SOLE SOURCE JUSTIFICATION

FOR AN ACTION EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

USING SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS

(AUTHORITY: FAR 13.501(a), 41 U.S.C. 1901)

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office {AGO), Western Acquisition Division {WAD) and National Weather Service, Office of Observations, Radar Operations Center {ROC).

2. Nature and/or descr iption of the action being approved.

This is a sole source justification for a new requirement to repair Signal Processor Interface Panels (SPIPs) which are still under warranty. The Purchase Request number is NWWG1300-19-00440. The forthcoming contract is anticipated to be an Indefinite Delivery Indefinite Quantity {IDIQ) contract with firm fixed price task orders. The Government will solicit direct to United States Technologies (UST).

3. Description of supplies or services required to meet the agency's needs (including the total estimated value).

The WSR-88D NEXRAD program procured 220 SPIPs from UST in September 2015.

These SPIPs were manufactured to a Government design and delivered with a 5-year warranty. The WSR-88D program began to experience premature failures of these SPIPs. When the SPIPs were returned from the National Reconditioning Center (NRC) to UST for warranty repair, it was discovered that many of the failed SPIPs had been subjected to lightning strikes. Upon further investigation, the Government discovered that the lightning suppression circuitry in the SPIP was not sufficient. The Government developed a fix to this design deficiency. All of the SPIPs are under warranty and must be returned to UST when they fail. Units that are determined to have failed due to lightning strike are not covered under the warranty. UST must be compensated for repairing these units by implementing the design change developed by the Government. The design change replaces the typically failed components with more robust components. The SPIPs that fail for any reason cannot be repaired by another commercial entity without voiding the warranty with UST.

The purpose of this procurement is to contract repair services from UST for the SPIPs that (1) are still under warranty, and (2) fail due to lightning strike or any other non standard operating condition. UST will evaluate each SPIP returned for warranty repair and identify those that were caused to fail due to lightning strike or other non-warranted conditions. UST shall provide failure analysis that concludes that the failure was due to a lightning strike or other non-warranted condition and provide a price quote to repair each such SPIP. The IDIQ's contract maximum is $XXXXXXXX to cover any additional SPIPs requiring similar repairs up through the end of the warranty period in 2023. The period of performance will include a five year ordering period.
