PART I – THE SCHEDULE

Any prospective contractor desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing from the Contracting Officer soon enough to allow a reply to reach all prospective contractors before the solicitation closing date. Oral explanations or instructions given before the award of a contract will not be binding.
SECTION C. DESCRIPTION/ SPECIFICATIONS/ STATEMENT OF WORK
C.1 Scope of Work The following is a description for water quality sampling and analysis on the Sequoia National Forest. The forest will be separated into four (4) zones. Zone 1 is the Hume Lake Ranger district located in the northern portion of the forest directly east from Fresno, CA and includes three (3) sites. Zone 2 is the Western Divide Ranger District located in the central portion of the forest directly east from Porterville, CA and includes five (5) sites. Zone 3 is the Kern Plateau portion of the Kern River Ranger District located in the southern portion of the forest northeast from Bakersfield, CA and includes four (4) sites. Zone 4 is the Lake Isabella portion of the Kern River Ranger District located in the southern portion of the forest east from Bakersfield, CA and includes seven (7) sites. See zone maps and individual location maps for additional information. Some water systems operate year round and some operate seasonally. Systems may also open or close due to water availability or other factors.
Most of the water systems are classified as transient non-community systems. All systems are to be sampled every month when open (approximately 30 days apart) for bacteriological analysis, nitrate (as NO3) analysis every year and nitrite (as NO2) analysis every 3 years. Sampling should be performed as early in the month as feasible to allow for repeat sampling or other follow up actions as necessary. Approximate travel times to each water system location, the approximate season of use (days in service), and the dates of the last nitrate and nitrite analysis are listed in the attached Water System Reference Information table. Three systems (Pinehurst Work Center, French Gulch campground, and Old Isabella /Auxiliary Dam Area) currently require quarterly analysis for nitrates due to high levels. All analyses shall be conducted by a state certified lab. Nitrate and Nitrite analysis results shall be submitted electronically to the correct jurisdiction providing regulatory oversight. All drinking water systems with State oversight shall have Annual Drinking Water Reports submitted to their respective State Oversight Office.
All persons taking water samples shall be “trained samplers” in accordance with the CA Safe Drinking Water Act regulations. Bacteriological sampling and analysis shall be in accordance with California Code of Regulations, Division 4, Chapter 15, Article 3 Primary standards – bacteriological standards. Routine monthly water quality samples shall be analyzed for Total Coliform and E.coli using the Present/Absent method (unless otherwise directed by the Forest Service or jurisdiction having authority). In the event of an E.coli positive analysis, the jurisdiction having authority shall be contacted for direction on disinfection/inspection/sampling and any type of additional analysis (Presence/Absence, Most Probable Number, etc). All laboratories used for testing and analysis shall be certified for drinking water testing by the State of California.
Chemical sampling and analysis when required shall be in accordance with California Code of Regulations, Division 4, Chapter 15, Article 4 Primary standards inorganic chemicals.
Water meters, where installed, shall be read once each month when the monthly water sample is taken. Approximate locations of the water meters are shown on the sample siting plans. This is an Optional Work Item which may be awarded subject to funds availability and pricing but is not guaranteed.
All samples shall be taken in accordance with supplied sampling siting plans. All positive analyses shall be reported directly through State Water Resources Control Board (SWRCB) website or county jurisdiction as appropriate and to the Forest Service within 24 hours to the zone contact listed below. All repeat samples shall be taken within 24 hours of notification in sets of four (4) until all analysis results are negative and a set of five (5) the following month for every total coliform positive sample.
There are three water systems that currently utilize continuous chlorination to meet drinking water standards (French Gulch Group Campground, Havilah Work Center, and South Fork Recreation Area). Each chlorination system consists of a solution tank and feed pump wired to operate when the well pump is running. Operation and oversight of the chlorination system at each water system is incidental to the cost of water sampling and testing for the system.
The selected contractor for the forest-wide water sampling contract shall be the Sequoia National Forest Water System Operator of Record and must be certified by the State of California as a water system operator. All water systems shall submit Electronic Annual Reports (EAR) each year, documenting specific water system information and format specified by the Waterboard or county jurisdiction.

