This is a Request for Proposal (RFP) for a commercial item using FAR Part 13, Simplified Acquisition Procedures. The provision at 52.212-1, Instructions to Offerors—Commercial, applies to this acquisition as supplemented with addenda below.
This RFP is 100% set-aside for small business concerns. The associated North American Industry
Classification System (NAICS) code is 237310,Highway, Street, and Bridge Construction , with a small business size standard of $36.5 M. The RFP will result in award of a firm-fixed-price contract.

In response to this RFP, the Offeror shall prepare a detailed quote for meeting all stated requirements and comply with the following limitations and characteristics:
• Margins (Top, Bottom, Right and Left) no smaller than 1" (headers and footers are allowed in the margins)
• Submission shall be provided in electronic format
• Arial size 11 font or Times New Roman 12 font shall be used with Arial size 9 font or Times New Roman 10 font permitted for tables and graphics.
• Offers shall be submitted in a format readable by Microsoft (MS) Word 2007, MS Excel 2007, or in text searchable PDF format, as applicable.
• Proposals shall be subdivided into sections as follows: Section 1 Technical Quote, Section 2 Past Performance Information, Section 3 Price Quote and Section 4 Supply Chain Risk Assessment Information.
o Combined, sections 1 and 2 of the proposal shall be limited to a total of twenty pages (20). A cover letter/page, table of contents, blank page section dividers, and resumes for Key Personnel are excluded from this total page count.
o Section 3 of the quote has no page limits.
o Section 4 of the quote has no page limits.
• Separate electronic files shall be submitted for the quote sections as follows:
o One file consisting of both Section 1, Technical Quote and Section 2, Past
Performance Information;
o One file consisting of Section 3, Price Quote;
o One file consisting of Section 4, Supply Chain Risk Assessment Information.

The government requires all contractors doing business with the government to be registered with the System for Award Management (SAM). For additional information and to register in SAM, a free service, please access the following website: www.sam.gov 1-866-606-8220. In order to register with SAM and to be eligible to receive an award, all offerors must have a Dun & Bradstreet number, which may be acquired free of charge by contacting Dun & Bradstreet on line at http://fedgov.dnb.com/webform or by phone at 1-866-705-5711. All offerors must have submitted their Representations and Certifications using the on-line Business Partner Network (BPN) at https://www.sam.gov . The BPN is the single source for vendor data for the federal government. Award will not be made to any contractor that is not registered in SAM.
1.2 52.212-1 Instructions to Offerors—Commercial Items (JAN 2017)
(a) North American Industry Classification System (NAICS) code and small business size standard is 237310, Highway, Street, and Bridge Construction , with a small business size standard of $36.5 M.
However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 18, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-
3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 18 include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than
5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror’s name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

2.0 Communications and Questions/ Site Visit
2.1 Solicitation Communications and Questions
Communications shall be conducted electronically by e-mail to Contract Specialist with a copy to the Contracting Officer identified in section 1 above.
The due date for communications and questions concerning this RFP is 27NOV2018, 10:00AM Eastern Standard Time (EST). Questions received after the cut-off date will generally not be considered.
Any information given to one Offeror concerning this requirement will be furnished at the same time to other prospective Offeror, if that information is necessary in submitting offers, or if lack of it would be prejudicial to the other prospective Offeror.

3.0 Quote Organization
Quote materials will be organized as follows: Section 1 Technical Quote, Section 2 Past Performance Information, & Section 3 Price Quote. All Sections are to be clearly separated from the other (i.e, page mailto:jgofus@doc.gov mailto:AKram@doc.gov
10 | P a g e break, blank page divider, etc). Each Offeror shall provide all price information only in the Price Proposal. The Technical and Past Performance sections shall not contain any price information.
To be acceptable, the proposal must meet all of the constraints set forth in the Performance Work Statement (PWS).
3.1 Section 1 Technical Quote
This volume addresses the technical aspects of the requirement. It shall indicate the firm’s capabilities and the means used to satisfy the requirements stated in the attached Performance Work Statement.
Reference the PWS Section 3, Requirement for specifics of the Government’s requirements for this service. In the technical proposal the offeror shall address its understanding of, and approach towards, fulfilling the requirements to include the following:
The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform this requirement.
3.2 The Contractor shall monitor performance in accordance with the approved Quality Control Plan (QCP). The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is the means by which they will ensure work complies with the requirements of the task order.
3.3 The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
When hiring personnel, the Contractor shall consider the stability and continuity of the workforce are essential.
3.4 Remove damaged caulking, traffic coating, and markings in the areas identified below and replace in accordance with the specifications herein.
A. All products must be manufacturer certified for compatibility with the existing coating system described above. All products shall be installed per manufacturer recommendations and the requirements herein.
B. The contractor will remove all damaged traffic coatings in the area contracted down to exposed concrete. The contractor shall test the exposed concrete for humidity per manufacturer requirements on their submitted traffic coating material. Installation shall only take place if concrete humidity, condition, and weather are in accordance with manufacturer requirements.
The contractor shall provide blowers or other means to dry the concrete if necessary. The contractor shall provide written notice to the Contracting Officer’s Representative (COR) by email of the actual humidity levels in the concrete and weather conditions at the time of installation.
C. The contractor shall clean and prepare the concrete surface and adjacent existing traffic coating in accordance with manufacturer requirements immediately before installation of the first layer of the new coating.
D. The contractor shall apply the new coating with overlap of at least twelve (12) inches over the existing traffic coating or as recommended by the manufacturer, whichever is larger.

