OVER AND ABOVE ITEMS:
The Contractor is responsible for documenting and reporting all discrepancies found during PMI inspections or servicing. Any equipment item or component that has not reached its recommended service life, but fails inspection and requires replacement, and is not included in routine servicing, is considered over and above.
The tear down discrepancy report must include (as a minimum):
Description of each discrepancy found;
Number of person-hours per discipline required to complete each discrepancy;
Hourly rate for personnel performing the work;
Parts cost less the percentage discount, if any;
Total dollar amount for each discrepancy; and Total dollar amount for the complete list of discrepancies.
The COR will be responsible for reviewing the list of discrepancies and making a recommendation to the Contracting Officer, to either accept or decline the Contractor's proposal.
The Contractor shall not proceed with correcting any discrepancies without prior approval from the Contracting Officer. Funds for “Over and Aboves” will be specified at the time of contract award and included in a specific contract line item number (CLIN). The dollar amount stated in the schedule for this CLIN will represent an estimated total, not-to-exceed amount, to cover charges for over and above items. The Government will pay invoices for over and above items out of the funds allocated and authorized on the “Over and Above” CLIN. It is not possible prior to contract award to accurately estimate the extent and duration of work or to anticipate costs for
“Over and Above” CLINS with any reasonable degree of confidence. Therefore, time and materials provides for acquiring these services on the basis of direct labor hours and cost of materials. Direct labor hours are at specified fixed hourly rates that include wages, overhead, general and administrative expenses, and profit. Cost of materials includes parts and appropriate material handling costs. The price to be paid for material shall be based on an established catalog or list price in effect when material or other product is furnished, less all applicable discounts to the Government. In no event shall the price exceed the contractor's sales price to its most favored customer for the same item in like quantity, or the current market price, whichever is lower.
Replacing, Adding and/or Removing Equipment During Contract Periods:
As AGSE requires adding, replacement or deletion during the course of a contract period, AOC reserves the right to make necessary replacement, additions or deletions from equipment. If a piece of AGSE is replaced with a like item, then the contractor shall complete the required inspections (as the previous equipment received) and shall be paid at the same rate as the previous piece of equipment during that particular contract period. During the next contract re-award (option year), that new piece of equipment shall be modified into the contract. If the replacement equipment is not like the previous equipment, then the contractor will agree in writing to what the scope and interval of maintenance will be required on the new equipment along with a contracted price to maintain the equipment. In this case, the payment will come out of either the “Over and Above” CLIN or be paid using a Government Credit Card. During the next contract re-award (option year), that new piece of equipment shall be modified into the contract. If the AOC adds a brand new piece of equipment during the course of a contract, then the contractor will agree in writing what the scope and interval of maintenance will be required on the new equipment along with a contracted price to maintain the equipment. In this case, the payment will come out of either the “Over and Above” CLIN or be paid using a Government
Credit Card. During the next contract re-award (option year), that new piece of equipment shall be modified into the contract. If the AOC elects to remove a piece of equipment and not replace it, then the vendor will not invoice for that piece of equipment as of the day of removal. During the next contract re-award (option year), that removed piece of equipment shall be modified out the contract.
PLACE OF PERFORMANCE:
The primary place of performance is NOAA/Aircraft Operations Center, Lakeland FL. If equipment cannot be serviced at this location, the contractor shall provide pricing for off- site servicing under the “Over and Above” items. AOC has the right to accept or reject any offsite work.
PERIOD OF PERFORMANCE:
The period of performance for this order is one year from July 1, 2019 thru June 30, 2020 with four (4) one-year option periods. The total performance period shall not exceed 5 years.
SECURITY REQUIREMENTS:
The contractor’s on-site technician must not have any criminal charges, wants, warrants, or felony convictions. Further, the on-site technician must be drug free and be able to obtain (and maintain) a federal security clearance.
The contractor’s on-site technician will receive an in-depth background investigation. This investigation will be conducted by the Federal Government through the Office of Personnel
Management and the Department of Commerce Office of Security. The on-site technician cannot begin working until the investigation package has been submitted and the preliminary background checks are approved. The preliminary background check includes finger-prints through the FBI, validation of the applicant’s identity, and a clearance check of the National
Crime Information Center.
UNAUTHORIZED WORK:
Contractor shall not use the AOC premises to work on any personal vehicle(s) or (anything of the like) on AOC premises. Contractor shall not conduct any work after business hours, or on weekends, without an AOC employee present to supervise the work. Both of these items are liability and safety issues. Contractor, at their own discretion, may work weekends, but will not be paid over-time unless weekend work was directed or approved by the COR.
Courses and Classes:
From time to time, the contractor may require training to maintain AOC AGSE. In this case, the contractor is liable for all expense to obtain the necessary training. As for courses that AOC asks a contractor to attend (i.e…safety stand-down training, or safety survey de-briefs), the AOC will pay for these hours. These hours will be regular straight-time hours. The COR will make any and all decisions regarding a course in which he feels the contractor should attend.
INSPECTION AND REPORTS:
NOAA Aircraft Operations reserves the right to inspect all work performed by the contractor. If any work is deemed unacceptable or incomplete, the COR will notify the contractor of rejected work needing re-work. Final completion of the work performed requires an inspection completion report. The COR will work with the contractor to ensure these reports are completed in a timely manner. All expenses and parts to repair unacceptable or incomplete work is the responsibility of the contractor.
SUBMITTAL OF INVOICES:
The Contractor shall submit invoices as needed, but no later than 5 working days after the work is complete. The contractor shall submit invoices to the COR at the address shown below. All invoices will be reviewed by the COR to determine if the government is properly billed for services provided. Partial invoices will only be processed after the COR acceptance and approval. Invoices may be e-mailed to the COR or mailed to 3450 Flightline Drive, Lakeland
FL, 33811 (ATTN: Support Services Chief).
The Certification and Accreditation requirements of Commerce Acquisition Regulation clause
1352.239-73 Security Requirements for Information Technology Resources (October 2003) does not apply, and a Security Accreditation Package is not required.
