Performance Work Statement National Oceanic and Atmospheric Administration (NOAA)

NOAA FISHERIES

SEFSC - FSD

Logbook Data Entry, Document Scanning, and Data Verification

NF-FN7510-22-00644

I. Introduction/Background:

The National Marine Fisheries Service (NMFS) has been delegated the authority and responsibility for stewardship of the Nation’s marine resources. This authority was first granted in the Magnuson-Stevens Fishery Conservation and Management Act (FCMA) of 1976. The Southeast Fisheries Science Center (SEFSC), Fisheries Statistics Division (FSD), Commercial Fisheries Monitoring Branch, (CFMB) acting as a designee under this authority of NMFS has promulgated separate data collecting programs that require specific types of record keeping and data submissions for each Fishery Management Plan (FMP). The data collection programs typically rely on paper questionnaires or data forms that are completed by the fisherman and returned to the CFMB. The CFMB is responsible for providing reliable and accurate information from the fishing industry and communities, specifically the collection of fishery dependent catch and effort data from commercial fishers operating in the Southeast region of the United States (US). This region includes the following states: Alabama, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, and Texas. The mission of the SEFSC is to use information provided by CFMB and provide the scientific advice and data needed by NMFS to effectively manage the living marine resources of the Southeast region.

Data is collected using paper questionnaires completed by the fishing community. This project is to scan documents, enter data, verify data entry, and transfer verification of entered information forms to a database.

II. Objectives:

SEFSC is seeking an outside contractor for single page document scanning, data entry, data verification, and secure data transmission of fisheries dependent catch and effort data collected in the Southeast US. National and international Fishery Management Organizations such as, but not limited to, The International Commission for the Conservation of Atlantic Tunas (ICCAT), South Atlantic Fishery Management Council (SAFMC), and the Gulf of Mexico Fishery Management Council (GFMC), utilize the data for scientific analyses that support critical conservation and management decisions. The data is needed for Fishery Management planning. Fisheries Management is an integrated process of gathering information, data analysis, consulting and decision-making, budgeting, and the implementation of techniques and strategies used to ensure continued productivity of the fishery. Ultimately, Fisheries Management helps sustain productive fisheries, provide safe sources of seafood while protecting endangered species and marine mammals.

PAGE 6 OF 87 1305M322QNFFN0019

III. Scope of Work

The SEFSC Logbook Department has five (5) unique reporting programs. Each program uses a different logbook form type for reporting. The logbook forms are pre-printed questionnaires that are answered by permit holders who are required to submit one or more forms after each fishing trip. This statement of work is for weekly logbook data entry services for the following five (5) expected reporting program forms:

● SE Coastal Fisheries Trip Report Form (Attachment 1)

● No-Fishing Reporting Form (Attachment 2)

● Supplemental Discard and Gear Interaction Trip Report Form (Attachment 3)

● Atlantic Highly Migratory Species (HMS) Logbook - Set forms (Attachment 4)

● Captain’s Daily Fishing Report Form (Menhaden) (Attachment 5)

All logbook forms listed above will be provided to the contractor in hard copy, individual sheets of paper (with individual tracking numbers) in file folders containing approximately 100 forms per folder. Each batch will contain approximately 3 - 12 folders, 1 batch for each of the 5 programs listed above. SEFSC will send batches of forms for up to five (5) logbook programs weekly. The volume of forms to be key-entered per batch will vary by program/form type depending on changes in completed fishing trips, seasonal openings, weather, etc. The volume per batch is expected to range from 300 to 1,200 forms per week. The number of keystrokes per form is variable depending on the number of different species of fish that are caught, the number of gear, and the number of fishing areas. Depending on the type of form, the number of keystrokes per form can vary from 20 to

200. Completed forms are considered Confidential Data and a blanket non-disclosure agreement (NDA) between SEFSC and the contractor will be required. See appendices for expected logbook forms from data collection programs.

Upon receipt of the batch, the contractor shall provide one (1) database containing approximately 1,000 records and approximately 1,000 images depending on the batch size. The contractor shall link all records and images by the tracking number. Data and images will be transferred via Secure File Transfer Protocol Server (SFTP).