E. For caulk replacement, apply a root inhibitor chemical to the concrete joint before installing new backer rod or caulking.
F. The contractor shall re-mark traffic striping patterns as necessary where they are impacted by repairs to the traffic coating. Color and pattern shall be the same as the existing markings.
G. Contractor shall schedule work with the COR at least five (5) working days in advance to accommodate the courtyard being closed during their work. The courtyard may be shut down starting at 9 PM on a Friday night and must be available for unfettered use by the Department of Commerce by 4 AM the following Monday. The contractor shall only perform work in the courtyard while the courtyard is closed to avoid vehicle damage.
H. The specific areas and quantities of repairs are shown in Figure 1. The total required repairs are:
a. Replace 750 square feet of bubbling traffic coating
b. Replace 400 linear feet of joint caulking
The Technical Quote shall fully discuss how the contract requirements will be met and the means used to accomplish them. Merely repeating the contract requirements and stating that they will be accomplished, without discussing how the offeror will accomplish them, is not acceptable.
3.2 Section 2 Past Performance Information
This volume addresses the offerors past performance as it relates to the requirement. The offeror shall submit data for past performance for relevant work completed or substantially performed within the past 36 months.
The offeror shall provide documentation outlining relevant past performance with contracts, as a prime or major subcontractor, which is the same or similar in nature, size, and complexity to the services being procured under this solicitation. Non-Government contracts may be used if Government contracts are not available. Offeror may provide performance information of predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement when such information is relevant. The documentation shall be submitted in the following format:
• Contract Number, Award Date and Contract type,
• Cost/Price – original awarded AND final (or projected final, if contract is active),
• Delivery Schedule – original AND final (or projected final, if the contract is active),
• Name, telephone number, fax number and e-mail address for the following:
▪ Contracting Officer (CO)
▪ Government Technical Representative or COR/COTR
• Identify in specific detail for each contract listed, why or how that effort is considered relevant or similar to the effort required by this solicitation. In determining relevancy, consideration should be given to such things as product/service similarity, size and complexity, contract type, contract environment, division of company proposing, and subcontractor interaction,
• A narrative explanation on each contract listed describing the objectives achieved and any cost growth or schedule delays encountered. For any contracts which did not/do not meet original requirements with regard to cost, schedule, or technical performance, a brief explanation of the reason(s) for such shortcomings and any demonstrated corrective actions taken to avoid recurrence, 12 | P a g e
• A copy of any cure notices or show cause letters received on each contract listed and a description of any corrective action by the offeror or proposed subcontractor,
• Description of any Termination or Termination proceedings for contracts that required work similar to that required by this solicitation. Detail circumstances leading to Termination proceedings and final outcome.
Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested herein remains with the offeror. Proposals that do not contain the information requested by this section are at risk for rejection or a less than acceptable performance rating by the Government. In the case of an offeror without any relevant past performance history, past performance will be evaluated as “neutral.” A neutral rating is neither an advantage nor disadvantage to the Offeror. Offerors with no past performance may provide the equivalent information on company officials and/or personnel proposed for this action.
All past performance comments received will be taken into account and could affect the overall rating.
The overall past performance evaluation is a subjective decision based on the whole of all data received.
If the past performance information is negative and the contractor has not previously had an opportunity to provide a response to the government evaluation, the contractor will be given an opportunity to provide rebuttal.
3.3 Section 3 Price Quote
This volume consists of the pricing and business terms associated with the offer to enter into a contract to perform the desired work. It includes a completed pricing table using the format provided below. It also includes a completed Representations and Certifications package containing offeror representations and certifications under 52.212-3, Offeror Representations and Certifications– Commercial Items (see Attachment 2). Additionally, it includes all solicitation amendments acknowledged in accordance with the solicitation and any other required administrative information.
The offeror shall submit sufficiently detailed information in the price proposal to permit the Contracting Officer and authorized representatives to evaluate the offer for fairness and reasonability.

