SCOPE OF WORK:
A music library is required for the majority of multimedia products produced by the CED, OMC and NOAA Video Studio. The total number of products that will be created in a given year varies. For example, more than 19 videos will be produced in 2018 for the Ocean Today program. Each multimedia product is unique so we require a large catalog of music to make appropriate selections as needed. For purposes of this statement of work, “music” refers to musical compositions and sound recordings in the contractor’s libraries. “Libraries” refers to groupings of music such as classical, contemporary, and sound effects that are appropriate for the products listed above. The widest possible selection of music should be available.
The element(s) of this project are (listed in no particular order):
The CED, OMC and the NOAA video studio have a requirement for unlimited downloads and unlimited use of music during the term of the agreement for up to 13 user accounts. The music blanket license should grant NOAA the following:
Task 1. Provide online access to a variety of music that will be used in products described above.
The contractor shall make the music available to the government via a web site that is secure and password-protected.
The government will
· Have the non-exclusive right, license and authority to use music downloaded from the contractor’s libraries in the government’s products
· The ability to make and disseminate products incorporating this music per the clearances outlined below
The government requires thirteen users for use of the vendor’s music collection (downloaded from the Internet) at the Silver Spring, MD and Seattle, WA locations for creating the government products.
The government may continue to disseminate these products in perpetuity, even after termination or expiration of this contract, so long as the product is not altered in any way (either its audio or visual parts). Upon expiration of this agreement by either party, the government’s ability to download music from the web site will terminate.
Products created using music from this library will be developed within the United States. However, these products will be posted on public websites that can be accessed worldwide. Additionally, products developed for the Ocean Today program may be sent to museums, aquariums, and other institutions worldwide and to film festivals and other competitions.
Productions using music from this contract will include the following clearances:
1) NON-BROADCAST - Audio, video, CDs, DVDs, and digital media, corporate intranet, closed circuit communications, public kiosks and museums. These products are not for sale to the general public.
2) INTERNET – Websites and free digital downloads/streaming
3) LICENSE – Master and synchronization
Products requiring any clearances other than those noted above will be licensed separately from this contract.
Task 2. Provide monthly reports on access and downloads.
At the end of each quarter, NOAA will supply the contractor with a listing of each music title downloaded under this contract.
3. IT SECURITY REQUIREMENTS
The Assessment and Authorization (A&A) requirements of Clause 48 CFR 1352.239-72 do not apply, and a Security Accreditation Package is not required.
The contractor will only supply hardware and/or software and/or product license and will not require the use of any contractor owned equipment. The contractor will not have remote access to any government owned equipment. The contractor must ensure the hardware and/or software provided disables “phone home” or similar capabilities.
The contractor includes the necessary product support and supporting documentation for the hardware and/or software that allows the sanitization (following NIST Special Publications 800-88 Guidelines for Media Sanitization, http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-88r1.pdf) of the hardware and/or software upon the disposal of the product.
The contractor must provide sufficient document demonstrating the software being provided complies with Office of Management and Budget Memorandum M-07-18 entitled Ensuring New Acquisitions Include Common Security Configurations and the FAR 39.101(d) regulations involving NIST common security configuration checklists including United States Government Configuration Baseline (USGCB) initiative. More information is available at National Checklist Program (NCP), (http://checklists.nist.gov), is the U.S. government repository of publicly available security checklists (or benchmarks) that provide detailed low-level guidance on setting the security configuration of operating systems and applications.
The contractor must provide sufficient documentation which demonstrates the acquiring information technology has implemented common security configurations. Common security configurations are available from the National Institute of Standards and Technology’s website at http://checklists.nist.gov.
The contractor must ensure that the product being purchased complies with the Homeland Security Presidential Directive 12 (HSPD-12) requirements from FAR 4.1302 stating: (a) In order to comply with FIPS PUB 201, agencies must purchase only approved personal identity verification products and services. (b) Agencies may acquire the approved products and services from the GSA, Federal Supply Schedule 70, Special Item Number (SIN) 132-62, HSPD-12 Product and Service Components, in accordance with ordering procedures outlined in FAR Subpart 8.4.
