SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

GENERAL SPECIFICATIONS

INTRODUCTION AND BACKGROUND

In order to implement elements identified in the CONT D3 Indian Treatment Cultural Survey area it is the purpose of the procurement to produce a map or maps, inventories of identified heritage resources, textual report detailing the findings of a 100% pedestrian heritage resource survey (less areas of ≥ 40% slope) of the proposed project area, and data input of spatial and narrative information into the National

Resource Management (NRM Heritage 9.0) system and the New Mexico Cultural Resource Information

System (NMCRIS), and document all findings in a cultural resource report. The report shall incorporate literature, archival, and field information as warranted by the nature of the site(s) identified as a result of the pedestrian survey. This statement of work pertains to 2,000 acres to be surveyed.

PROJECT LOCATION

The CONT D3 Indian Treatment project area is part of the Guadalupe Woodlands EA which consists of approximately 2,000 acres located on the Guadalupe Ranger District of the Lincoln National Forest.

The topography of the area consists of steep canyon walls and a gently sloping canyon floor. The dominant overstory vegetation consists of piñon and juniper woodland with agaves, cholla, whitethorn acacia. The project is at an elevation of 5,800 feet. Soils are derived from limestone parent materials and are shallow rocky clay loams on the ridges and deep alluvial clay loams in the canyon bottoms.

The geographical setting for the Turkey Treatment Project Archaeological Survey is located in the following described areas:

CONT D3 Indian Treatment-Area of Potential Effect (APE)

Total Acres in APE to be surveyed: 2,000

T23S, R20E, Sections 11 and 14 as shown on the Algerita, New Mexico, 7.5' USGS topographic map.

T23S, R20E, Sections 11, 12, 13, and 14 as shown on the Ares Peak, New Mexico, 7.5' USGS topographic map.

T23S, R21E, Sections 7, 8, 17, and 18 as shown on the Ares Peak New Mexico, 7.5' USGS topographic map.

SCOPE OF WORK

The contractor shall provide the necessary qualified personnel and any and all labor, equipment, supplies, services, permits, and licenses, necessary to perform a 100% pedestrian archaeological survey, excluding ≥ 40% slopes, surveys that are less than 15 years, and the Sacramento Peak Observatory

The contractor shall arrange for LINC PASSES and input of spatial and narrative information into the

National Resource Management System (NRM Heritage 9.0) system and the New Mexico Cultural

Resource Information System (NMCRIS). Computers located at the Lincoln National Forest will be made available for data entry

A field meeting is required with the Forest Inspector and/or Forest Service archaeologist prior to developing the Work Plan. The Work Pan shall include a Safety Plan to identify hazards that could occur during the project.

The contractor shall also include a time line for completion of all work. The plan shall be submitted to the Contracting Officer’s Representative (COR) for approval 2 weeks prior to commencing the field work.

Records Search

The contractor shall review the survey reports, site forms, the National Resource Management System

(NRM Heritage 9.0), the New Mexico Cultural Resource Information System (NMCRIS), Government.

Land Office plats, orthophotos, and any other pertinent files or records available at the Lincoln National

Forest Supervisor’s Office which pertain to the project area (including proximate, relative areas). In addition, the contractor shall be familiar with the general prehistory and history of the Lincoln National

Forest and southern New Mexico to develop a context for the cultural resources discovered during the course of the survey.

Survey Work Standards

For the purposes of this survey and to ensure complete coverage of the survey area, the contractor shall conform to the U.S. Forest Service, Region 3 Standards, as described in the Forest Service Hand book

2309.24, Chapter 10, Survey Standards. A 100% archaeological pedestrian survey is defined as the systematic intensive inspection of the land surface, excluding ≥ 40% slopes, using parallel transects spaced no more than 15 meters apart. Any proposed deviations from this transect interval must be identified and justified in the offeror’s technical proposal.

Each qualified surveyor shall keep and record field notes describing terrain and vegetation, cultural remains, observational problems, and procedures used to accommodate or compensate for them. All field notes shall be submitted for review to the Forest Service upon request.

In addition, any proposed use of shovel testing during this survey must be clearly defined and justified in the technical proposal.

Site Recording

The contractor shall record and/or update all cultural resource sites located in the project area in accordance with the State of New Mexico, Historic Preservation Division, Archaeological Resources

Management Section guidelines and standards, and with the USDA-Forest Service Region 3 Cultural

Resources Handbook 2309.24 Chapter 10. All sites shall be documented on Laboratory of

Anthropology Site Forms.