4.0 Evaluation Factors
4.2 EVALUATION CRITERIA
Offerors are required to submit technical proposals addressing the Evaluation Factors 1-4 identified below. Proposals will be evaluated for acceptability, but not ranked using the non-cost/price evaluation factors. This procurement is being conducted utilizing a Lowest Price Technically Acceptable (LPTA) source selection process in accordance FAR 15.101-2. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. There shall be no trade-offs.
Note that offers that are not Technically Acceptable cannot be selected for award, regardless of Price. Technically acceptable shall consist of meeting all of the acceptability standards listed below.
Standard 1: Technical Compliance
- The contractor’s technical assessment demonstrates technical knowledge and details approaches that ensure it addresses all of the work described in the performance work statement are completed as specified therein.
Standard 2: Technical Capability
- The contractor provided information demonstrating that they successfully performed removing damaged caulking, traffic coating, and markings in the areas identified and in accordance with the specifications in the PWS within the last five (5) years that are similar in size, scope and complexity as outlined in the performance work statement.
Standard 3: Contractor Experience and Personnel Qualifications
Minimum five (5) years documented and demonstrated experience in removing damaged caulking, traffic coating, and markings outside of a historic building.
- Contractor’s Supervisors must have no less than five (5) years of experience in managing staff in removing damaged caulking, traffic coating, and markings outside of a historic building.
- The contractor’s personnel must have no less than three (3) years of experience performing removing damaged caulking, traffic coating, and markings outside of a historic building.
- Past performance information is to be provided from two (2) references for removing damaged caulking, traffic coating, and markings outside of a historic building. The Government reserves the right to fully investigate all relevant past performance information.

The following factors will be used to evaluate quotes.
(1) Technical
The offeror's approach to performing contract requirements and its capability to successfully perform the contract will be evaluated. The quote will be evaluated based on the extent to which it demonstrates an understanding of and the capacity to fulfill the requirements including the following elements as applicable:
Remove damaged caulking, traffic coating, and markings in the areas identified below and replace in accordance with the specifications herein.
A. All products must be manufacturer certified for compatibility with the existing coating system described above. All products shall be installed per manufacturer recommendations and the requirements herein.
B. The contractor will remove all damaged traffic coatings in the area contracted down to exposed concrete. The contractor shall test the exposed concrete for humidity per manufacturer requirements on their submitted traffic coating material. Installation shall only take place if concrete humidity, condition, and weather are in accordance with manufacturer requirements. The contractor shall provide blowers or other means to dry the concrete if necessary. The contractor shall provide written notice to the Contracting Officer’s Representative (COR) by email of the actual humidity levels in the concrete and weather conditions at the time of installation.
C. The contractor shall clean and prepare the concrete surface and adjacent existing traffic coating in accordance with manufacturer requirements immediately before installation of the first layer of the new coating.
D. The contractor shall apply the new coating with overlap of at least twelve (12) inches over the existing traffic coating or as recommended by the manufacturer, whichever is larger.
E. For caulk replacement, apply a root inhibitor chemical to the concrete joint before installing new backer rod or caulking.
F. The contractor shall re-mark traffic striping patterns as necessary where they are impacted by repairs to the traffic coating. Color and pattern shall be the same as the existing markings.
G. Contractor shall schedule work with the COR at least five (5) working days in advance to accommodate the courtyard being closed during their work. The courtyard may be shut down starting at 9 PM on a Friday night and must be available for unfettered use by the Department of Commerce by 4 AM the following Monday. The contractor shall only perform work in the courtyard while the courtyard is closed to avoid vehicle damage.
H. The specific areas and quantities of repairs are shown in Figure 1. The total required repairs are:
a. Replace 750 square feet of bubbling traffic coating

b. Replace 400 linear feet of joint caulking
(2) Past Performance
The offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, cost management, communications between contracting parties, proactive management and customer satisfaction.
Past Performance will be determined to be relevant if the performance involves work performed within the past three (3) years that is the same or similar in nature, size, and complexity to the services being procured under this solicitation.
The Government reserves the right to assess the past performance of proposed subcontractors.
The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the offeror, the agency’s knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.
If an offeror does not have a history of relevant past performance, or indications of unsatisfactory performance in general, the offeror will receive a neutral past performance rating. A neutral rating is an Acceptable rating.
(3) Price
Proposed prices will be evaluated but not scored. The price evaluation will determine whether the proposed prices are complete and reasonable in relation to the solicitation requirements and market rates. Proposed prices must be entirely compatible with the technical quote and consistent with the pricing requirements listed in this solicitation.
Proposals will be reviewed for page limitations. Pages exceeding the page limitation will be eliminated from evaluation.
A proposal receiving an “Unsatisfactory” or “Fail” rating in one or more factors may be removed from further consideration for award or continued evaluation.
The Government reserves the right to award without discussions if the Contracting Officer determines that the initial offer is fair and reasonable and that discussions are not necessary.