The contractor must ensure that the product being purchased complies with Internet Protocol Version 6 (IPv6) requirements from FAR part 11.002 requirements which state that unless the agency Chief Information Officer waives the requirement, when acquiring information technology using Internet Protocol, the requirements documents must include reference to the appropriate technical capabilities defined in the USGv6 Profile (NIST Special Publication (SP) 500-267- http://www.nist.gov/itl/antd/usgv6.cfm) and the corresponding declarations of conformance defined in the USGv6 Test Program (http://www-x.antd.nist.gov/usgv6/index.html). To meet this requirement each DOC acquisition of IP protocol technology must express requirements for IPv6 capabilities in terms of the USGv6 Profile (i.e., using the USGV6 Capabilities Check List) and vendors must be required to document their product’s support of the requested capabilities through the USGv6 test program (reference http://www.antd.nist.gov/usgv6/) using the USGv6 Suppliers Declaration of Conformity.
The contractor must provide sufficient document demonstrating the software being provided meets the following:
1) The standard installation, operation, maintenance, updates and/or patching of software shall not alter the configuration settings from the approved USGCB/other secure configuration.
2) Applications designed for normal end users shall run in the standard user context without elevated system administration privileges.
The contractor must provide all supporting documentation or a reference to obtain the necessary material which describes the security capabilities, the design and development processes and the testing and evaluation procedures used by the product or services being provided for this acquisition. The contractor must provide all supporting documentation or a reference to obtain the necessary material which describes all product or service updates and enhancements as they are implemented. The product or service supporting documentation could be the user and system administrator guides, which is documents the functional properties of the security controls employed to permit the analysis and testing of the security controls.
If the vendor proposes the use of cloud services, NOS requires an integrated technical solution which meets the security requirements below. For any cloud services being used by the contractor to support this acquisition, the following conditions must be met:
a. Comply with DOC and NOAA Information Technology Security Policies;
b. Must use Cloud Services that are covered under the Federal Risk Authorization Management Program (FedRAMP; http://www.fedramp.gov/) ,

NAM 133052.270304 NOAA ACQUISITION AND GRANTS OFFICE OMBUDSMAN (OCT 2016)
(a) The NOAA Acquisition and Grants Office (AGO) Ombudsman is available to organizations to promote responsible and meaningful exchanges of information. Generally, the purpose of these exchanges will be to:
(1) Allow contractors to better prepare for and propose on business opportunities.
(2) Advise as to technologies and solutions within the marketplace that the Government may not be aware of, or is not fully benefiting from.
(3) Identify constraints in transparency and process.
(b) The AGO Ombudsman will objectively, reasonably, and responsibly collaborate with parties and recommend fair, impartial, and constructive solutions to the matters presented to him/her. Further, the AGO Ombudsman will maintain the reasonable and responsible confidentiality of the source of a concern, when such a request has been formally made by an authorized officer of an organization seeking to do business with, or already doing business with NOAA.
(c) Before consulting with the AGO Ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations with the respective contracting officer for resolution. However, direct access to the AGO Ombudsman may be sought when an interested party questions the objectivity or equity of a contracting officer’s decision, or when there is a bona fide reason to believe that reasonable, responsible, and objective consideration will not be received from an assigned contracting officer.
(d) There are several constraints to the scope of the AGO Ombudsman’s authority, for instance:
(1) Consulting with the AGO Ombudsman does not alter or postpone the timelines of any formal process (e.g., protests, claims, debriefings, employee employer actions, activities involving A76 competition performance decisions, judicial or congressional hearings, or proposal, amendment, modification or deliverable due dates, etc.).
(2) The AGO Ombudsman cannot participate in the evaluation of proposals, source selection processes, or the adjudication of protests or formal contract disputes.
(3) The AGO Ombudsman is not authorized to generate or alter laws, judicial decisions, rules, policies, or formal guidance.
(4) The AGO Ombudsman is not authorized to develop or alter opportunity announcements, solicitations, contracts, or their terms or conditions.
(5) The AGO Ombudsman cannot overrule the authorized decisions or determinations of the contracting officer.
(6) The AGO Ombudsman has no authority to render a decision that binds AGO, NOAA, the Department of Commerce, or the U.S. Government.
(7) The AGO Ombudsman is not NOAA’s agent relative to the service of magistrate or judicial process and cannot be used to extend service of process to another party (whether federal, public, or a private entity).
(e) After review and analysis of a filed concern or recommendation, the AGO Ombudsman may refer the interested party to another more suitable federal official for consideration. Moreover, concerns, disagreements, and/or recommendations that cannot be resolved by the AGO Ombudsman will need to be pursued through more formal venues.
(f) The AGO Ombudsman is not to be contacted to request copies of forms and/or documents under the purview of a contracting officer. Such documents include Requests for Information, solicitations, amendments, contracts, modifications, or conference materials.
(g) Questions regarding this solicitation and contract language shall be directed to Rafael Roman, NOAA AGO Ombudsman, at Rafael.Roman@noaa.gov.
