The Experience Questionnaire will be used as part of this evaluation.

(vi) Description of Requirement (including a list of any attachments)

Scope of Contract

This contract requires the Contractor to furnish and apply Calcium Chloride dust palliative materials on Forest roads. The Contractor shall provide all equipment, operating supplies, operators, supervision, and support functions necessary to perform the work in compliance with these terms, specifications, and provisions. This work is being solicited as a performance based service contract. Performance based means the Contractor is responsible for an end product. If an end product is not provided in compliance with the contract specifications, an adjustment to the payment will be made.

Location and Description

The work is located throughout northern Idaho and western Montana on the Lolo, Flathead, Kootenai, Bitterroot, and Idaho Panhandle National Forests (Attachment 3 Vicinity Maps). Maps describing in detail the roads and vicinities of the project will accompany task orders issued for the work.

Site Visit

No site visit is planned for this project. For further information, please contact the Contracting

Officer, Michael Lucas at Michael.j.lucas@usda.gov.

Existing Structures

All existing structures such as signs, cattle guards, and culverts damaged by the Contractor shall be replaced or repaired by the Contractor at no additional cost to the Government.

End Product Criteria

After performing Dust Abatement operation, the roadway:

- Shall have a uniform spread of abatement material on the road.

- Shall be no over-spray running into ditches or waterways.

- Shall have a product that complies with SPS 412.

- Shall have an Application Rate as listed on the task orders.

- Shall not have been contaminated by other products hauled in the distribution equipment.

- Shall have been accomplished within the requirements of the solicitation.

Contractor’s Quality Control Plan

The Contractor, not the Government, is responsible for management and quality control actions to meet the terms of this contract. The role of the Government is quality assurance to ensure contract standards are met.

Records of quality inspections shall be kept and made available to the Government throughout the performance period and for the period after contract completion until final settlement of any claims under this contract.

After Award, the Contractor shall provide a Quality Control Plan that outlines, in part, a performance strategy and addresses all major points contained in the Quality Assurance Plan, Attachment 1.

Government’s Quality Assurance Plan

See attached Quality Assurance Plan (Attachment 1) for full understanding of all tasks required and acceptable quality levels.

Delivery Time

The Contracting Officer's Representative (COR) will inform the Contractor of the proposed delivery date and issue task orders for each subitem at least 2 weeks in advance. The COR will confirm the delivery order a minimum of 48 hours prior to the desired time of delivery.

If the Contractor fails to deliver the product by the specified time, the Contractor may be assessed actual damages to the Government, including but not limited to all costs incurred in road surface watering and blading, as well as administrative costs.

Delivery Locations

Specific delivery locations will be identified in the task order. Projects will be combined when advantageous and practical. Due to steep grades, narrow roads or lack of an adequate turn around location, tractor trailer and truck trailer hauling units may have to be off loaded to distribution vehicles adjacent to the state highway for some task orders. Contractors should inspect all road systems to ensure that their hauling and distribution vehicles are suitable for use.

Basis of Payment

(a) Quantities stated in the Schedule of Items are estimates only and will be used for evaluation of quotes. Delivery of quantities in excess of those estimated will not be required unless agreed to by the Contractor. When each hauling/distribution vehicle cannot be readily weighed to determine quantities, the actual weight of material in vehicle tanks shall be determined at the start of the project. Thereafter, the number of vehicle loads applied to the road surface shall be used for quantity determination, provided each load is filled to the same level, each load is completely emptied on the project, and material lost from the load is deducted. The COR may direct additional check weighing of loaded and empty vehicles at any time.

(b) Payment will be made at the contract unit prices, for actual quantities accepted in accordance with the Quality Assurance Plan of this contract, less any adjustment for sub-standard materials.

Prices for Years 2023 and 2024 will go into effect January 1st of each year.

Effective Period of the Contract

The effective period of this contract is:

2022 Date of award through February 28, 2023

2023 March 1, 2023 – February 29, 2024

2024 March 1, 2024 – February 28, 2025

Pollution and Erosion Control

(a) All refuse, including garbage, rubbish, and solid or liquid wastes from the Contractor’s operations, including camps, parking areas, and equipment maintenance areas shall be stored and collected in a sanitary manner and disposed of in a State-approved sanitary landfill or as approved by the Contracting Officer.

This notice, when delivered to the Contractor or the Contractor’s representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required. After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or refuses to promptly take corrective action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The

Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this clause.

Wash water or waste water from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

Mechanized equipment shall not be operated in live streams without written approval by the

Contracting Officer.

Barricades, Warning Signs, and Other Devices

The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic. The

Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagmen and pilot car operators and equipment, and other protective devices, except for special devices, shall conform with Part VI of the Manual on Uniform Traffic

Control Devices for Streets and Highways, published by the Federal Highway Administration and applicable safety codes. Necessary warning signs and guards shall be posted during blasting operations to safeguard the public.

All subsequent move-ins of equipment shall be treated the same as the initial move in. Prior to initial move-in of all equipment, and all subsequent move-ins, the Contractor shall make equipment available for inspection at an agreed location