Site Definition

For the purposes of this survey, a site is defined as a locus of purposeful prehistoric or historic human activity. An activity is considered to have been purposeful if it resulted in a deposit of cultural material beyond the level of one or a few accidentally lost artifacts. Loci of human activity not classifiable as sites by this definition should be considered and recorded as isolated occurrences.

Heritage resources, which include at least one of the following, are here defined as sites:

1. one or more features;

2. one formal tool if associated with other cultural material or more than one formal tool;

3. an occurrence of cultural material (for example; sherds, lithic debris, historic artifacts) that contains one of the following:

a. three or more types of artifacts or material;

b. two types of artifacts or material in a density of, at least ten items per 100 square meters;

c. a single type of artifact or material in a density of, at least twenty-five items per 100 square meters.

As a general rule, site designations are reserved in the case of historic remains for those at least 45 years old.

All previously recorded cultural resource sites located within the survey area that have been determined to be eligible or undetermined will be updated using the Laboratory of Anthropology site inventory update form.. All sites within the survey area that have been which previously determined not eligible will need to checked to see is there has been any changes, then discuss the findings in the report. All

Historical Cultural Property Inventories (HCPI’s) shall be recorded or updated using the HCPI form

Evaluate each heritage resources site and make a recommendation regarding its eligibility to the

National Register of Historic Places using all criteria listed in 36 CFR 60.4, USDA-National Register

Bulletin 15, and provide all appropriate site, feature, and artifact documentation as required by the New

Mexico State Historic Preservation Office as justification for a determination of eligibility.

A minimum of two trowel or shovel probes will be excavated in all new sites to aid in the determination of site significance/eligibility. The total disturbance from informal probing will not exceed one square meter. An eligibility recommendation of “Undetermined” may be made, with justification, when eligibility if inconclusive based on surface and subsurface observations.

Each discovered or updated cultural resource site will be digitally photographed, with resolutions minimally 5 megabyte and photographs should be submitted on a CD or thumb drive. As many photographs as are necessary to clearly depict the condition of each site and the features present should be taken. At least two photographs shall show the physical environment and configuration of the land making up the site. Photographs should also illustrate surface evidence of features and site disturbance.

The following applies to all eligible cultural resource sites:

The site boundary shall be marked with white paint pursuant to the description identified in Chapter 10, § 15.1 (Site Markings) of the R3 Cultural Resources Handbook. Site boundaries marked on the ground should correspond to the boundaries as mapped. A datum tree or other convenient, fairly permanent object, such as a fence post, will be established as near as possible to the center of the site or next to a prominent feature of the site. An aluminum tag with the site number shall be attached to the datum at stump level with an aluminum nail. The site datum shall also be identified by placing two bands of white paint around it.

The USDA-Forest Service realizes that this marking system is not always possible at each site; any deviation from this system should be discussed with the Contracting Officer’s Representative and documented in the report. The Forest Service also requests that all sites that can be observed from a primary road not be marked with white paint.

Prior to project implementation all sites considered eligible will need to have be re-flagged for avoidance.

Each discovered or updated heritage resource site will be mapped using resource-grade Global

Positioning System (GPS) units. Accuracy shall be five meters or less. GPS data files shall be submitted to the Forest Service and include meta data on the type of GPS unit used, accuracy, and process used for differential correction of the data (if any). All sites, including linear sites, must be submitted as polygons.

The spatial files used to record site locations, survey/inventory areas, test units, and other important spatial data shall be submitted to the Forest Service in the form of GIS digital files in a geodatabase format compatible with the Forest Services GIS software (currently ESRI ArcMap 10-5-1). Digital files will be required for each project; one file will contain site locations (one digital shapefile for each site, do not combine all sites into one digital shapefile). A digital file for all located isolated occurrences and a digital file on the area surveyed and/or inventoried. All GIS data shall be provided using NAD 83 datum and projected using the Universal Transverse Mercator (UTM) system, using the appropriate

UTM Zone for the project area.

Each discovered heritage resource site will be digitally photographed, with resolutions minimally 5 megabyte and photographs should be submitted on a CD or thumb drive. As many photographs as are necessary to clearly depict the condition of each site and the features present should be taken. At least one photograph shall show the physical environment and configuration of the land making up the site.

Photographs should also illustrate surface evidence of features and site disturbance.

