Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Region 2 AQM; San Juan National Forest
2. Description of Action: This request is for a new follow-on contract vehicle to finish Collaborative Process Management Process training for the San Juan National Forest Leadership Team (FLT) begun under Blanket Purchase Agreement (BPA) AG-82CS-B-15-0001. The contract will be a firm fixed price contract and will include a contract line for travel reimbursement in accordance with current Federal Travel Regulations. Funding for this requirement is from the NFTM job code. The anticipated dollar value of this procurement is not to exceed $100,000.
3. Description of Supplies/Services: The services to be acquired are for FLT training in Collaborative Process Management to improve effectiveness and efficiency of the Team.
4. Authority Cited: FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services will satisfy agency Requirements.
5. Reason for Authority Cited: A BPA was put in place in 2015 for Collaborative Process Management training and consultation as the San Juan FLT recognized the need to improve its effectiveness and relevancy to the San Juan National Forest in recognizing, preparing, and implementing strategic plans for the forest. The BPA had a ceiling price of $150,000. During the life of the BPA a total of $81,500 was obligated for this purpose under two BPA Calls in 2015 and 2016 with an expiration date of December 31, 2018. Because of turnover in the contracting and purchasing staff in 2016 and 2017 and an unusually active fire season in 2018, the program was put on hold until September of 2018 when the training process was reinitiated. This training program is the intellectual property of Rebecca Reynolds Consulting, Inc. (RRC) and no other vendor is capable or authorized to teach this material. Although other vendors are capable of providing similar training, the FLT has vested significant resources in this particular program and vendor to date and a different vendor would necessitate starting the process over again with very little to gain from the additional time and money. The required schedule of services is from March 1, 2019 through April 30, 2020 with the intent of maintaining the momentum of the past few months with no break in services.
6. Efforts to Obtain Competition: The original BPA was competed and awarded on a best value basis to RRC, Inc. In order to maintain the current flow of training it is necessary to remain with the current vendor as a logical follow on to the original competed requirement.
7. Actions to Increase Competition: None have been taken for this particular requirement as competition is not practical. Once the high level Collaborative Process Management training has been completed any future similar requirements will be made available to competitive procurement actions.
8. Market Research: RRC's website was researched to determine if the training program was made available to other training providers. RRC maintains the exclusive right to present this training program.
9. Interested Sources: To date, no other sources have written to express an interest. The notice required by FAR 5.201 will be published upon approval of this Justification for Other Than Full and Open Competition. Any response received from that notice will be used to verify that no other source exists for this specific requirement.
10. Other Facts:
a. Procurement history
The original BPA was competed and awarded on a best value basis but the performance end date expired on December 31, 2018 making a BPA Call against the original BPA unallowable. Re-competing the requirement is impractical as other vendors do not have access to the same training material that the Forest has already invested in. This follow on contract will allow the forest to realize the full potential of the training program as originally envisioned.
