Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price.
Payment will be made on actual work performed unless otherwise noted.
There is a requirement for payment protections (payment bond or Irrevocable Letter of Credit (ILC)) if quote is over $35,000. The payment bond or ILC will be for 100% of the award price and submitted within 10 days after contract award. See Section 00 72 00 for additional information. There is no bid guarantee required with quote.
Scope of Contract
The intent of this contract is to furnish all labor, equipment and materials necessary to install new asphalt shingles on the Covelo Ranger Station office. Major items of work include but are not limited to: Removing and replacing approximately 4,500 sq ft of asphalt shingles, installing flashing/drip edge, removing and replacing vents and painting vents to match color of new roofing.
Project Location
The Covelo Ranger Station is located in Covelo, CA. From Highway 101, approximately 12 miles north of Willits, turn right on CA-162 E/Covelo Road. Travel on CA-162 for approximately 30 miles to Covelo; Covel Ranger Station is on the north end of town on the right.

Responsibilities: The successful awardee will be required to provide product submittals to the Contracting Officer (CO) for proposed roofing systems, per the specifications. Contractor will provide all roofing materials and incidental supplies. Storage on-site must be pre-coordinated with the CO. Installation shall provide a complete and usable roofing system including but not limited to all surfacing materials, associated venting, penetration sealing, and replacement of any existing gutters. Installation will comply with contract specifications and manufacturer's installation instructions. Contractor will dispose of all waste, including removed roofing materials.
SPECIAL CONDITIONS AFFECTING WORK
(a) Surveys - The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys and measurements performed by the Government.
(b) Weather - Weather conditions should not be a problem for this project during the contract time period.
(c) Access - Contractor will have access to the work site during the contract time period by Forest Service and
County roads.
(e) Use of Utilities - Sanitary facilities in the project area are not available to the Contractor. Potable water and electricity is available to the Contractor.
(f) Tracked Equipment - Tracked Equipment will not be permitted on bituminous and concrete surfaces unless proper precautions are taken to protect them.
(h) Camping Requirements - Before any camp, storage, or service area is operated on National Forest lands or lands administered by the Forest Service, written permission shall be obtained through the Forest Service. See Section J for camping permit form and terms. A camp is interpreted to include the campsite or trailer parking area of any employee working on the project for the Contractor. Contractors and their employees shall comply with the rules and regulations governing the operation of the premises of which they occupy.
SECTION 00 21 - 13 - Instructions to Bidders
Inquiries
Any prospective quoter desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Requests for explanation or interpretation of the solicitation, drawings, specifications, etc. may be submitted by email to Rebecca Wilcox at rebecca.wilcox@usda.gov
Instruction for Submission of Quotes
(a) Submission of Quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes may be submitted via the Schedule of Items plus Technical Response documents of the Quoter's design as specified in the solicitation. As a minimum, quoters must show:
(1) Pricing and Contact Information (use SF 1442 and Schedule of Items)
(2) Acknowledgment of any Solicitation Amendments (use SF 1442);
(3) Response to non-price evaluation factors (see Section 00 21 13, Evaluation Criteria) .
(b) Late submissions, modifications, revisions, and withdrawals of quotes. Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. Quotes received after the designated time may not be considered.
(c) Contract award. The Government intends to evaluate quotes and award a contract without corresponding with quoters. Therefore, the quoter's initial offer should contain the quoter's best terms from a price and technical standpoint. However, the Government reserves the right to correspond if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received.
(d) System for Award Management (SAM). To be considered for award all quoters must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A QUOTE IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information.
Effective June 29, 2018, all non-Federal entities who create or update their registration in SAM.gov will no longer need to have an approved Entity Administrator notarized letter on file before their registration is activated. All non- Federal entities still must mail the original, signed copy of the notarized letter to the Federal Service Desk. Failure to do so within 30 days of activation may result in the registration no longer being active. Contractors who are new to the SAM registration process are highly encouraged to begin registering as soon as possible to avoid any possible delays in future contract awards. Remember, there is no cost to use SAM. To find out additional information about the changes of the SAM registration process, contractors should visit the Frequently Asked Questions (FAQ) link located at the top of the SAM homepage (www.sam.gov).

(e) Unique Entity Identifier (formerly Data Universal Numbering System (DUNS) Number. Place the annotation "Unique Entity Identifier" as well as Electronic Funds Transfer (EFT indicator, if applicable (formerly DUNS+4)" next to your name and address on the first page of your quote. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Quoter to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Quoter should indicate that it is A Quoter for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(f) Electronic Submissions
(1) Quoters must submit electronic responses to this solicitation. Email quotes to rebecca.wilcox@usda.gov. Please limit the size of your file to 5 MB or less. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.
(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--
(i) The Contracting Officer shall immediately notify the quoter and permit the quoter to resubmit the quote.
(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and
(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.
(3) Facsimile Submissions will not be accepted.

Award Determination
Award will be made to the quoter whose quote represents the best value to the Government. Factors to be considered in determining the best value include such matters as price, capability (to include experience of the company and project manager/superintendent and additional resources) and past performance. Price is of equal importance compared to availability and relevant past performance (non-price factors); however, the importance of price may become greater as the difference between availability and relevant past performance decrease. Where capability and past performance are determined to be substantially equal, price may control award. Non-price evaluation factors are considered to be of equal importance to each other. If a quoter takes exception to any of the terms and conditions of the solicitation, including attachments; is not currently registered in SAM; a quoter cannot be verified as a Small Business as shown in SAM or other proof as submitted by the quoter; or an incomplete quote that lacks sufficient information for the government to perform a technical evaluation to determine acceptability without clarification, then the Government may consider its quote to be unacceptable in which case the quote may not be evaluated.
Evaluation Criteria
Non-Price:
(1) Relevant Past Performance: Quoters shall submit references with a current point of telephone (and, if available, email) contact for up to three projects similar to this solicitation. For each, briefly describe the work performed. Price:
The pricing in the Schedule of Items will be used to establish price reasonableness and to demonstrate the quoter's clear understanding of the work to be performed.
52.204-7 System for Award Management. (OCT 2018)
52.222-23 Notice of Requirement for Affirmative Action To Ensure Equal Employment Opportunity for Construction. (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled Affirmative Action Compliance Requirements for Construction, and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the-
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the covered area is CA Butte; CA Colusa; CA El Dorado; CA Glenn; CA Nevada; CA Sierra; CA Sutter; CA Yuba.

52.222-5 Construction Wage Rate Requirements-Secondary Site of the Work. (MAY 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.225-10 Notice of Buy American Requirement - Construction Materials. (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American-Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225- 9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR
52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested-
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights-
(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination.
The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records.