Recording Non-Site Cultural Remains (Isolated Occurrences)

When an isolated occurrence (I.O.) is encountered, it shall be recorded in the field with resource-grade

Global Positioning System (GPS) units, shall be accurately plotted on the appropriate 7.5 minute USGS map, and briefly documented, including artifact type and standard measurements. Accuracy of GPS units shall be five meters or less. GPS data files shall be submitted to the Forest Service and include meta data on the type of GPS unit used, accuracy, and process used for differential correction of the data

(if any). The spatial files used to record the I.O’s shall be submitted to the Forest Service in the form of

GIS digital files in a geodatabase format compatible with the Forest Services GIS software (currently

ESRI ArcMap 10-5-1). All GIS data shall be provided using NAD 83 datum and projected using the

Universal Transverse Mercator (UTM) system, using the appropriate UTM Zone for the project area.

Collections

Artifact collections are not authorized under the terms of this contract, except in the case of “rare finds”

(jewelry, whole or nearly whole ceramic vessels, etc.) or if the collection is absolutely necessary to adequately assess the resource.

When collection is necessary, the artifact will be point provenienced to a permanent datum established by the contractor and the location of the artifact shown on the site map. All collected materials shall be analyzed and discussed in the final report. All collected materials will be catalogued prior to turning them over to the Lincoln National Forest. Curation of the collected artifacts will be the responsibility of the United States Government and all collections remain the property of the United States Government.

Disposition of Collections and other Investigation Documentation

All material and data produced by the contractor or in work in support thereof, are, and shall be, the sole property of the United States Government; unlimited rights in ownership, usage, and equity for such materials and data, and shall be, transferred without reservation to the United States Government.

Materials include, but are not limited to, the following items: manuscripts, outlines, abstracts, field notes, artwork (including maps, sketches, charts, tables and related overlays), photography (including negatives, transparencies, prints, and microfiches), collected artifacts, and data sheets. The final report will be distributed to interested parties by the government.

The contractor shall arrange for LINC PASSES and input of spatial and narrative information into the

National Resource Management System (NRM). Computers located at the Lincoln National Forest will be made available for data entry

The contractor may use the archaeological data resulting from this survey for future research purposes as long as the USDA Forest Service, Lincoln National Forest is acknowledged as the source of the data.

Report

After fieldwork is complete, the contractor will provide a report which describes the anticipated project activities that could impact cultural remains, survey methodology, recommendations for site protection, and survey results. The report will be used for National Historic Preservation Act, Section 106 consultation between the USDA-Forest Service and the New Mexico State Historic Preservation Office and as such, shall provide sufficient information with which to conduct these procedures.

The report must be accompanied by a completed R-3-FS-2300-4 form (Inventory Standards and

Accounting form), Laboratory of Anthropology NMCRIS Project Activity Number, Laboratory of

Anthropology site inventory forms, HCPI recording forms, all artifact recording forms, with diagnostic artifact drawings, I.O forms, with diagnostic artifact drawings, and all other appropriate recording forms, as well as the necessary number of 7.5' USGS topographic maps required to show clearly the locations of all heritage resources found, the survey boundaries, and the project location. All site locations will be marked on the topographic maps in accordance with standards set forth in the USDA-Forest Service

Region 3 Cultural Resources Handbook. All topographic maps included in the report shall contain a heading in accordance with the standards set forth in the USDA-Forest Service Region 3 Cultural

Resources Handbook.

In the report, findings of new sites, and update of sites, will include a summary table of all fire-sensitive sites. Table will include site number, site type, fuel loading, and what causes fire-sensitivity. This information is based on Laboratory of Anthropology Site Inventory Form, version 2001, section 3.

Condition and 4. Recommendations.

One unbound copy of the draft report and LA site forms will be sent to the Lincoln National Heritage

Department for review prior to final report. The report will be returned to the contractor if there are editorial or typographic errors, reproduction or production flaws, format/content discrepancies or any other problems, which cause it to be of less than professional quality.

All hand prepared pages such as maps and drawings must be of professional quality and legible when reproduced in black and white. Offset printing or high quality photocopying will be acceptable for the text. The report must be clean and suitable for reproduction. The various recording forms and the topographic maps showing project and heritage resource locations should be originals. 6. Unless otherwise designated by the Contracting Officer, the use of this area is not exclusive, and may be granted to other Permittees, contractors, or recreating public. Disorderly conduct is not permitted.

7. Damaging or removing any natural feature or other property of the Forest Service is prohibited.

H-3 MIGRANT AND SEASONAL AGRICULTURAL WORKER PROTECTION ACT

FSAR 4G52.222-701 Employment of Eligible Workers (DEC 1999)

Section 274A of the Immigration and Nationality Act (8 USC 1324a) makes it unlawful for an employer to hire undocumented workers. The Immigration and Naturalization Service (INS) has established the

Form I-9, Employment Eligibility Verification Form, as the document to be used for employment eligibility verification (see 8 CFR 274a).

