APPENDIX A

Synopsis/Solicitation Format

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) This solicitation number 12FPC422Q0033 is issued as a request Quote (RFQ), with the intent to issue one Firm Fixed Price Contract. Quotes are requested for four (4) Custom Pontoon Boats in accordance with specifications listed in Attachment A

(iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-06 5/26/2022 which can be found at http://www.acquisition.gov/far/index.html.

(iv) This is a 100% set aside for small business. The applicable NAICS code is 336612 “Boat Building”, which has a size standard of 1,000 Employees. For more information on size standards visit http://www.sba.gov/size.

(vi) Description of Requirement. NRCS – Soil and Plant Science Division is requesting the acquisition of 4 Coastal Zone Soil Survey (CZSS) pontoon vessels / boats for sample and data collection efforts associated with CZSS / subaqueous soil survey projects. Each pontoon vessel must be able to be towed behind a medium duty truck (3/4 ton) and have the capacity to be transported from the state of Maine to Texas. Please see attachment A “Coastal Zone Soil Survey Pontoon Vessel Specifications

(vii) Delivery will be made to: USDA NRCS Soil Survey Regional Office 34407 Bland Rd Ste. 117, Raleigh NC 27609. Deliverables must be provided within 120 days after award.

(viii) The provision at 52.212-1, Instructions to Quoters—Commercial, applies to this acquisition. Attachment B - Addenda Clauses also applies.

52.212-1 INSTRUCTIONS TO QUOTERS—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (Nov 2021)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits a quote, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition—

(1)Is set aside for small business and has a value above the simplified acquisition threshold;

(2)Uses the HUBZone price evaluation preference regardless of dollar value, unless the quoter waives the price evaluation preference; or

(3)Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b) Submission of quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes shall be submitted on company letterhead stationery, or as otherwise specified in the solicitation. As a minimum, Quote s must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotes;

(3) The name, address, and telephone number of the quotes;

(4) A technical description of the items being Quote d in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see

FAR 52.212-3(b) for those representations and certifications that the quoter shall complete electronically);

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple quotes. Quoters are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.

(f) Issuance of purchase order. Your quotation should contain your best technical and price terms. The Contracting Officer may reject any or all quotes. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotes, the Contracting Officer may negotiate final terms with one or more quoter of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate quotes and award a contract without discussions with quoters. Therefore, the quoters initial quote should contain the quoters best terms from a price and technical standpoint.

(h) Multiple awards. The Government reserves the right to issue multiple purchase orders for different line items when advantageous to the government.

(j) Unique entity identifier. (Applies to all quotes that exceed the micro-purchase threshold, and quotes at or below the micro-purchase threshold if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Quoter shall enter, in the block with its name and address on the cover page of its quote, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Quoters name and address. The Quoter also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Quoter to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The quoter should indicate that it is a quote for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(ix) FAR provision 52.212-2, Evaluation-Commercial Items applies to this solicitation.

52.212-2 Evaluation-Commercial Items

(a) The Government will award a Firm-Fixed Price contract resulting from this solicitation to the one responsible quoter whose quote submission conforms to the solicitation and is determined to be the best overall value to the Government through the use of the tradeoff process, price and other factors considered. The Government reserves the right to award to a higher priced Quoter who is rated EXCEEDS EXPECTATIONS for Factor 1; and/or EXCEEDS EXPECTATIONS for Factor 2; and proposes a fair and reasonable price for Factor 3.

The following factors shall be used to evaluate quotes:

Section 1: Evaluation Methodology

Ratings based on Vendor Capability and Approach to Design, Experience & Past Performance, and Pricing aspects of the quote and will utilize the Adjectival Rating (defined below).

The evaluation factors are:

1. Factor 1 - Capability & Approach to Design

2. Factor 2 - Experience & Past Performance

3. Factor 3 - Price

Section 2: Evaluation Factors The award decision is based on evaluation factors that are tailored to the acquisition.

Evaluation factors must:

1. Represent the key areas of importance and emphasis that directly relate to the purpose or objective of the acquisition; and

2. Support meaningful comparison and discrimination between and among competing proposals.

Non-Price Factor One (1) - Capability & Approach to Design and Factor Two (2) – Experience & Past Performance) are equal in importance and when combined are significantly more importance than Price (Factor Three (3)).

1.1.1 Factor 1: Capability and Approach to Design

1.1.2 Quoter’s Capability and Approach to Design

Submission Requirements:

Quote shall describe Quoter’s capability and approach as defined in the solicitation. The Government will evaluate Quoter’s capability and approach in providing the design, manufacture, and delivery of required deliverables identified in the solicitation. The Government will also evaluate the Quoter’s knowledge of the work being performed.

Evaluation Criteria/Methodology:

Capability rating standards focus on strengths, weaknesses and/or risks of Quoter’s quote. Capability shall be rated using rating listed in table below. If an Quoter’s quote demonstrates failure to meet a government requirement, quote will be deemed as a deficiency, resulting in an unacceptable rating and not awardable.

1.2 Factor 2: Past Performance

1.2.1 Past Performance

Submission Requirements:

The contractor shall provide references as required in the solicitation that can support their past performance for this type of requirement. Vendor shall provide past performance information that can support their past performance for this type of requirement. The Government will evaluate Quoter’s past performance through references that can support their past performance and experience in performing tasks like the requirements defined under this RFQ.

1.3 Factor 3: Price

1.3.1 Contract Price

Before the Quote’s specified expiration time, the Government may accept a Quote (or part of a Quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services.