Bacteriological Analysis Results Reporting
All analysis results and water meter readings shall be mailed or faxed to the Contracting Officer with the monthly invoices. Analysis results only shall also be sent to the county or state health department contact listed as the Regulatory Authority in the attached Water System Reference Information table. Complete contact information is shown in the list below:
The current reporting is as follows: All seasonal systems either recreational or administrative shall be sampled monthly and reported monthly while in operation. All systems open year-round shall be sampled monthly and reported monthly with the exception of Democrat and Johnsondale as stated in the list below for the Regulatory Authority listed. The Democrat and Johnsondale water systems are classified as State Small under county jurisdiction and shall be sampled monthly and reported quarterly. It is the responsibility of the successful bidder to verify the reporting requirements for the Regulatory Authority in the respective Zone prior to contract notice-to-proceed and on a regular basis as requirements have been changing in the State of California.

Forest Service: Facilities Engineer, Sequoia National Forest, 1839 South Newcomb St, Porterville, CA 93257; Phone 559-306-3449, acting contact – Pablo Baca. Submit bacteriological analysis results every month of operation.
Provide bids for routine, repeat, and follow up bacteriological sampling and analysis, chemical Nitrate sampling and analysis, Nitrite sampling and analysis, and monthly water meter reading. Note: Bids shall include travel time, lab analyses, and any other costs involved with sampling and analysis for each site.
· Note: Water Meter reading may or may not be exercised for the current contract as bid; bid price and funding dependent.
· Note: Bid on all water systems as per the Schedule of Items. The Government may close or open water systems as it deems appropriate depending on water source production and funding.
Other Water System Services:
Additional field services are occasionally required to inspect, troubleshoot, disinfect, and take other actions needed to bring a water system back in to compliance after a total coliform positive analysis occurs and the routine corrective actions taken by the Forest Service fail to correct the problem. All persons performing work or disinfecting Public Water Systems shall be Certified Distribution Operators in accordance with CA Safe Drinking Water Act regulations. Submit names, certification numbers, and expiration dates of certified personnel (or a copy of the State of CA Distribution Operator Certificate) with solicitation proposal. These field services will be ordered on an hourly basis as needed using the Field Troubleshooting Services pay item shown in the schedule of items, including transportation.
Additional office services are occasionally required to amend or modify existing water system permits or to comply with other requirements of the jurisdiction providing regulatory oversight. These services will be ordered on an hourly basis as needed using the Office Regulatory and Permit Services pay item shown in the schedule of items, including incidental office supplies and support required to complete transactions with the appropriate jurisdictions.
Additional materials used for disinfecting water system when required, and for operation of continuous chlorination systems where installed. This service will be ordered on a gallon consumed basis as needed to complete the disinfection protocol or operate the chlorination system, pay item shown in the schedule of items, including incidentals.
Provide hourly rate bids for field troubleshooting services and office regulatory and permit services as described above in addition to bids for sampling and analysis of water systems in the four zones.
Please Note: This contract will be for one year with up to four option years to be exercised annually.

Nothing in this part shall be construed to take away any of the Government's rights under the Suspension of Work Clause (52.242-14). Restrictions are as follows:
Work Days and Hours of Work: Work at administrative sites shall be done between 76:00 ap.m. and 67:00 pa.m., and coordinated to minimize disruption toin order to not disrupt the normal business hours operations of the Forest Service.
Scheduling of designated work days and times within these parameters will be agreed on by the Contractor and Contracting Officer prior to work starting under the contract; changes in schedule, other than emergency circumstances (e.g. snow storm/fire/power outage preventing safe access on normal work day) must be by written bilateral agreement of the Contractor and Contracting Officer. In the case of emergencies, the COR may approve a temporary change in work schedule until the emergency situation is resolved.
C.5 Licenses and Insurance Worker’s Compensation Insurance: The Contractor shall provide evidence of Worker’s Compensation Insurance or a valid reason that exempts the Contractor from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.
If the contractor fails to provide the documentation within 10 calendar days after contract time begins, the contract may be terminated for cause in accordance with FAR 52.212-4.
C.6 Government-Furnished Equipment The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract.