The contractor is required to (1) have all employees complete and sign the I-9 Form to certify that they are eligible for employment; (2) examine documents presented by the employee and ensure the documents appear to be genuine and related to the individual; (3) record information about the documents on the form, and complete the certification portion of the form; (4) retain the form for three years, or one year past the end of employment of the individual, whichever is longer.

It is illegal to discriminate against any individual (other than a citizen of another country who is not authorized to work in the United States) in hiring, discharging, or recruiting because of that individual's national origin or citizenship status.

Compliance with Section 274A of the Immigration and Nationality Act (8 U.S.C. 1324a) is a material condition of the contract. If the contractor employs unauthorized workers during contract performance in violation of section 274A, the Government may terminate the contract, in addition to other remedies or penalties prescribed by law.

For further information on the requirements of the Act, contractors should contact the Employer and

Labor Relations Officer of their local INS office.

FSAR 4G52.222-702 Labor Standards for Contracts Involving Migrant and Seasonal

Agricultural Workers (DEC 1999)

(a) General. This contract is subject to the Migrant and Seasonal Agricultural Workers Protection Act

(MSPA) (29 U.S.C 1801-1872) and to Department of Labor regulations implementing MSPA (see 29

CFR 500). The purpose of MSPA is to eliminate activities that are detrimental to migrant and seasonal agricultural workers, to require registration of farm labor contractors, and to assure necessary protections for the workers. In addition to traditional farm labor activities, the Act applies to predominately manual forestry work including, but not limited to, tree planting, release, precommercial thinning, and site preparation and wildland fire fighting.

(b) Definitions.

"Migrant Agricultural Worker" and "Seasonal Agricultural Worker", as used in this clause, mean individuals employed in agricultural (including forestry) work on a seasonal or temporary basis. A worker who moves from one seasonal activity to another is employed on a seasonal basis even though the worker may continue to be employed during a major portion of the year. Migrant workers are required to be absent overnight from their permanent place of residence. Seasonal workers are not required to be absent overnight from their permanent place of residence. Members of the contractor's immediate family are not considered to be either migrant or seasonal workers. "Immediate family" includes only (1) spouse; (2) children, stepchildren, or foster children; (3) parents, stepparents, or foster parents; and (4) brothers and sisters.

"Farm Labor Contractor", as used in this clause, means an individual who, for any money or other valuable consideration, paid or promised to be paid, performs any recruiting, soliciting, hiring, employing, furnishing, or transporting of any migrant or seasonal agricultural worker.

(c) Registration Requirement. Any contractor who provides or hires migrant or seasonal workers to perform agricultural or manual forestry work shall first obtain a Certificate of Registration from the

Department of Labor or an authorized State agency. The contractor shall carry the Certificate at all times while engaged in contract performance, and shall display it upon request. Any of the contractor's employees who also perform any one or more of the activities defined for a "Farm Labor Contractor" in paragraph (b) must have their own Farm Labor Contractor Employee Certificate.

(d) Worker Protections. The contractor shall comply with the following protections and standards related to wage disclosure, record keeping, vehicle safety, and housing:

(1) The contractor shall display and maintain at the place of employment the MSPA poster provided by the Department of Labor.

(2) Wage and Payroll Standards

(i) The contractor shall disclose in writing to each worker in a language common to the worker the full terms of their employment, including workers compensation information, at the time they are recruited or hired. The Department of Labor provides an optional form WH-516 for contractor's use in disclosure.

(ii) The contractor must keep the following payroll records for each employee: name, address, social security number, basis for wages (i.e. per hour, per tree, per acre), number of units earned if paid on a per unit basis, hours worked, total pay, withholdings and purpose for each, and net pay. Payroll records shall be retained for three years.

(iii) Payments must be made no less frequently than every two weeks or semi-monthly. At the time of each payment, the contractor shall provide to the employee a written itemization of the information listed above and which shall include the employer's tax identification number.

(iv) If paid on a piece rate basis, the employee's wage must be at least equivalent to the required hourly wage for the hours worked, including overtime differential for time in excess of 40 hours per week.

(3) Motor Vehicle Safety

(i) The contractor must register all vehicles used to transport employees, unless employees provide their own transportation or carpool by their own arrangement in one of their own vehicles. The authorization to transport employees must appear on the contractor's certificate. If the contractor directs or requests employees to carpool, the registration requirement is still applicable. Any driver who transports workers for a fee or at the direction of the contractor must be registered as a farm labor contractor or a farm labor contractor employee.

