SCOPE OF WORK

The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other necessary incidentals necessary to perform the Stock Boarding Services.

The number of Stock may be increased and decreased throughout the life of the BPA based on need and a subsequent determination of maximum available forage and space by the Contractor and Forest Service (FS).

Introduction and Need: The Grand Mesa, Uncompahgre and Gunnison National Forests has a need for Stock Boarding Services within 15 miles of Montrose or Delta.

Estimates are 2 to 6 stock from approximately June through September and 4 to 27 stock from October through May.

Details: The stock boarding facility/pastures must be in a location that is convenient and easily accessible and must be free of harmful or risky objects.

This contract shall cover the basic stock needs including feed, water, salt block, shelter, space and an aptitude or desire to provide stewardship to stock when FS personnel are not present.

Forage: An adequate supply of forage must be provided for each animal. During late fall and winter each animal will be provided with 20 pounds of hay per day when the grasses in the pasture are devoid of nutrient value; or each animal will be provided enough hay to ensure that they maintain their body weight. The hay must be of a high quality and considered “horse hay” (recommended attributes include dry, clean, a good stem to leaf ratio, composed primarily of palatable grasses, with a protein level between 14-20 percent) and shall not show any signs of mold; weed-free hay is preferred if locally available and price is approved by FS. The hay will be paid for as part of the contract. Prices will be set in the fall yearly and based on fair market value.

When supplemental hay is fed, hay shall be spread such that all horses get access to feed and timid horses are not run off feed by dominant horses.

Supplemental feed may be provided if forage quantity and quality is deemed by Forest Service (FS) personnel to be insufficient for maintenance of stock health. This could include times of total snow cover or lack of available forage. The supplemental feed will be purchased by the FS.

Salt Block: Stock shall always have access to mineralized salt blocks.

Drinking Water: Stock shall have access to a continuous supply of fresh drinking water;

approximately 12 gallons per head per day. Water may be provided by a spring fed pond or creek that runs through the stock’s pasture. Care should be taken to ensure that the route to the water is kept open at all times. Pond or creek banks should be monitored to ensure that the stock have adequate footing and are not slipping when drinking. An acceptable alternative is a water tank/trough with floating or submersible heater and an adequate wildlife escape ramp.

Shelter: Shelter should be provided to enable the stock to escape wind, moisture and to provide shade. Large groves of trees are acceptable.

Fence Requirements: Fencing must be in good repair and to a standard that will confine stock. All fence maintenance is the responsibility of the contractor. Fence preference is for smooth wire;

other types of fence are acceptable if in good repair, however preference shall be given for “stock-friendly” or smooth wire fences.

Other Needs: Area provided shall be large enough to allow less dominant stock to move away from dominant stock.

The contract area must always be available to the FS so that stock can be picked up and dropped off on any day and at any hour. It must also be available so that employees can check on the conditions of the animals and facility.

Must provide an area large enough to provide ingress/egress for trucks and stock trailers with room to turn around.

A corral or “trap” pasture is needed where stock can be segregated for illness, shoeing or to facilitate catching early in the morning or on repeated use days.

Noxious weeds, especially those that can harm stock shall be controlled by the landowner.

We prefer that animals under different ownership are not boarded in the same pasture as the FS stock. The Contractor shall notify one of the individuals listed in the Emergency Contact List if planning to add non-Forest Service stock to the same pasture. We prefer that stock that are put in adjacent pastures are monitored to prevent across fence fighting issues. If other stock are boarded with or are in pastures adjacent to FS stock, we ask that the Contractor provide proof of negative Coggins and proof of current vaccinations to an FS employee listed in the Emergency Contact List.

The Contractor shall provide due diligence in taking care of stock. Damages will only be sought in cases of extreme negligence by the Contractor.

Emergency Situations: In the event of an emergency the Contractor shall utilize the Emergency Contact List in Attachment 1. The FS employees are listed in the order in which they should be contacted. If the first person on the list is unavailable, move to the second person on the list and so on. In the event that no employee can be reached, the Contractor may take emergency action and call a local Veterinarian to examine the animal at the facility, or may transport the animal to a veterinarian if necessary.

Routine Health Care Items: All routine health care items such as shoeing, trimming, vaccinations, worming and other items will be the sole responsibility of the FS and not part of this contract.

GENERAL INFORMATION

1. Description of Agreement and Locations:

The BPA will be in effect for 5 years unless cancelled.

The number of animals (horses, mules) and frequency of service is unknown and will change throughout the life of the BPA.

2. Extent of Obligation

The Government is only obligated to the extent of authorized calls actually placed against this BPA by authorized personnel, against authorized items.

3. Purchase Limitations

BPA Calls should not exceed $50,000 per BPA Call.

The limitation for each individual call under this BPA shall not exceed the Simplified Acquisition Procedure limit for Commercial items established in FAR 13.5 or $225,000.00 for the life of each BPA.

5. Delivery tickets

All shipments under this agreement shall be accompanied by sales slips/invoices that shall contain the following minimum information:

(i) Name of supplier.

(ii) BPA number.

(iii) Date of purchase.

(iv) Purchase/Call number.

(v) Itemized list of supplies or services furnished.

(vi) Quantity, unit price and extension of each item, less applicable discounts.

(vii) Date of delivery or shipment.

Tickets must be furnished within 48 hours via hard copy, scan/email, or fax to designated Forest Service representative. Tickets must show the location(s) of weed spraying.

7. Invoices

Invoices must be submitted for each project or BPA Call.

An individual invoice will be required for each delivery or as specified and allowed by each call. The “Submit Invoice-to” address for all orders is the Department of Treasury’s Invoice Processing Platform (IPP). The Contractor shall register and submit all invoices via IPP unless otherwise noted in an individual call. 8. Placement of Calls Information from Calls placed against this BPA must be provided directly to the contact. Agency personnel authorized to place calls against this BPA MUST furnish a list of calls placed to the COR and Contracting Officer monthly.

9. Completion Date of Calls The completion date for calls shall be established when each call is placed.

10. Payment and Acceptance Will be stated and defined on a call-by-call basis. Payments will be made through (Electronic Funds Transfer (EFT) via IPP (see Paragraph 7 above) unless otherwise noted on a specific call.

Payment will be made as requested by the property holder. Minimum is yearly.

11. Cancellation of BPA The United States Government reserves the unilateral right to cancel this BPA by providing written notification to the Contractor.

The Contractor may withdraw from this BPA upon written request to the Contracting Officer.

Withdrawal from the BPA does not affect awarded calls.

13. Period of Performance

The agreement shall be reviewed annually before the anniversary of its effective date and revised as necessary to conform to the requirements of the Federal Acquisition Regulation. The government may place calls under this BPA for a period of 5 years from the date of award.

14. Modifying the BPA

This Blanket Purchase Agreement shall be changed only by modifying the agreement itself and not by individual orders issued under it. Only the Contracting Officer, or their designated successor, identified in paragraph 12 may modify this BPA.

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services- Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision—

“Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

Contractors are not prohibited from providing—

(1)A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer—

(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-25 Prohibition on Contracting Certain Telecommunications and Video Surveillance Services or Equipment (AUG 2019)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
