PERFORMANCE WORK STATEMENT
Vessel Monitoring System (VMS) transceiver hardware installation, maintenance, repair, and replacement for NOAA/Office of Law Enforcement/Pacific Islands Division
1.0 Organization
The Pacific Islands Division (PID) of the Office of Law Enforcement (OLE), National Marine Fisheries Service (NMFS), National Oceanic and Atmospheric Administration (NOAA), Department of Commerce (DOC), is a government agency charged with the mission of enforcing laws, regulations and conservation measures supporting stewardship for living marine resources.
2.0 Background
The PID provides administrative and technical support to operate the Pacific region portion of the national Vessel Monitoring System (VMS) used to track commercial fishing and other vessels required by Federal Regulations for the purpose of fisheries enforcement. Under regulations at CFR Title 50, Subpart A, Section 665.19, OLE is required to procure, install, maintain, repair and replace VMS transceivers for Hawaii Longline Limited Entry permit holders. A critical component of this task is to conduct reasonable, regular, sustainable, life-cycle installation, maintenance, repair and replacement of VMS hardware.
2.1 Scope
NMFS Office of Law Enforcement (OLE) has been operating a Vessel Monitoring System (VMS) since approximately 1994 in accordance with applicable U.S. laws and Federal regulations. The Pacific Islands Division (PID) in Honolulu, Hawaii is currently responsible for approximately 160 VMS units on commercial fishing (and a few non-fishing) vessels in the Hawaiian, American Samoan, Western and Central Pacific areas / fisheries. Many of these VMS units are beyond their warranty period. All of the manufacturers that sell VMS hardware to this fleet are located more than 2,500 miles from Hawaii. To address these circumstances, it is necessary to pay a local marine electronics vendor for removal of old VMS units, installation of new VMS units, and frequent service (to include occasional replacement parts) within and outside normal warranty-covered provisions.
PID currently plans to continue its “VMS lifecycle replacement program” for the foreseeable future, under which approximately 30 new units are procured each year to replace aging or malfunctioning inventory. This will require the vendor to install and ensure activation of these VMS units as specified below.
2.2 Benefits
Implementation of this proposal now will ameliorate deteriorating VMS maintenance, operational and fiscal issues. Operationally, implementation of this proposal will ensure compliance of the regulated commercial fishing fleets with relevant VMS federal regulations, and importantly, do so without impeding their legitimate commerce / livelihoods.
3.0 Service Required
The requirements to meet our objectives shall include the following (all work performed on vessels at piers in Honolulu, the vendor’s facility, and / or as otherwise mutually agreed, unless specified otherwise):
A. Professionally install new NMFS-OLE-type-approved VMS units that are provided by PID on vessels upon direction by authorized PID staff (see service response standards in paragraph F below).
B. Remove existing VMS units from vessels upon direction by PID staff.
C. Coordinate with PID VMS staff, and if necessary, the manufacturer of newly-installed units (or serviced units) to ensure that the units are properly activated and operationally performing in accordance with PID requirements.
D. Perform warranty assessments (covered by manufacturer’s warranty or not) upon request by PID.
E. Perform other assessments, maintenance, repair, or replacement labor, and when specifically required by
PID, provide materials sufficient to service VMS units on specified vessels.
F. Performance Standards and Evaluating Factors.
1. For vessels new to the fishery, VMS unit installation shall be completed (installed and operational on the designated fishing vessel with position reports being verifiably received by OLE PID) within 8 working days of notification by OLE PID (see notification response requirements below). This is expected, based on past data, to be less than 10% of required service.
2. For vessels requiring replacement of an existing VMS unit, installation shall be completed normally within 3 working days (but not to exceed 5 working days) of notification by OLE PID.
This is expected, based on past data, to be more than 50% of required service.
3. All other service shall be completed within a mutually-agreeable time frame (not to exceed 8 working days of notification by OLE PID).
4. Included at no additional charge, returning to OLE PID (or making available for pick-up by PID) of any previously-installed (ie.“replaced”) government-owned VMS unit (and if requested, associated cabling / equipment).
5. An established relationship with manufacturers of the sub-set of type-approved VMS units installed and operating on vessels whose VMS is managed by PID will be necessary. PID is currently limited by Federal Regulations to the most-recently type-approved VMS units are currently the only hardware certified by the Pacific Islands Fisheries Science Center (PIFSC) for the electronic logbook (“e-forms”) program / software which became mandatory in this region in July 2021. Outside of warranty service will require close coordination with PID VMS staff, who will request service, respond to queries, and coordinate and facilitate government payment for outside-of-warranty work for requested service. Certification from the suppliers of previously-installed VMS hardware (currently, Skymate and Woods Hole Group/CLS) by the contract date, to perform warranty assessment and service on their hardware, is required.
6. The vendor shall generally be required to adhere to the following notification response standards during PID’s normal duty hours (M-F 8 am - 4:30 pm)
i. Shall verbally respond to PID phone calls requesting service the same day if the call is before noon, or by noon the following day if the call is made after noon.
ii. Shall respond by email or phone to emailed service requests within 24 hours of the email being sent by PID.