IV. Tasks

a. Task A – Scanning Reporting Forms

1. Description: Scan above referenced reporting forms received from SEFSC on a weekly basis and return images as a .tif image file saved using a naming nomenclature that corresponds to the tracking number from the scanned form. The SEFSC will provide the form specific nomenclature;

2. Deliverable: Within 5 business days for jobs consisting of less than 50,000 keystrokes; 10 business days for jobs greater than 50,000 keystrokes, but less than 500,000. Provide an electronic, readable pdf file for each scanned form. These scanned pdf files shall be delivered via a secure site for electronic file transfer in pdf format. An email notification shall be provided to the project lead upon completion of the electronic batch file transfer.

b. Task B – Data Entry

1. Description: Enter data contained on all reporting forms received into a Microsoft Access template provided by SEFSC;

2. Deliverable: Within 5 business days for jobs consisting of less than 50,000 keystrokes; 10 business days for jobs greater than 50,000 keystrokes, but less than 500,000, all data shall be entered into the Microsoft access template and submitted via electronic batch file transfer of the database via a secure site for electronic file transfer in Microsoft Access format and .tif. An email notification will be provided to the Project Lead upon completion of the file transfer.

PAGE 7 OF 87 1305M322QNFFN0019

c. Task C – Batch Submission

1. Description: Transfer files via a SFTP, a software application which enables the transfer of files from one computer to another, containing reporting forms data to the SEFSC. The SEFSC will verify accuracy data entry;

2. Deliverable: Data will be transferred with at least 96% accuracy; Error rate must be less than 4%. This rate will be calculated as fields in error divided by total data fields entered. An error is determined from automated programs that compare keyed data to list and ranges of acceptable entries, and by spot-checking data listings by SEFSC personnel. Per quarter, SEFSC will conduct a 100% audit of all forms delivered during a haphazardly selected week to assess accuracy of data. The contractor will be provided the editing tables and ranges for pre-submittal Quality Assurance/Quality Control (QA/QC).

The contractor shall work with NOAA Fisheries staff from the SEFSC to update and revise editing procedures. All new quality control processes must be approved by NOAA Fisheries prior to implementation. Failure to meet the error rate criterion will necessitate re-keying by the awardee at no expense to the government;

d. Task D – Resolution of Errors

1. Description: Deliver all data and scanned images using a Secure File Transfer Protocol (SFTP) link provided by the contractor in accordance with Tasks A, B, and C; The SEFSC has sixty (60) calendar days to inspect and accept the batch of work after delivery. If the contractor is notified of a problem within the 60 day time period the contractor will resolve the problem at no cost to the government. After 60 days the batch will be considered acceptable. Notification of data related issues will be done via email exchange between the SEFSC Lead and/or the Contract COR and an identified awardee representative.

2. Deliverable: The contractor will retain a backup copy of submitted batches for at least 60 days to confirm acceptance. The contractor shall make corrections to data not meeting the 96% accuracy rate within 14 days of notification. The corrections shall be submitted in the same manner as indicated in tasks A, B & C.

e. Task E – New Reporting Form(s)

1. Description: As needed, the contractor shall work with SEFSC to create new reporting forms by establishing protocol, scanning, data entry, and delivery. Reporting forms may be structured or unstructured. Fixed unit rate (CLIN 0002, 1002, 2002, 3002 and 4002) is by project and may increase by 10%-20% over a year; will result in a bilateral modification. The rate will be negotiated on a form-by-form basis. Examples of the types of forms and the record layout (data templates) are appended.

2. Deliverables: Capability to create new reporting form(s) on an as needed basis. The new reporting form(s) will abide by tasks A-D.

The contractor working with completed SEFSC forms must provide a signed non-disclosure agreement with the SEFSC prior to delivery to awardee of initial form delivery. Updates to this form will be required as Policy dictates.

Post-award and prior to first form delivery, contractor program staff and SEFSC must meet with SEFSC programmers/staff for initial database setup. This meeting is expected to be virtual. During option year (if executed), a meeting between SEFSC and awardee must occur within 30 days of the start of Option Period 1 to discuss and resolve any annual data entry or database maintenance needed. Additionally, a mutually agreeable framework for alterations to data entry protocols will be developed during the initial post-award meeting.

Contractor shall provide proficient communication in the following ways: 1.) contact person or data manager made available for these services; 2.) return phone calls and emails within 2 business days; 3.) requests for altered protocol must be observed and maintained over time;

PAGE 8 OF 87 1305M322QNFFN0019

The degree to which the quotation demonstrates an understanding of the requirements will be evaluated, as well as the offeror's planned management of consultants and subcontractors, if applicable.

(b) Evaluation Factor 2: EXPERIENCE. The offeror's background, experience, and qualifications will be assessed to determine the likelihood that that offeror can successfully perform the contract requirements and the degree of the risk of non-performance.

Offorer must have experience providing fisheries and/or other wildlife data and digital imaging to government agencies or scientific organizations.