(ii) Any vehicle under the ownership or control of the contractor shall comply with safety standards applicable to that vehicle. Generally passenger vehicles or station wagons must comply with

Department of Labor regulations at 29 CFR 500.104. Vehicles other than passenger vehicles or station wagons which are driven more than 75 miles must comply with Department of Transportation

Regulations referenced at 29 CFR 500.105. All drivers must have a current, valid State driver’s license and must comply with Department of Transportation work/rest requirements.

(iii) Each vehicle under the ownership or control of the contractor which is used to transport any migrant or seasonal agricultural worker shall be covered by vehicle insurance in accordance with applicable state requirements.

(4) Housing

(i) The contractor shall house workers only in a commercial establishment or a facility that has been certified by a health authority or other appropriate agency. The contractor must post the certificate of occupancy at the housing site.

(ii) The authorization to furnish housing, other than commercial lodging, must appear on the contractor's certificate.

(e) For further information on the requirements of the Act, contractors should contact their local Wage and Hour Division of the Department of Labor.

Worker Housing

Supplement to 4G52.222-702 (d) (4) Add the following to the clause at H.8.2, subparagraph (4)

Housing:

(iii) If the contractor is not furnishing worker housing:

Workers on this contract may obtain housing only in a residential accommodation, including a commercial establishment such as a hotel or motel, which meets all applicable state and federal standards for employee housing.

Within 10 days after award, and prior to the issuance of Notice to Proceed, the contractor must notify the

Contracting Officer of the planned worker housing site.

If the housing site is located on a National Forest, the Contractor must obtain a permit from the District

Ranger for the District on which the housing site is located and the facilities established for the workers must meet the applicable U.S. Department of Labor (USDOL) MSPA standards for such sites.

If the housing site is not located on a National Forest, the site must meet the applicable housing standards in MSPA.

If an exemption from the permit requirement is claimed, the contractor must provide a written statement identifying the law authorizing the exemption, stating the facts constituting an exemption under that law, and identifying a USDOL employee or official who stated or concurred that the accommodations were exempt, citing name, date, and means of communication.

If the housing site is changed after approval by the Contracting Officer, the contractor must provide a new Permit or exemption statement. The above requirements are material conditions of this contract. If the contractor fails to comply, the Government may terminate the contract. In addition, other remedies or penalties prescribed by law may apply

Field Sanitation

In accordance with US Department of Labor Fact Sheet No. ESA 97-28 “Field Sanitation Standards”

(Ref. 29CFR 1928.110), employers must provide:

► Potable drinking water, suitably cool and in sufficient amounts, dispensed in single-use cups or by fountains, located so as to be readily accessible to employees.

► Facilities maintained in accordance with public health sanitation practices include upkeep of water quality through daily change or more often if necessary.

► Notification to each employee of the location of the water and allowance of reasonable opportunities during the workday to use them. The employer also must inform the employee of the relevant health hazards in the field and the practices necessary to minimize them.

Employees cannot be made to bear the costs incurred by the employer for providing required facilities.

FSAR 4G52.222-703 Migrant and Seasonal Agricultural Worker Protection Act Registration

(DEC 1999)

The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) (29 U.S.C. 1801-1872) and implementing regulations issued by the Department of Labor (29 CFR 500), require any employer who hires or anticipates hiring employees subject to MSPA to obtain an MSPA registration number.

If the contractor employs or anticipates hiring employees subject to MSPA, the contractor shall provide a valid U.S. Department of Labor MSPA Registration Number to the Contracting Officer within 10 days after notification of award of the contract.

The Government may demand that the contractor display MSPA registration at any time during contract performance if it appears that the contractor is employing workers subject to MSPA. On demand, the contractor shall display its MSPA registration or state why it is exempt from MSPA.

Compliance with MSPA is a material condition of the contract. If the contractor fails to provide a valid

MSPA number in accordance with this clause, or falsely states that it is exempt from the MSPA, the

Government may terminate the contract, in addition to other remedies or penalties prescribed by law.

Cancellation or Change of Required Worker’s Compensation Insurance clause.

There shall be no cancellation, material change, potential exhaustion of aggregate limits or non-renewal of insurance coverage(s) without thirty (30) days written notice from the Contractor or its insurer(s) to the Contracting Officer. There shall be no lapse in the required coverage or any reduction in required limits during the life of this contract. Any failure to comply with the requirements of this clause shall constitute default of Contract and may be grounds for immediate termination for default of this Contract.

KEY PERSONNEL (AGAR 452.237-74) (FEB 1988)

(a) The Contractor shall assign to this contract those persons whose resumes, personnel data forms or personnel qualification statements were submitted as a requirement of the contract. No substitution or addition of personnel shall be made except in accordance with this clause.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment.

The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below.
