Inquiries Any prospective quoter desiring an explanation or interpretation of the solicitation, specifications, etc., must request it in writing, not later than 5 calendar before the closing date, to allow a reply to reach all prospective quoters before submission of their quotes. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Requests for explanation or interpretation of the solicitation, specifications, etc. may be submitted by email to Donna Vandor at donna.vandor@usda.gov.

Submission of Quotes

(a) Electronic Submissions (Email submissions are preferred if possible)

(1) Quoters may submit electronic responses to this solicitation. Email quotes to donna.vandor@usda.gov. Please limit the size of your file to 5 MB or less; more is not always better, so please be concise. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.

(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--

(i) The Contracting Officer immediately shall notify the quoter and permit the quoter to resubmit the quote.

(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and

(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timelines, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.

System for Award Management (SAM)

To be considered for award all bidders must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A BID IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information. Effective June 29, 2018, all non-Federal entities who create or update their registration in SAM.gov will no longer need to have an approved Entity Administrator notarized letter on file before their registration is activated. All non-Federal entities still must mail the original, signed copy of the notarized letter to the Federal Service Desk. Failure to do so within 30 days of activation may result in the registration no longer being active. Contractors who are new to the SAM registration process are highly encouraged to begin registering as soon as possible to avoid any possible delays prior to submission of bid. Modoc National Forest Hay Request Statement of Work

Product Requested: 260 Tons of 6 string rectangle bales of grass hay. Size should not exceed 6 string bale rectangle bales. Vendor is responsible for delivering, unloading and stacking the hay. The hay will be unloaded and stacked on a solid surface within the Double Devil Wild Horse Corrals or in the hay barn. The vendor is expected to bring adequate equipment to complete the unloading and stacking of the hay.

Animals being Fed: The Grass hay will be fed to Wild Horses at Double Devil Wild Horse Facility.

Delivery Location & Times: Double Devil Wild Horse Corrals @ 2400 County Road 74 Alturas, Ca 96101.

Deliveries can be make 7 days a week, between the hours of 8:30 a.m. to 3:30 p.m. Deliveries should start no later than September 15th, 2019 and conclude by September 30th, 2019. To determine quantity each load shall be accompanied by certified weight slip, empty and loaded.

Directions: From Alturas, Ca travel West on Highway 299 approximately 3 miles, turn left onto County Road 73 (AKA Barnes Grade/Crowder Flat Road), Continue on County Road 73 for 2.5 miles, just before the pavement ends, turn left onto County Road 74, towards Devils Garden Conservation Camp (Signs for both the Corrals and Camp present near the roadway), Continue approximately 2 miles down County Road 74, and turn right at the Double Devil Wild Horse Corrals Sign.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Price

(Contracting Officer shall insert the significant evaluation factors, such as (i) technical capability of the item offered to meet the Government requirement; (ii) price; (iii) past performance (see FAR 15.304); and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.)

52.212-3 Offeror Representations and Certifications-Commercial Items. (OCT 2018)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.

(a) Definitions. As used in this provision-

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate-

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology-

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically-

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern-

(1) Means a small business concern-

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that-

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern-

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned business concern means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

The offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products, i.e., an end product that is not a COTS item and does not meet the component test in paragraph (2) of the definition of "domestic end product." The terms "commercially available off-the-shelf (COTS) item," "component," "domestic end product," "end product," "foreign end product," and "United States" are defined in the clause of this solicitation entitled "Buy American-Supplies."