(c) Evaluation Factor 3: PAST PERFORMANCE. The offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, effective management of subcontractors, cost management, level of communication between the contracting parties, proactive management and customer satisfaction.

Offeror shall provide at least three (3) past performance references. Provide name, address, phone number, and name of the project.

The Government will conduct a past performance assessment based on the quality of the past performance of the contractor on similar contracts as it relates to the probability of successful accomplishment of the required effort.

The Government will use its discretion to determine the sources of past performance information used in the evaluation. Information utilized will be obtained from the references listed in the quote, other customers known to the Government, and others who may have useful and relevant information. Information will also be considered regarding any significant subcontractors and key personnel, who may be referenced on Attachment No.6.

Offerors shall provide a listing of customers to which Past Performance Questionnaire forms were distributed.

The list must contain the firms’ names, the representative to whom the form was provided, a telephone number of the contact and an email address. Your customers are requested to complete the Past Performance form and submit the form by email directly to the Contract Specialist and Contracting Officer noted below.

If an offeror does not have a history of similar or relevant past performance, or if it is not available, it should be noted as such in the quote.

NOTE: Upon completion of the form, the customer shall return it to:

DOC, NOAA, Western Acquisition Division by email to:

Contract Specialist – Jamie Abu Shakrah, Jamie.AbuShakrah@noaa.gov Contracting Officer – Carina Topasna, carina.topasna@noaa.gov

Please Note: Any Exceptional, Marginal or Unsatisfactory rating assessed by the customer on individual elements or overall rating assigned on the past performance questionnaire, shall include an explanatory narrative to be provided in the remarks block. These narratives need not be lengthy, just adequately detailed to support evidence of the specific ratings noted above. Failure to provide information supporting the assigned rating may result in a lower rating being designated than that assigned by the customer.

Offerors shall make every effort to ensure that forms are received no later than the submission date stated in the solicitation for the quote in order to be considered for evaluation of this factor.

If an offeror does not have a history of relevant past performance, or if past performance information is not available, the offeror will receive a neutral past performance rating.

(c) Business/Price Quote Instructions

Business/Price quotes must adhere to the pricing structure established in the Price Schedule. See Section v.

The quote must include a price for all Contract Line Item Numbers (CLINs).

Any acceptance period entered on the quote form by the offeror shall not be less than forty-five days, which shall apply if no other period is offered.

The person signing the offer must have the authority to commit the offeror to all of the provisions of the quote, fully recognizing that the Government has the right, by terms of the Solicitation, to make an award without discussion if it so elects.

PAGE 13 OF 87 1305M322QNFFN0019

FAR 52.229-11 TAX ON CERTAIN FOREIGN PROCUREMENTS-NOTICE AND REPRESENTATION (JUN 2020)

(a) Definitions. As used in this provision—

Foreign person means any person other than a United States person.

Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area.

United States person as defined in 26 U.S.C. 7701(a)(30) means

(1) A citizen or resident of the United States;

(2) A domestic partnership;

(3) A domestic corporation;

and

(ii) One or more United States persons have the authority to control all substantial decisions of the trust.

(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.

(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror would claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.

(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that

(1) It [_] is [_] is not a foreign person; and

(2) If the Offeror indicates "is" in paragraph (d)(1) of this provision, then the Offeror represents that—I am claiming on the IRS Form W-14 [__] a full exemption, or [__] partial or no exemption [Offeror shall select one] from the excise tax.

PAGE 18 OF 87 1305M322QNFFN0019

(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then—

(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract;

and

(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.

(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.

(g) A taxpayer may, for a fee, seek advice from the Internal Revenue Service (IRS) as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Technical capability of the services offered to meet the Government requirement: The quotation will be evaluated on how the offeror intends to organize, staff and manage the contract and the means that will be used to accomplish the contract requirements. The degree to which the quotation demonstrates an understanding of the requirements will be evaluated, as well as the offeror's planned management of consultants and subcontractors, if applicable.

(2) Past performance:

Past Performance. The offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, effective management of subcontractors, cost management, level of communication between the contracting parties, proactive management and customer satisfaction. The Government reserves the right to assess the past performance of proposed subcontractors.

The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the offeror, the agency's knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.

If an offeror does not have a history of relevant past performance, or if past performance information is not available, the offeror will receive a neutral past performance rating; however, an offeror without a history of relevant past performance may receive a lowered rating for the experience evaluation factor.

(3) Price:

The proposed prices will be evaluated but not scored. The price evaluation will determine whether the proposed prices are complete, and reasonable in relation to the solicitation requirements. Proposed prices must be entirely compatible with the technical proposal.
