Parts and Software NIST will evaluate if the Contractor has demonstrated that it has access to the original equipment manufacturer’s replacement parts and software updates to perform the required upgrade. Lack of access will indicate the inability to perform the required upgrade.

Factor 4 - Price The price evaluation will determine whether the quoted prices are fair and reasonable in relation to the solicitation requirements. Quoted prices shall be entirely compatible with the technical quotations.

REQUIRED SUBMISSIONS

Contractors shall submit the following:

1. For the purpose of evaluation of Technical Acceptability:

• Documentation that confirms that the Contractor has at least two (2) years of prior experience servicing the OMAX equipment listed in the SOW-Appendix 1. If the Contractor lacks experience with a particular model/item in Appendix 1, the Contractor may describe its experience servicing technically comparable (in terms of fundamental design, function, and maintenance requirements) OMAX equipment in lieu of that specific instrument. Please note, however, that the determination of whether the equipment described is technically comparable is at the sole discretion of NIST; NIST may determine a Contractor’s quote technically unacceptable if the alternative equipment described is not considered technically comparable.

• Documentation which demonstrates the Contractor’s ability to provide personnel with the requisite skills and experience to fulfill NIST’s requirements.

• Documentation that demonstrates that the Contractor has access to the original equipment manufacturer’s replacement parts and software updates to perform the required services. A letter or certificate issued by the manufacturer verifying access is acceptable proof.

It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order. The provisions and clauses contained in Attachment 2 are applicable to this procurement and will be incorporated into the resultant award, if applicable.

5. Contractors shall provide an active DUNS # for the System for Award Management (SAM) registration.
