STATEMENT OF OBJECTIVE

BLANKET PURCHASE AGREEMENT FOR SNOW REMOVAL –

1. Background The U.S.D.A. Forest Service, Grand Mesa, Uncompahgre and Gunnison National Forests- Norwood Ranger District has a requirement for Snow Plowing and Removal Services. The GMUG NFs seek to streamline the acquisition process by taking advantage of strategic procurement of snow plowing and removal services.

2. Description of Agreement This Blanket Purchase Agreement (BPA) will utilize specifications to define the requirements of each call placed.

Description/Specifications/Statement of Work

1. SCOPE OF WORK:

The Contractor shall furnish all equipment, transportation, labor, supervision, and supplies necessary to plow snow and provide service to haul away large amounts of snow to maintain both parking lots and areas in a clean, safe and accessible condition. Work is required to be performed as described prior to 7:00 a.m. and after 5:00 p.m., seven days a week. Performance will be according to the standards indicated herein.

It is the intent of the government to enter into a Blanket Purchase Agreement (BPA) to provide snow plowing and snow removal services as specified. Where the term “contract” may be used herein, it shall refer to the resultant BPA or any resulting BPA Call Order placed under a BPA.

A definitive number of snow plowing, and snow removal services is unknown. It is the intent of the Government to have these services made available as needed.

This BPA will begin on the date of award and will be in effect for one year. If each of the four options are renewed the BPA will extend for a maximum of five years. The options are awarded yearly, after evaluation of the existing contract.

All orders placed against this BPA will be placed on a BPA Call Order. This call will identify the service needed and the date required. Call Orders will be issued on an as needed basis at any time during the life of this BPA. In some cases we will put funding on a BPA call to cover the services expected to be needed at the beginning of the season.

2. LOCATION AND DESCRIPTION OF AREA:

The site and descriptions of work are as follows (Refer to Figure 1 at the end of this document for a

Google Earth image of the contract area location & outline of where plowing is to occur):

Physical Address: 2742 HWY 145 Ophir, CO 81426 The cabin is rented throughout the winter months any day of the week via www.Rec.gov. Plowing and removal should be completed seven days a week, Sunday PM-Saturday PM, prior to 7:00am and after 5:00pm if snowfall is 6” or greater. Plow Parking Lot #2 (parking for guests to cabin) and Parking Lot #1 (additional parking for guests and for Nordic skiers). Walkways to the cabin/outbuildings, and removal of snow from the roof of the building will be taken care of separately by our Recreation Staff. When snow begins to fall with heavy and rapid accumulations shortly before or during business hours, Contractor will begin plowing the snow from the parking lots and driveway using the fastest method possible. Contractor must be from local area.

For snowfalls 6” or greater, all snow shall be plowed away from the buildings and pushed/piled into areas that make the least amount of impact to the available parking areas indicated on the map. If snow needs to be hauled off site, please notify the Norwood District before moving it.

3. ADDITIONAL GUIDELINES

a. Contractor will comply with all federal, state and local governmental laws, regulations, codes and ordinances.

b. All work shall be completed in a workmanlike manner consistent with customary industry practices.

c. All fire hydrants must be kept free from snow and easily accessible in case of emergencies.

d. Contractor shall not create drifts in front of dumpster enclosures, fire lanes, or entrances or on sidewalks. Contractor agrees to remove Contractor-created drifts at no additional cost.

e. Contractor agrees to contact the Contracting Officer Representative if for some reason during business hours the properties cannot be completely plowed prior to 7:00 a.m.

f. Contractor agrees to provide after hour’s telephone numbers.

4. Extent of Obligation

The Government is only obligated to the extent of authorized calls actually placed against this BPA by authorized personnel, against authorized items.

5. Purchase Limitations

The limitation for each individual call under this BPA shall not exceed the Simplified Acquisition Procedure limit for Commercial items established in FAR 13.5 or $200,000.00 for the life of the BPA.

6. Individuals Authorized to Purchase Under this BPA

- The following individuals are authorized to place orders under this contract:

The COR will be required to keep a log of orders placed.

7. Delivery tickets All order under this agreement shall be accompanied by sales slips that shall contain the following minimum information:

(i) Name of supplier.

(iii) Date of purchase.

(iv) Purchase/Call number.

(v) Itemized list of supplies or services furnished.

(vi) Quantity, unit price and extension of each item, less applicable discounts.

(vii) Date of delivery or shipment.

8. Invoices

An individual invoice will be required for each delivery or as specified and allowed by each call. The “Submit Invoice-to” address for all orders is the Department of Treasury’s Invoice Processing Platform (IPP). The Contractor shall register and submit all invoices via IPP unless otherwise noted in an individual call. This platform is managed by the U.S. Department of Treasury and additional information is available at this website: https://www.ipp.gov/index.htm.\

9. Placement of Calls Calls placed against this BPA may be shipped directly to the Vendor. Reports should be furnished by email to the individual authorized to submit information for BPA Calls.

10. Completion Date of Calls The completion date for calls shall be established on each call.

11. Payment and Acceptance Will be stated and defined on a call-by-call basis. Payments will be made through (Electronic Funds Transfer (EFT) via IPP (see Paragraph 8 above) unless otherwise noted on a specific call.

12. Cancellation of BPA The United States Government reserves the unilateral right to cancel this BPA by providing written notification to the Contractor.

The Contractor may withdraw from this BPA upon written request to the Contracting Officer.

Withdrawal from the BPA does not affect awarded calls.

14. Period of Performance

The agreement shall be reviewed annually before the anniversary of its effective date and revised as necessary to conform to the requirements of the Federal Acquisition Regulation. The government may place calls under this BPA for a period of 5 years from the date of award.

15. Modifying the BPA

This Blanket Purchase Agreement shall be changed only by modifying the agreement itself and not by individual orders issued under it. Only the Contracting Officer, or their designated successor, identified in paragraph 13 may modify this BPA.

16. Evaluation Criteria

The Government will award a contract resulting from this request for quote to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government based on lowest price, past performance, delivery schedule and ability to meet the required specifications.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

452.228-71 Insurance Coverage. (NOV 1996) Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. (c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury.

Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

452.237-70 Loss, Damage, Destruction or Repair. (FEB 1988)

(a) For equipment furnished under this contract without operator, the Government will assume liability for any loss, damage or destruction of such equipment, not to exceed a total of $[n/a] except that no reimbursement will be made for loss, damage or destruction due to (1) ordinary wear or tear,

(2) mechanical failure, or (3) the fault or negligence of the Contractor or the Contractor's agents or employees.

(b) For equipment furnished under this contract with operator, the Government shall not be liable for any loss, damage or destruction of such equipment, except for loss, damage or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

(c) All repairs to equipment furnished under this contract shall be made by the Contractor and reimbursement, if any, shall be determined in accordance with (a) or (b) above. Repairs shall be made promptly and equipment returned to use within 8 hours. In lieu of repairing equipment, the Contractor may furnish similar replacement equipment within the time specified. The Contractor may authorize the Government to make repairs upon the request of the Contracting Officer. In such case, the Contractor will be billed for labor and parts costs.

452.237-74 Key Personnel.(FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Snow Plow Operator

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.