SECTION E. INSPECTIONS AND ACCEPTANCE
E.1 Government Inspections Government inspections are for the purpose of satisfying the Government that the services are acceptable and do not relieve the Contractor of the responsibility for maintaining quality control.
Visual inspections will be made on a periodic basis by the Contracting Officer's Representative or designated inspectors. Such inspections do not constitute acceptance by the Government.
The Contractor (or designated representative) is encouraged to be present to observe inspections.
E.2 Specific Inspection Procedures This is a performance-based contract that expresses the Government’s requirements in the form of minimum quality standards to be met. The Contractor must determine the optimal work schedule, frequency, resource allocations, and performance methods to achieve a work product that meets the standards.
F. DELIVERIES OR PERFORMANCE
F.1 Work Timing The Contractor shall begin work within three (3) calendar days after the effective date of the Notice to Proceed.
Failure to begin work on schedule will make the contract subject to immediate termination for cause.
If this solicitation has more than one numbered item, award of more than one item to one contractor will not change the start work dates or the amount of contract time; times will run concurrently.
SECTION G. CONTRACT ADMINISTRATION DATA
G.1 Pre-work Pre-work conference. Before work begins, a pre-work conference is normally held to discuss the contract – especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.
G.3 Payment Payments and Deductions. Payment will be made for fully acceptable work at the prices bid in the schedule of items. In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price (see Section E for deduction thresholds).
Contract Release. Before final payment will be made, the Contractor shall sign a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release.
A Contract Release FS-6300-0016 must be uploaded with request/invoice for final payment in IPP, before final payment will be approved/completed.
A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727, 41 U.S.C. 15).
G.3-1 Invoice Processing Platform (IPP) All payment requests must be submitted electronically through the US Department of the Treasury’s Invoice Processing Platform (IPP). “Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in FAR clause 52.212-4 Contract Terms and Conditions – Commercial Items. The IPP website address is: https://www.ipp.gov.
Under this contract, the following are required to be submitted as an attachment to the IPP Invoice:
Each invoice shall be submitted on the Contractor’s letterhead or invoice form with the following:
1. Invoice date and Government Contract Number.
1. Billing period specified with beginning and ending dates. The beginning date must not be later than the completion date or within any previous billing dates.
1. An accounting (bulleted list, for example) of charges claimed and amounts due, identified by work task and contract line item number.
1. Total amount due for the billing period.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor’s Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank or Bureau of the Fiscal Service within 5 business days of award. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.
If the Contractor is unable to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
SECTION H. SPECIAL CONTRACT REQUIREMENTS
H.1 Quality Control Plan The contractor shall provide a method of self-inspection to assure that the quality of performance meets or exceeds the standards specified in this solicitation. This plan is to be easy to use, maintain, understand, and be applicable to this solicitation. The plan is to be provided with the quote.
H.2 Public officials not personally liable There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.
H.3 Designation of Contracting Officer’s Representative (COR) The Contracting Officer designates the Contracting Officer's Representative (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
H.4 Approval of Subcontracting The Contractor shall request approval from the Contracting Officer prior to entering into any subcontract arrangement. The written notification shall include as a minimum:
1. The name, address and telephone number of the subcontractor;
2. The date upon which the subcontract was entered into and its duration;
3. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate;
4. Documentation of the subcontractor's representative authority.
Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.
PART II – CONTRACT CLAUSES
SECTION I. CONTRACT TERMS & CONDITIONS

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(End of clause) 52.217-8 - Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of the period of performance end date. (a) The Government may extend the term of this contract by written notice to the Contractor within 14 days of the contract end date; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

L.3 FAR 52.237-1 SITE VISIT (Apr 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
L.4 FAR 52.233-2 Service of Protest (SEP 2006)
(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from:

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.
EVALUATION
The Government will award a contract resulting from this solicitation using Simplified Acquisition procedures per FAR part 13. The following factors shall be used to evaluate offers: Price, Technical, and Past Performance.
FACTOR 1. TECHNICAL CRITERIA
1A. Work Plan and Schedule. Address your proposed work plan, including sequence and methodology of accomplishing the work items.
1B. Key Personnel. Provide brief resumes of the persons to be designated as project managers, water system samplers, and water system operators. Include certification documentation. Provide a brief summary of experience, qualifications, and certification documentation for the laboratory planned for water sample testing and analysis.
1C. Quality Control Plan. Address your proposed Quality Control plan. What supervisory measures will you employ to ensure that contract specifications will be met? What are your self-inspection measures, including how you will inspect work for compliance with specifications? Fully explain how project management/oversight will be accomplished for this project.
FACTOR 2. PAST PERFORMANCE.
Furnish a list of three projects of relevant and similar magnitude completed by the firm within the last five years. For each project cited, provide:
0. the name of the project,
0. the location of the project,
0. the total cost of the project,
0. brief narrative of the project (less than ½ page per project),
0. name of the Government Agency, Company, or Individual contracting the work,
0. the name and phone number of the Contracting Officer, COR, or individual administering the project,
0. any evaluations that you received.
The technical proposal must address past performance for both the Offeror and any proposed subcontractors. Companies lacking relevant performance history will be evaluated on past performance information regarding predecessor companies, key personnel, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to this acquisition.
FACTOR 3. PRICE
Provide your most competitive price on the Schedule of Items in Section B.
