Source Selection Information – see FAR 2.101 and 3.104

Version 1.0

SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

NMAN21202201658

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants

Office (AGO), Resource Management and OMAO/Marine Operations/Marine Engineering Div.

2. Description of supplies or services required to meet agency needs (including the estimated value). Services are required of authorized Caterpillar diesel engine technicians to repair the No. 6 Diesel Generator set on board the NOAA Ship BROWN in Newport, RI 30 Aug

– 04 Sept 2022.

3. Identification of the single source or the brand name to be solicited.

Authorized OEM Caterpillar engine technicians and OEM factory parts are required for this requirement.

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

Brand Name – This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs.

Authorized OEM Caterpillar engine technicians are required for this requirement to ensure that the technicians have the appropriate technical knowledge for this specific engine including all recent and cumulative OEM notices and updates for this engine. A factory authorized contractor also has exclusive access to the Caterpillar worldwide network of parts.

Exclusive Licensing Agreement/Restrictive Rights/Authorized Reseller - The source has one or more of the following: an established exclusive licensing agreement, proprietary data, limited rights in data, patent rights, OEM required certifications or OEM authorized reseller, copyrights or secret processes with regard to the supplies or services required.

Caterpillar factory authorized contractors are the only contractors that have access to the Caterpillar worldwide network of parts. Many of the engine components are remanufactured by the Caterpillar. It is critical that these and all parts are Caterpillar certified parts to ensure the quality standards are met for remanufactured parts, and to also ensure any warranty work from the engine repairs is enforceable.

Urgency – The nature of the requirement has been deemed urgent due to unusual and compelling circumstances. Following competitive procedures would result in unacceptable delays resulting in serious injury to the Government.

The NOAA Ship BROWN will only be in port in Newport, RI for a limited time frame to repair this engine. The period of performance is 30 Aug – 04 Sept 2022. It is critical that this requirement be awarded to the contractor as soon as possible so that they are able

PAGE 13 OF 33 1333MK22QNMAN0034

Source Selection Information – see FAR 2.101 and 3.104 to schedule and prepare their technician and parts as possible to travel. It is therefore critical that the contract be awarded in such a manner that the contractor can have their technicians arrive on the day that the ship arrive. If this engine is not repaired before the ship’s scheduled departure date, it will severely impact the ship’s next mission and possibly subsequent missions. CASREP-RB-2021-08 applies.

5. Market Research.

At this time various CAT authorized repair contractors are being contacted about this requirement.

6. Technical/Requirements Representative Certification

I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.

Subsistence for lodging, meals and incidental expenses shall be reimbursed based on actual costs incurred only to the extent that they do not exceed on a daily basis, the maximum per diem rates in effect at the time of travel as set forth in the Federal Travel Regulations.

In the event that the Contractor cannot negotiate a lodging rate at or below the FTR rate, the Contractor shall submit a request for payment of actual lodging costs to the Contracting Officer for approval prior to incurring any charges for lodging.
